Jury Final Report
Recommendation
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, authorize the City Manager to respond to the FY 2014/15 Grand Jury Final
Report from the San Bernardino County Civil Grand Jury.
Background
On November 20, 2019, the San Bernardino County Civil Grand Jury issued a letter to
the City informing us that they conducted an audit of their files and found that they have
-15 Grand Jury Final Report relating to
Code Enforcement. Staff conducted research and could not find any documentation
that showed proof of a response. In December 2019, staff followed up with a letter to
the Grand Jury noting that given the age of the findings, we would need more time to
review our records and respond.
Discussion
The findings and recommendations of the 2014-15 Grand Jury Final Report include:
FINDINGS
1. Receipt of the business license for multi-family rentals does not automatically
enroll a property in the annual fire inspection program resulting in some
properties being excluded from the program.
2. The use of two different departments for code inspections of rental housing
results in a lack of standardization and communication.
3. A business license is obtained for a single-family rental property before a
Certificate of Occupancy is issued by the Code Enforcement Department
resulting in a property being available for rent that may or may not meet code.
RECOMMENDATIONS
15-11: Establish a procedure that upon receipt of a business license for
multifamily rentals, the property is automatically enrolled into the annual fire
protection program.

Residential Rental
Application Acceptance Policy
In accordance with SBMC 5.04.525F residential rental properties are
required to register with the Business Registration office and pay a
fee to rent or lease properties within the City of San Bernardino. A
Certificate of Occupancy (C of O) must be obtained prior to any
property being utilized for rental purposes. The following policy will
outline the processing procedures.
I. All applications for a residential rental property must submit the
following information prior to the application being processed:
a. A completed City of San Bernardino Business
Registration Property Application from the Business
Registration Office.
b. An approved Zoning Verification Review from Community
and Economic Development.
c. A copy of the current Certificate of Occupancy issued by
the Community and Economic Development Department.
II. All applicants will be directed to Community and Economic
Development to obtain both the Zoning Review and the C of O.
III. A list of applications will be generated by Business Registration
on a monthly basis and forwarded to Code Enforcement for an
inspection.
IV. If the applicant provides the Zoning Review but no C of O then
the application will be placed on hold.
a. A receipt showing proof that they are in the process of
obtaining the C of O will be required prior to accepting
payment and placing the account on hold.
V. Applications submitted without the required documentation will
be rejected and our standard process of collection will continue.
VI. Any accounts failing to submit the required documentation
within that time frame will be sent notifications that a lien may
be placed on the property for failure to submit all registration
information.
Residential rental properties include Single Family rental properties, multi-
family rental properties, single room rentals, and apartments.
