RESOLUTION NO. 2019-189
RESOLUTION OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA,
APPROVING THE AWARD OF A CONSTRUCTION
CONTRACT WITH LM RASMUSSEN CONSTRUCTION IN
THE AMOUNT OF $87,700 FOR ACCESS
IMPROVEMENTS TO ENTRANCE DOORS OF 201
NORTH E STREET BUILDING; AUTHORIZE THE
CONSTRUCTION CONTINGENCY IN THE AMOUNT OF
$8,700; AND AUTHORIZE THE CITY MANAGER OR
DESIGNEE TO EXPEND THE CONTINGENCY FUND, IF
NECESSARY, TO COMPLETE THE PROJECT
WHEREAS, Article III of the City Charter which provides for the City's legislative
function with the power to set policy, approve contracts and agreements, and undertake other
obligations; and
WHEREAS, LM Rasmussen Construction, 1137 Alpine Heights Road, Alpine,
California, 91901 is the lowest responsive responsible bidder for access improvements to the
entrance doors of the 201 North E Street Building and Special Provision No. 13304.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by this
reference.
SECTION 2. The City Manager or his designee is hereby authorized and directed to
award a construction contract to LM Rasmussen Construction in the amount of $87,700.
SECTION 3. The City Manager or designee is hereby authorized and directed to
execute said contingency not to exceed $8,700 on behalf of the City.
SECTION 4. The Director of Finance is authorized and directed to issue a Purchase
Order in the amount of $87,700 to LM Rasmussen Construction for this work.
SECTION 5. That the City Council finds this Resolution is not subject to the California
Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA
applies only to projects which have the potential for causing a significant effect on the
environment. Where it can be seen with certainty, as in this case, that there is no possibility that
the activity in question may have a significant effect on the environment, the activity is not
subject to CEQA.

SECTION 6. Severability. If any provision of this Resolution or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect other provisions or
applications, and to this end the provisions of this Resolution are declared to be severable.
SECTION 7. Effective Date. This
