HomeMy WebLinkAbout2019-304Resolution No. 2019-304 RESOLUTION NO. 2019-304 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 655 ENTITLED, IN PART, "A RESOLUTION... DESIGNATING CERTAIN STREETS OR PORTIONS THEREOF AS THROUGH HIGHWAYS..." AND AUTHORIZING THE ESTABLISHMENT OF AN ALL -WAY STOP CONTROL AT THE INTERSECTION OF D STREET AND TWENTY-EIGHTH STREET WHEREAS, the Traffic Engineering Section of the Public Works Department received a request to evaluate the intersection of D Street and 28th Street for All -way stop signs; and WHEREAS, this intersection is currently two-way stop controlled; and WHEREAS, the intersection of D Street and 28th Street meets the warrants for an ALL WAY STOP sign installation and it was determined that intersection safety would be enhanced if stop signs are installed at this intersection. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. Resolution No. 655, which designates certain streets, or portions thereof, as through highways, Section One is amended by adding Subsection (3.9) D STREET to read in its entirety as follows: "(3.9) "D" STREET (A) At its intersection with 28th Street (All -Way Stop)" SECTION 3. Resolution No. 655, which designates certain streets, or portions thereof, as through highways, Section One is amended by amending Subsection (18) TWENTY-EIGHTH by adding Subsection (B) to read as follows: "(18) TWENTY-EIGHTH STREET (B) At its intersection with "D" Street (All -Way Stop)" SECTION 4. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that Resolution No. 2019-304 the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 5. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. SECTION 6. Effective Date. This Resolution shall become effective immediately.
