RESOLUTION NO. 2019-308
RESOLUTION OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA,
AUTHORIZING THE EXECUTION OF AN AGREEMENT
AND ISSUANCE OF AN ANNUAL PURCHASE ORDER IN
THE AMOUNT OF $300,000 WITH THREE (3) ONE-YEAR
EXTENSIONS AT THE CITY'S OPTION TO
ENVIRONMENTAL PROJECT SERVICES, INC., FOR
CONCRETE MAINTENANCE SERVICES
WHEREAS, Environmental Project Services, Inc. was determined to be the lowest
bidder for concrete maintenance services; and
WHEREAS, The Department of Public Works, Operations and Maintenance Division, is
responsible for the operation and maintenance of the City's infrastructure. It includes street
lights, traffic signals and signs, pavement markings, tree maintenance, right of way maintenance,
concrete maintenance, pavement contract management, land maintenance district management,
storm drains, graffiti removal and hazmat disposal; and
WHEREAS, One of the responsibilities of the Division is to ensure that sidewalks,
curbs, gutters, and cross gutters are properly maintained and repaired as needed. Keeping the
sidewalks, curbs, gutters, and cross gutters in good repair is essential to the safety of the public.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by this
reference.
SECTION 2. The City Manager of the City of San Bernardino is hereby authorized and
directed to execute on behalf of said City a Vendor Services Agreement between the City of San
Bernardino and Environmental Project Services, Inc., a copy of which is attached hereto, marked
Exhibit "A", and incorporated herein by reference as fully as though set forth at length.
SECTION 3. That pursuant to this determination the Director of Finance or his designee
is hereby authorized to issue an annual purchase order to Environmental Services, Inc. in the
amount of $300,000 with three (3) one-year extensions at the City's option.
SECTION 4. That the City Council finds this Resolution is not subject to the California
Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA
applies only to projects which have the potential for causing a significant effect on the
environment. Where it can be seen with certainty, as in this case, that there is no possibility that
the activity in question may have a significant effect on the environment, the activity is not
subject to CEQA.

SECTION 5. Severability. If any provision of this Resolution or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect other provisions or
applications, and to this end the provisions of this Resolution are declared to be severable.
SECTION 6. Effective Date. This Resolutiop shall become effective immediately.
