HomeMy WebLinkAbout2019-161Resolution No. 2019-161 RESOLUTION NO. 2019-161 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING COOPERATIVE AGREEMENT NO. 19- 1002205 WITH THE SAN BERNARDINO COUNTY TRANSPORTATION COMMISSION (AUTHORITY) FOR THE I-215/ UNIVERSITY PARKWAY INTERCHANGE PROJECT (SSO4-019) WHEREAS, On October 19, 2015, the City approved Memorandum of Understanding (MOU) No. 15-1001217 and Cooperative Agreement No. 16-1001335 to transfer responsibility for Project Management for the University Parkway/Interstate 215 Interchange Southbound Loop Entrance Ramp project (SSO4-19) to the San Bernardino County Transportation Commission (Authority), also known as SBCTA, to complete; and WHEREAS, On August 11, 2016, the SBCTA Board awarded a Contract to HDR for design and environmental services for the Project Approval & Environmental (PA/ED) and the Plans Specifications and Estimate (PS&E) phases in the amount of $1,500,932.00 plus a $225,140.00 contingency. This amount was higher than anticipated, so the SBCTA Board also approved Amendment No. 1 to Cooperative Agreement No. 16-1001335 with the City. The cost increase is reflected in the Amendment and is being fully funded through a Federal Demonstration (DEMO) grant. There is no change to SBCTA's or the City's share; and WHEREAS, On September 6, 2016, the City approved Amendment No. 1 to Cooperative Agreement No. 16-1001335 to modify the distribution of costs for the project. There is no change proposed to the City's share of the cost of the Phases currently in process. Amendment No. 1 also provides for removal of language in the original Agreement establishing an escrow to hold the City's share of the cost of each phase. Instead of establishing an escrow, the City will simply deposit its share of the cost of each phase with SBCTA as the work progresses. The amount of $242,942 will need to be deposited with SBCTA for the PANED and PS&E phases; and WHEREAS, On Jun 30, 2018, Cooperative Agreement No. 16-1001335 expired; and WHEREAS, SBCTA is asking the City to approve Cooperative Agreement No. 19- 1002205 with San Bernardino County Transportation Commission (Authority) to reflect an increase in the estimated cost for the PANED and PS&E phases and initiate preliminary design activities and preparation of environmental review documents and construction, in the event that the project is approved following preparation of the environmental review documents. The estimated cost of the PS&E and ROW phases and corresponding estimated Project Management costs have increased (See Attachment A-2). The amount of $1,848,293.05 will need to be deposited with SBCTA for Design (PS&E) and Right-of-way (ROW); and Resolution No. 2019-161 BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Council finds that execution of Cooperative Agreement No. 19- 1002205 with the San Bernardino County Transportation Commission is exempt from environmental review under the California Environmental Quality Act (Pub. Resources Code, § 21000 et seq.) ("CEQA") pursuant to State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.), section 15262 (planning and feasibility studies with no effect of law), 15306 (information collection relating to projects not yet approved), and 15061(b)(3) (activities with no potential to cause a significant effect on the environment). SECTION 3. The City Manager or designee is hereby authorized and directed to execute Cooperative Agreement No. 19-1002205 with San Bernardino County Transportation Commission (Authority) to reflect an increase in the estimated cost for the PANED and PS&E phases and initiate preliminary design activities and preparation of the Draft Report and construction. The estimated cost of the PS&E and ROW and construction phases and corresponding estimated Project Management costs have increased (See Attachment 2). SECTION 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable.
