Today Aug/18/2021 the same tow company hit us again with $365.00 for impound fees to recover our pick-up. Once again I woke up ready to go work when I noticed the pick-up was missing. I almost had a heart attack, I called San Bernardino Police to report the truck missing , officer identify himself as "Mitanc" refused to take a report or give me the number of the perpetrator because "that is not a criminal act" Once again the pick-up was towed from behind our condo but was reported to Police that it was parking in a fire-lane at another address. ---------- Forwarded message --------- From: Frank Audi Date: Thu, Jul 15, 2021 at 6:36 PM Subject: Re: repeated illegal impound of our vehicles from behind our garage To: Jeff Dracup Hi Dear When I spoke to you the first time You estimated a $3500 retainer, Now the retainer went to $7500.?. More than double What has changed in 10 days.? On Thu, Jul 15, 2021 at 4:07 PM Jeff Dracup wrote: Hi Frank. I agree, these impound lots are nothing more than criminal operations. I recently had a car put into one of these lots because of a car accident and they completely misrepresented the daily fees. We can initiate a legal action against the company as soon as we receive a $7,500 deposit which is necessary if we are to become attorneys of record and legal action in court. Recharge against the deposit and refund any unused portion at the end of the matter. If you would like to start the lawsuit please reply in the affirmative and we will send you the fee agreement via DocuSign and the invoice by email from QuickBooks. They ignored our offers for settlement and repeatedly impound our vehicles in a gangster style. They sold my work truck on an illegal lien sale despite my objection We need to sue them as soon as possible. Please let us know if and when can you file a court action, Thank you On Wed, Jul 14, 2021 at 2:45 PM Jeff Dracup wrote: Hi Frank. I apologize for not responding sooner. I've been on vacation and just got back last night. This is a matter we could help with on an hourly basis only. If you'd like us to get involved and send a demand letter and try to negotiate a release of the vehicle, we would need a $1,500 retainer against which we would charge $350/hour. Very often these impoundments are done illegally. If you'd like to proceed, please reply to all in this email and we'll send you the invoice for the $1,500 (via email from QuickBooks) plus and email from DocuSign with our fee agreement. We look forward to representing your best interests. Best regards, - Jeff Jeffrey A. Dracup California State Bar # 110516 Dracup & Patterson, A Professional Corp .
