HomeMy WebLinkAbout2019-306Resolution No. 2019-306 RESOLUTION NO. 2019-306 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING A BUDGET AMENDMENT TO FUND THE CONTRACT WITH NINYO AND MOORE IN THE AMOUNT OF $213,384.90 FROM THE BOND PROCEEDING ACCOUNT FOR MONTGOMERY WARD SERVICE CENTER SOIL VAPOR EXTRACTION PILOT TEST WORK PLAN IMPLEMENTATION; AND AUTHORIZING THE FINANCE DIRECTOR OR DESIGNEE TO AMEND THE FY 2019/20 BUDGET WHEREAS, On June 05, 2019, the Mayor and City Council adopted Resolution No.2019-80 approving an agreement with Ninyo & Moore Geotechnical & Environmental Sciences Consultants for Montgomery Ward Service Center Soil Vapor Extraction Pilot Test Work Plan Implementation; and WHEREAS, On March 21, 2016, the Mayor and City Council adopted Resolution Nos. 2016-064 and 2016-065 approving Bond Expenditure Agreement between the Successor Agency and the City. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The Finance Director or his designee is hereby authorized and directed to amend FY 19/20 budget to approl)riate funds in the amount of $213,384.90 from the Bond Proceeding Account to the Montgomery Ward Service Center Soil Vapor Extraction Project. The Finance Director is or his designee is hereby further authorized to amend the FY 2019-20 adopted budget as identified in the staff report accompanying this Resolution. SECTION 3. That the City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. SECTION 5. Effective Date. This Resolution shall become effective immediately.
