Subject: Agreement with Southern California Mountains Foundation for
Improvements Bobby Vega Park
Recommendation
Adopt Resolution No. 2020-30 of the Mayor and City Council of the City of San
Bernardino, California, approving an agreement between the City of San Bernardino
and the Southern California Mountains Foundation for the donation of labor, material,
and equipment for the design and construction of improvements at Bobby Vega Park
located at 800-862 North Garner Avenue, San Bernardino CA 92411.
Background
The Southern California Mountains Foundation is a certified California Conservation
Corps (CCC). CCCs provide young men and women aged 18 to 25 with paid job
training to work on environmental projects and respond to natural and man-made
disasters. The Southern California Mountains Foundation has been awarded
Proposition 68 grant funding set aside for certified local conservation corps projects,
designating Bobby Vega Park as a project site.
Discussion
Using the Proposition 68 grant award, the Southern California Mountains Foundation
has elected to complete improvements including a walking path and fitness equipment
as out lined in Exhibit A at Bobby Vega Park. This will enable the Foundation to fulfill
their mission while also providing park improvements in a disadvantaged community.
These site improvements are designed to enhance park services and encourage
community participation in physical activities.
Approval of the agreement between the City and the Southern California Mountains
Foundation (Foundation) will allow the Foundation to provide the labor, equipment, and

and the City of San Bernardino aligns with Key Target No. 2: Focused, Aligned
Leadership and Unified Community and Key Target No. 4: Economic Growth and

RESOLUTION OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA,
APPROVING AN AGREEMENT BETWEEN THE CITY OF
SAN BERNARDINO AND THE SOUTHERN CALIFORNIA
MOUNTAINS FOUNDATION FOR THE DONATION OF
LABOR, MATERIAL, AND EQUIPMENT FOR THE
DESIGN AND CONSTRUCTION OF IMPROVEMENTS AT
BOBBY VEGA PARK
WHEREAS, the City owns certain real property in the City of San Bernardino,
California, generally located at 800-862 N. Garner Ave., San Bernardino CA 92411 and
; and
WHEREAS, the Southern California Mountains Foundation is a California nonprofit
501(c)(3) corporation and a certified California Conservation Corps (CCC) with operations in the
City of San Bernardino; and
WHEREAS, the Southern California Mountains Foundation was awarded Proposition 68
grant funding designated for Certified California Conservation Corps and has selected Bobby
Vega Park as a project site.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by this
reference.
SECTION 2, The City Manager is authorized and directed to execute on behalf of the
City the Donation and Park Improvements Agreement between the City of San Bernardino and
the Southern California Mountains Foundation attached hereto as and incorporated
herein by this reference as though set forth in full.
SECTION 3. The City Council finds this Resolution is not subject to the California
Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA
applies only to projects which have the potential for causing a significant effect on the
environment. Where it can be seen with certainty, as in this case, that there is no possibility that
the activity in question may have a significant effect on the environment, the activity is not
subject to CEQA.
SECTION 4. Severability. If any provision of this Resolution or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect other provisions or
applications, and to this end the provisions of this Resolution are declared to be severable.
SECTION 5. Effective Date. This Resolution shall become effective immediately.

RECITALS
A.TheCityis amunicipalcorporationandchartercity.TheCityowns that certain
realpropertyin the CityofSanBernardino,California,generallylocatedat800-862N. Garner
Ave., San Bernardino and commonly known as Bobby Vega Park .
B.Donorisa Californianonprofit 501(c)(3) corporationwithoperationsinthe City
of San Bernardino.
C.Donor desires to donate the labor, material, and equipment required for the design
andconstructionofimprovementsto the Park,asfurtherdescribedin ExhibitAattachedhereto
ImprovementsImprovementsshall be
installed in a section of the Park as more specifically identified in Exhibit B attached hereto and
incorporated herein by this reference.
D.Upon installation, the City will own and maintain the facilities as part of the Park.
InconsiderationfortheCitymakingspaceavailableattheParkfortheImprovementsandfor
treatingsaidImprovementsaspartofthe Parkformaintenancepurposes,the Donorwishesto
design and construct the Improvements at no cost to the City.
TERMS
NOW THEREFORE,in considerationofthe covenants,conditionsandagreements
containedin thisAgreement,andforothergoodandvaluableconsideration,the receiptand
sufficiency of which is acknowledged by City and Donor, City and Donor agree as follows:

1.1Donor shall, at its own cost and expense, furnish all labor, equipment, and
material for design and construction of the Improvements
in a good and workmanlike manner, in accordance with City approved plans. All Services shall
be subject to the terms and provisions of this Agreement, the exhibits attached hereto, and all
applicable local, state and federal laws, rules and regulations.All Services are for the
convenience of and at the request of Donor, who shall be solely responsible for all costs and
expenses in connection with the design and construction thereof. The City shall not be
responsible to any contractor or its subcontractors, suppliers or materialmen for any such work.
1.2Donor shall design and install the Improvements in the manner described in
Exhibit A. Donor shall remove existing improvements and excavate the existing soil to a depth
as directed by the City. Donor shall duly dispose of all excavated turf, soil, and existing
