HomeMy WebLinkAbout2019-324Resolution No. 2019-324 RESOLUTION NO. 2019-324 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, AUTHORIZING THE EXECUTION OF A MILLS ACT PRESERVATION AGREEMENT WITH 320 NORTH E STREET LLC C/O ALAN STANLY ("OWNER") FOR THE PROPERTY LOCATED AT 320 N E STREET, SAN BERNARDINO WHEREAS, the property is located on the 1991 Historic Resources Reconnaissance Survey and therefor eligible to enter into a Historic Property Preservation Agreement with the City; and WHEREAS, the Mills Act is a state law designed to provide financial incentives for property owners that restore and maintain historic residential and commercial properties; and WHEREAS, the property owner will enter into a 10 -year preservation agreement beginning November 6, 2019, and remaining in effect for a minimum initial term of 10 years; and WHEREAS, the owner, Mr. Stanly, will be utilizing the funds to rehabilitate the building in an effort to attract quality tenants and business into downtown. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2, The City Manager is hereby authorized and directed to execute a Mills Act Preservation Agreement, attached hereto and incorporated herein as Exhibit "A", 320 North E Street LLC C/O Alan Stanly for the property located at 320 North E Street, San Bernardino, CA 92410. SECTION 3. The authorization to execute the Agreement is rescinded if the parties fail to execute the Agreement within sixty (60) days of the passage of this Resolution. SECTION 4. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Resolution No. 2019-324 SECTION 5. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. SECTION 6. Effective Date. This Resolution shall become effective immediately.
