HomeMy WebLinkAbout2019-160Resolution No. 2019-160 RESOLUTION NO. 2019-160 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING THE AWARD OF A CONSTRUCTION CONTRACT WITH SAN MARINO ROOF CO. INC. IN THE AMOUNT OF $389,242 FOR FACILITY REPLACEMENT - ROOF AT VARIOUS LOCATIONS; AUTHORIZE THE CONSTRUCTION CONTINGENCY IN THE AMOUNT OF $38,000; AND AUTHORIZE THE CITY MANAGER OR DESIGNEE TO EXPEND THE CONTINGENCY FUND, IF NECESSARY, TO COMPLETE THE PROJECT WHEREAS, Article III of the City Charter which provides for the City's legislative function with the power to set policy, approve contracts and agreements, and undertake other obligations; WHEREAS, San Marino Roof Co. Inc., 2187 N. Batavia Street, Orange, California, 92865 is the lowest responsive responsible bidder for Facility Replacement - Roof at Various Locations; and Special Provision No. 13296; and BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Manager or his designee is hereby authorized and directed to award a construction contract to San Marino Roof Co. Inc. in the amount of $389,242 SECTION 3. The City Manager or designee is hereby authorized and directed to execute said contingency not to exceed $38,000 on behalf of the City. SECTION 4. The Director of Finance is authorized and directed to issue a Purchase Order in the amount of $389,242 to San Marino Roof Co. Inc. for this work. SECTION 5. That the City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 6. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable.
