B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation - Government Code Section 54956.9(d)(4)): one case
INVOCATION AND PLEDGE OF ALLEGIANCE
Chaplain Russ Fritz of the SBPD Chaplain Corps led the invocation. Alejandro Herrera,
fifth grade student from Bradley Elementary School led the Pledge of Allegiance.
CLOSED SESSION REPORT
Assistant City Attorney Sonia Carvalho reported that the mayor and council authorized
outside counsel to file an appeal in Saenz and Hanna v City of San Bernardino. The
vote was 3-3, with the mayor breaking the tie.
PRESENTATIONS
1. Certificate of Recognition – Anthony Parnther – San Bernardino Symphony
Orchestra Maestro - Mayor Valdivia
Mayor Valdivia introduced the Mr. Parnther, the new music director for the SBSO
and presented him a certificate of welcome to the City.
2. Citizen of the Month – Belvedere Neighborhood Association - Council
Member Shorett
Councilmember Shorett honored the Belvedere Neighborhood Association members
as citizens of the month for their reinvigoration of the group and a cleanup of Foothill
Boulevard the previous week.
3. Resolution – El Chicano Newspaper 50th Anniversary – Gloria Macias
Harrison - Mayor Pro Tem Richard
Mayor Pro-tem Richard and Mayor Valdivia presented a resolution co-founder
Gloria Harrison and El Chicano newspaper for its 50 years of weekly circulation.

The paper is the first English language Chicano newspaper, originally staffed by 6
volunteers.
4. San Bernardino County Transportation Authority - Mt. Vernon Bridge
Paula Beauchamp, Director of Project Delivery for San Bernardino County
Transportation Authority, provided an update on the rehabilitation of the historic
bridge, including response after recent earthquakes.
5. Chamber of Commerce & Local Elected Officials Announcements
Jim Wheeler, Chairman of the Board of Directors for the Chamber, announced the
upcoming Chamber events and recognized long time San Bernardino businesses.
PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA
Cheryl Brown, speaking on behalf of Hardy Brown, San Bernardino, spoke about a
public charter school and responsiveness of the police chief to issues there after the
previous council meeting. He commended the professional manner that the chief
displayed in talking to a member of the public. And said that all vacant manager
positions in the city should be posted for all to apply and require an annual HR study of
the diversity of the city employees.
Treasure Ortiz, San Bernardino, questioned the council’s actions and said they would
bankrupt the city if they continue to make bad decisions involving the animal shelter, the
cut in pay for the city clerk and city attorney and the police department.
Phillip Peterson, San Bernardino, said that everything in San Bernardino is not perfect
but crime is going down and response times have been cut. He said there is a lot of
good things happening in San Bernardino and is tired of the negativity and that the
negativity is part of the problem. He encouraged people to patronize local businesses.
Thomas Fleming, San Bernardino, said that when you try to support local businesses,
you see homeless people relieving themselves outside. He also spoke about Africans
being a majority in the world, said the airport being used by amazon is ridiculous and
people ought to be given cheap flights to other places and adding a tax that would help
improve the city.
Joyce Seeger, San Bernardino, spoke about the Transitional Assistance Department
being built near her ward and said people have reached out to council members in other
wards to ask for their support in the neighbors’ efforts against the project and asked if it
were happening in a residential area of their ward how they would feel about it. She
sked those up for election if they could tell their constituents that they did the right thing.
Robert Porter, (delivered by Sandra Ibarra) San Bernardino, said he loves the people
of San Bernardino and the city itself and that he is rooting for them.
Lynn Wear, San Bernardino, said some may wish that the residents would fade away
and end their opposition to the TAD project but that would not happen. She said that
opponents would continue to advocate for a Development Code update to be specific
without room for ambiguity leading to interpretation, fostering confusion and
inconsistency and lays the groundwork for potential misconduct. She said it is a flawed
application process and asked if the council had the political will to make it right.
Kathy Mallon, San Bernardino, spoke about residents’ united opposition to the TAD
project. This administration thinks that if they stonewall and obstruct the search for

facts, that the opposition would fade away and any mistakes fraud or developer
collusion would be swept under the rug. They will use all legislative and legal opposition
available to stop the project. She spoke about a public records request that had not
been completely fulfilled in the time allotted for response.
Leo Duarte, said that the San Bernardino, Inland Empire league and the soccer
community to ask that Nunez Park soccer field be rehabilitated. He spoke of 12 years of
problems that caused broken legs and other issues and thanked the council and mayor
for all previous help and support.
Eric Eisenhammer, said he had seen the community’s progress and challenges and he
has compared real estate prices across the state and that the best prices exist in San
Bernardino and said the city needs to find investors to restore the downtown. The city is
at the crossroad to attract business, create jobs and attract investors to grow the
economy.
Gil Botello, San Bernardino, thanked the mayor for LED lights in the Meadowbrook
area. And that 7500 LED lights have been placed in the city and it is about quality of life
and safety.
Rebekah Walker, San Bernardino, has been teaching in the city for more than 15 years
and recently purchased a house in the city. She said she has a problem with the
“walking dead” on 40th street. Asked if there was something in place to attack the
homeless issue at Wildwood Park and if there was anything in place to attract
businesses to the area.
Jennifer Grant, San Bernardino, said an easement behind her house with a lot of dry
grass and trees that are a fire hazard. She has called for someone to take care of it.
She complained about the potholes and asked if there could be paving of streets on the
west side.
Amelia Lopez, San Bernardino, spoke about the Neighborhood Leadership Academy
and thanked those who attended the opening at City Hall. The inaugural class will begin
in October and said the academy will teach skills to help people make a difference in
their neighborhoods and offered information about how to apply.
Clementina Pena, San Bernardino, asked about the TAD project and why the city was
spending money on new buildings when there are empty buildings and need for street
maintenance. She said she cannot remember the last time she saw a street
maintenance crew and said a neighborhood had been hurt because of the state of the
streets in the neighborhood.
Luis Ojeda, San Bernardino, invited the public to a street clean up and said there was
an upcoming meeting regarding the issue of illegal vendors and the city needs to
address it. He said the Food Fest needs security to control homeless and vandals that
make the venue dangerous.
Chad White spoke about his cannabis distribution business being almost ready to
open. He thanked staff for helping them get to this point and they are ready to providing
more than 500,000 in taxes and revenue to the city this year.
Jesus Medina, San Bernardino, thanked everyone who attended the previous week’s
Food Fest for their support. He said that when residents collaborate with the city, great
things can happen.
