HomeMy WebLinkAbout2019-272Resolution No. 2019-272 RESOLUTION NO. 2019-272 RESOLUTION Of THE MAYOR CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING THE PURCHASE OF A CNG VACTOR 2110I JET RODDER FROM HAAKER EQUIPMENT COMPANY OF LA VERNE, CALFORNIA AT A PRICE OF $479,890.44 AND AUTHORIZING THE DIRECTOR OF FINANCE TO TRANSFER FUNDS FROM AB2766 FUND TO CAPITAL PURCHASES FUND (5701) IN THE AMOUNT OF $479,890.44 WHEREAS, under Article III of the City Charter, the City Council is empowered to set policy, approve contracts and agreements, and undertake other obligations. The City is required to meet the standards of federal and the state Clean Air Acts and replacement of the Vactor Truck will allow implementation of measures to reduce motor vehicle emissions. WHEREAS, the Haaker Equipment Company has agreed to extend the same unit pricing of $479,890.44 for a New 2020 Vactor 211 O Jet Rodder including tax pursuant to Section 3.04.01 OB2 of the Municipal Code. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Council hereby authorizes the City Manager to purchase one new CNG Vactor Truck using a cooperative purchasing agreement via bid No. N2M18-87 in the amount of $479,890.44. SECTION 3. The City Council hereby authorizes the Director of Finance to transfer funds from the AB2766 Fund to Capital Purchases fund (5701) in the amount of $479,890.44. SECTION 4. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 5. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. SECTION 6. Effective Date. This Resolution shall become effective immediately.
