Background As of January 1, 2019, the state legislature prohibits local authorities from regulating sidewalk vending activities, except in accordance with Senate Bill 946 (SB946). The
passage of SB 946 has decriminalized sidewalk vending activities and prohibits local agencies from issuing for sidewalk vending. SB 946 explicitly stated that the legislation did not
affect the applicability of the California Retail Food Code, which permits criminal enforcement as to sidewalk vendors who sell food. On June 5, 2019, the Mayor and City Council of
the City of San Bernardino approved ordinance MCSan Bernardino. The ordinance in place allows the city to regulate sidewalk vending activities within the City of San Bernardino. To
enforce the regulations of sidewalk vending staff has identified several within the municipal code
