HomeMy WebLinkAboutRES 2020-054 Approve First Amendment to Consultant Services Agreement with Paragon Partners, Ltd.RESOLUTION NO.2020-54 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST AMENDMENT TO THE CONSULTANT SERVICES AGREEMENT WITH PARAGON PARTNERS, LTD. EXTENDING THE CONTRACT TERM TO DECEMBER 30, 2021 WHEREAS, on June 20, 2018, the Mayor and City and Council adopted Resolution No. 2018-189 approving the Operating Budget and Capital Improvement Program (CIP) for FY 2018/19; and WHEREAS, funding for 40th Street Widening Between Johnson Street and Electric Avenue has been approved as part of the City's CIP; and WHEREAS, plan, specifications and environmental have been completed for 40th Street Widening Between Johnson Street and Electric Avenue; and WHEREAS, on September 05, 2018, the Mayor and City Council adopted Resolution No. 2018-248 approving an Agreement with Paragon Partners, Ltd. in the amount of $123,100 to perform all Right -of -Way (RAW) functions that are necessary to obtain required R/W for the 40th Street Widening Between Johnson Street and Electric Avenue (SSO4-014 ("Project"); and WHEREAS, the City now wishes to extend the term of the Agreement through December 31, 2021 enter into a First Amendment to Consultant Services Agreement with Paragon Partners, to memorialize the extended the term. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Manager or her designee is hereby authorized and directed to approve First Amendment to Consultant Services Agreement with Paragon Partners, Ltd. to extend the contract to December 30, 2021, a copy of which is attached as Exhibit "A" and incorporated herein. SECTION 3. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable.
