The Joint Regular Meeting of the Mayor and City Council of the City of San Bernardino
was called to order by Mayor R. Carey Davis at 9:00 AM, Monday, January 22, 2018, in
the Board Room, 201 North "E" Street, San Bernardino, CA.

There 38 members of the public in the audience for this discussion.
David McPherson, of HDL, consultant to the Marijuana Commission, provided a
PowerPoint presentation that explained the California cannibis laws, the types of
policy decisions that can be made, the benefits of a regulatory ordinance, and
regulatory options.
Deputy City Attorney gave an update on the Measure O litigation. He reported
that the city had received a written tentative decision January 18, 2018 that the
measure was invalid. He expected a final decision within two weeks.

2. Public Outreach, Town Hall Meetings, and Surveys

The council gave direction by consensus regarding conducting public surveys
and getting public input on the issues surrounding cannabis.

PUBLIC HEARING
4. Extension of the Moratorium on Commercial Marijuana Land Uses and
Activities, Outdoor Personal Cultivation of Marijuana and Cannabis Events
Council member Valdivia left the meeting at 2:20 PM, during discussion of this
item.
Council member Richard left the meeting at 3:00 PM, after voting on the motion.
Council member Nickel left the meeting at 3:10 PM, after voting on the motion.

5. PUBLIC COMMENTS FOR ITEMS NOT ON THE AGENDA
Robert Porter, San Bernardino, suggested that all city employees consider
moving into the city.
Sung Kim, Colton, said he’d be able to answer questions about marijuana and
help the council get to the answers they seek faster, and that they were asking
the wrong questions.
Karmel Roe, San Bernardino, said that instead of a ban, she suggested an
urgency ordinance to adopt state law until they get through all of the issues that
the council had spoken about earlier in the meeting.
Yolanda Ramirez, San Bernardino, spoke about the need for police officers. She
said the money spent for trash service would be better spent for police service.
William Cioci, San Bernardino, said the City Attorney owes the city an apology
for providing a ballot title and summary for Measure O. He said he beleivs that
marijuana was a god-given gift.
Gem Montes, said requiring a permit for growing marijuana would be public
information and that could lead to crime and other issues. He also said she would
not encourage micro-businesses, supports testing of the product within the city
and recommended two separate ordinances, one for recreational and medical
marijuana.
6. ADJOURNMENT
The meeting adjourned at 3:52 p.m. to February 1, 2018, at 10 a.m.

The next joint regular meeting of the Mayor and City Council and the Mayor and
City Council Acting as the Successor Agency to the Redevelopment Agency will
be held on Wednesday, February 7, 2018 at 4:00 p.m. in the Council
Chamber located at 201 N. E Street, San Bernardino, California 92401. Closed
Session will begin at 4:00 p.m. and Open Session will begin at 5:00 p.m.
