Recommendation
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Adopt Resolution No. 2020-79 of the Mayor and City Council of the City of
San Bernardino, California, authorizing the City Manager or Assistant City
Manager to submit an application for the projects utilizing Permanent Local
Housing Allocation Funds from the California Department of Housing and
Community Development; and
2. Adopt Resolution No. 2020-92 of the Mayor and City Council of the City of
San Bernardino, approving the Permanent Local Housing Allocation Funds
Section 302(c) (4) Plan.
Background
The California Department of Housing and Community Development (HCD) has
released a Notice of Funding Availability (NOFA) of approximately $195 million for the
Permanent Local Housing Allocation (PLHA) program. Funding for the NOFA is
provided pursuant to Senate Bill 2. Senate Bill 2 was signed into law by Governor
Brown on September 29, 2017 and took effect January 1, 2018. It creates a $75 fee on
certain real estate transaction documents when they are recorded, capped at $225 per
transaction. The fee does not apply to sales of residential and commercial properties
but instead to other transactions like mortgage refinancing and county fixture filings.
Senate Bill (SB) 2 established the Building Homes and Jobs Trust Fund so that 70
percent of the moneys collected would be deposited into the Fund, beginning in 2019,
and allocated local governments for eligible housing activities. The intent of SB 2 is to
provide a permanent source of funding to local governments for housing-related
projects and programs that address the unmet housing needs in their communities.
On April 15, 2020, the Mayor and City Council approved Resolution 2020-60 that
approval, HCD revised its template resolution. The new resolution template includes

language that commits jurisdictions to utilize deed restrictions on for sale properties to
ensure compliance with program requirements, and that assistance to rental projects
will require the developments to remain affordable for 55 years. Consequently, the City
Council will need to adopt the new version of the resolution.
Discussion
Under the PLHA program, HCD is required to allocate 90 percent of the funds based on
the federal Community Development Block Grant (CDBG) formula. The remaining 10
percent is required to be distributed through a competitive grant program for
communities that do not receive CDBG allocations. The current NOFA covers the first
year of the program and the subsequent four annual allocations.

RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN
BERNARDINO, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR ASSISTANT
CITY MANAGER TO SUBMIT AN APPLICATION FOR PROJECTS UTILIZING
PERMANENT LOCAL HOUSING ALLOCATION FUNDS FROM THE STATE
DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT
All of the City
consents to, adopts, and ratifies the following resolution:
A. WHEREAS, the Department is authorized to provide up to $195 million under the
SB 2 Permanent Local Housing Allocation Program Formula Component from the
Building Homes and Jobs Trust Fund for assistance to Cities and Counties (as
described in Health and Safety Code section 50470 et seq.
(Chapter 364, Statutes of 2017 (SB 2)).

C. WHEREAS Applicant is an eligible Local government applying for the program to
administer one or more eligible activities, or a Local or Regional Housing Trust Fund
to whom an eligible Local government delegated its PLHA formula allocation.
D. WHEREAS the Department may approve funding allocations for PLHA Program,
subject to the terms and conditions of the Guidelines, NOFA, Program requirements,
the Standard Agreement and other contracts between the Department and PLHA
grant recipients;
NOW THEREFORE BE IT RESOLVED THAT:
1. If Applicant receives a grant of PLHA funds from the Department pursuant to the
above referenced PLHA NOFA, it represents and certifies that it will use all such funds
in a manner consistent and in compliance with all applicable state and federal
statutes, rules, regulations, and laws, including without limitation all rules and laws
regarding the PLHA Program, as well as any and all contracts Applicant may have
with the Department.
2. Applicant is hereby authorized and directed to receive a PLHA grant, in an amount not
to exceed the five-year estimate of the PLHA formula allocations, as stated in
Appendix C of the current NOFA ($9,732,162), in accordance with all applicable rules
and laws.
3. Applicant hereby agrees to use the PLHA funds for eligible activities as approved by
the Department and in accordance with all Program requirements, Guidelines, other
rules and laws, as well as in a manner consistent and in compliance with the Standard

Agreement and other contracts between the Applicant and the Department.
4. Applicant certifies that, if funds are used for the acquisition, construction or
rehabilitation of for-sale housing projects or units within for-sale housing projects, the
grantee shall record a deed restriction against the property that will ensure
compliance with one of the requirements stated in Guidelines Section 302(c)(6)(A),(B)
and (C).
5. Applicant certifies that, if funds are used for the development of an Affordable Rental
Housing Development, the Local government shall make PLHA assistance in the form
of a low-interest, deferred loan to the Sponsor of the Project, and such loan shall be
evidenced through a Promissory Note secured by a Deed of Trust and a Regulatory
Agreement shall restrict occupancy and rents in accordance with a Local government-
approved underwriting of the Project for a term of at least 55 years.
6. Applicant shall be subject to the terms and conditions as specified in the Standard
Agreement, the PLHA Program Guidelines and any other applicable SB 2 Guidelines
published by the Department.
7. City Manager Teri Ledoux or Assistant City Manager Rebekah Kramer are authorized
to execute the PLHA Program Application, the PLHA Standard Agreement and any
subsequent amendments or modifications thereto, as well as any other documents
which are related to the Program or the PLHA grant awarded to Applicant, as the
Department may deem appropriate.

Provide a description of the way the Local government will prioritize investments that increase the supply of housing for households with incomes at or below 60
percent of Area Median Income (AMI).
The City of San Bernardino plans to prioritize investments to several categories of households over the next five years. When using funds to assist with multifamily rental housing, the
City will target households at 60% AMI or lower. For workforce housing, the City will assist households earning 120% of AMI or lower. When the City assists homeless households,
they will target those which earn 30% of AMI or lower. Finally, when providing homeownership assistance the City will also target those households earning between 80% and 120%
The City's Housing Element supports all four eligible activities included in the PLHA Section 302(c)(4) Plan.The Housing Element facilitates provision of housing opportunities that are
affordable to all economic segments of the community, including homeownership and multifamily rental for households with varied income levels. Several of the Housing Element
Goals are consistent with the proposed PLHA Plan: 1) Goal 3.2 Conserve and improve the existing affordable housing stock and revitalize deteriorating neighborhoods; 2) Goal 3.3

Community Action Partnership of San Bernardino (CAPS), and Family Service Association of Redlands (FSA). The City anticpates providing services to an additional 100 homeless

The PLHA funds will be used to expand the City's existing homeownership program which uses blighted, vacant lots for the construction of new affordable single family homes. The
City provides financing assistance to construct the homes and financing for first time home buyers. It is anticipated that 15 households can be assisted with aquisition financing
during the five-year Plan. Outreach and marketing to homeowners is underway, and the waiting list will be updated monthly.
Fiscal incentives made by a county to a city within the county to incentivize approval of one or more affordable housing Projects, or matching funds invested by a county
in an affordable housing development Project in a city within the county, provided that the city has made an equal or greater investment in the Project. The county fiscal incentives
shall be in the form of a grant or low-interest loan to an affordable housing Project. Matching funds investments by both the county and the city also shall be a grant or low-interest
deferred loan to the affordable housing Project.

RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN
BERNARDINO, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR ASSISTANT
CITY MANAGER TO SUBMIT AN APPLICATION FOR PROJECTS UTILIZING
PERMANENT LOCAL HOUSING ALLOCATION FUNDS FROM THE STATE
DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT
All of the City Council members of the City of San Bernardino (“Applicant”) hereby
consents to, adopts, and ratifies the following resolution:
A.WHEREAS, the Department is authorized to provide up to $195 million under the
SB 2 Permanent Local Housing Allocation Program Formula Component from the
Building Homes and Jobs Trust Fund for assistance to Cities and Counties (as
described in Health and Safety Code section 50470 et seq.
(Chapter 364, Statutes of 2017 (SB 2)).
B.WHEREAS the State of California (the “State”), Department of Housing and
Community Development (“Department”) issued a Notice of Funding Availability
(“NOFA”) dated 02/26/2020 under the Permanent Local Housing Allocation (PLHA)
Program;
C.WHEREAS Applicant is an eligible Local government applying for the program to
administer one or more eligible activities, or a Local or Regional Housing Trust Fund
to whom an eligible Local government delegated its PLHA formula allocation.
D.WHEREAS the Department may approve funding allocations for PLHA Program,
subject to the terms and conditions of the Guidelines,NOFA, Program requirements,
the Standard Agreement and other contracts between the Department and PLHA
grant recipients;
NOW THEREFORE BE IT RESOLVED THAT:
1.If Applicant receives a grant of PLHA funds from the Department pursuant to the
above referenced PLHA NOFA, it represents and certifies that it will use all such funds
in a manner consistent and in compliance with all applicable state and federal
statutes, rules, regulations, and laws, including without limitation all rules and laws
regarding the PLHA Program, as well as any and all contracts Applicant may have
with the Department.
2.Applicant is hereby authorized and directed to receive a PLHA grant, in an amount not
to exceed the five-year estimate of the PLHA formula allocations, as stated in
Appendix C of the current NOFA ($9,732,162), in accordance with all applicable rules
and laws.
3.Applicant hereby agrees to use the PLHA funds for eligible activities as approved by
the Department and in accordance with all Program requirements, Guidelines, other
rules and laws, as well as in a manner consistent and in compliance with the Standard
Agreement and other contracts between the Applicant and the Department.

4.Applicant certifies that, if funds are used for the acquisition, construction or
rehabilitation of for-sale housing projects or units within for-sale housing projects, the
grantee shall record a deed restriction against the property that will ensure
compliance with one of the requirements stated in Guidelines Section 302(c)(6)(A),(B)
and (C).
5.Applicant certifies that, if funds are used for the development of an Affordable Rental
Housing Development, the Local government shall make PLHA assistance in the form
of a low-interest, deferred loan to the Sponsor of the Project, and such loan shall be
evidenced through a Promissory Note secured by a Deed of Trust and a Regulatory
Agreement shall restrict occupancy and rents in accordance with a Local government-
approved underwriting of the Project for a term of at least 55 years.
6.Applicant shall be subject to the terms and conditions as specified in the Standard
Agreement, the PLHA Program Guidelines and any other applicable SB 2 Guidelines
published by the Department.
7.City Manager Teri Ledoux or Assistant City Manager Rebekah Kramer are authorized
to execute the PLHA Program Application, the PLHA Standard Agreement and any
subsequent amendments or modifications thereto, aswell asany other documents
which are related to the Program or the PLHA grant awarded to Applicant, as the
Department may deem appropriate.
