HomeMy WebLinkAbout2019-269Resolution No. 2019-269 RESOLUTION NO. 2019-269 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING REVISED SALARY SCHEDULES FOR FULL-TE%4E MISCELLANEOUS AND SAFETY CLASSIFICATIONS OF THE CITY OF SAN BERNARDINO FOR FISCAL YEARS 2011/12, 2012/13, 2013/14, 2014/15, 2015/16, 2016/17, 2017/18, 2018/19 AND 2019/20 IN COMPLIANCE WITH THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM (CALPERS) REGULATIONS WHEREAS, in February 2018, California Public Employees' Retirement System (CalPERS) Office of Audit Services (OFAS) conducted an audit on various Public Agencies, including the City of San Bernardino; and WHEREAS, the California Code of Regulations, Subchapter 1, Employees' Retirement System Regulations section 570.5 (2 CCR § 570.5) states that "(a) For purposes of determining the amount of "compensation earnable" pursuant to Government Code Sections 20630, 20636, and 20636. 1, pay rate shall be limited to the amount listed on a pay schedule that meets all of the following requirements: (1) Has been duly approved and adopted by the employer's governing body in accordance with requirements of applicable public meeting laws; (2) Identifies the position title for every employee position; (3) Shows the pay rate for each identified position, which may be stated as a single amount or as multiple amounts within a range; (4) Indicates the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually; (5) Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer's internet website; (6) Indicates an effective date and date of any revisions; (7) Is retained by the employer and available for public inspection for not less than five years; and (8) Does not reference another document in lieu of disclosing the pay rate". BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: Resolution No. 2019-269 SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The full-time miscellaneous and safety classifications attached hereto and incorporated herein as Exhibit "A" and Exhibit "B" are approved, and employees shall be paid in accordance with the salary schedule and salary range table. SECTION 3. That the City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. SECTION 5. Effective Date. This Resolution shall beco a effective immediately.
