HomeMy WebLinkAbout2019-049Resolution No. 2019-49 RESOLUTION NO. 2019-49 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, ADOPTING MANDATORY ELECTRONIC FILING OF FPPC FORM 700 (STATEMENT OF ECONOMIC INTERESTS) USING THE CITY'S FPPC-APPROVED VENDOR WHEREAS, the Fair Political Practices Commission (FPPC) requires elected officials, and high level executives who have make decisions regarding public funds to report their economic interests annually, on or about April 1 of each year; and WHEREAS, those required to file such reports may presently do so either manually or electronically, using the city's vendor; and WHEREAS, significant staff time and resources in the City Clerk's Office are saved when officials file electronically; and WHEREAS, because the City currently uses an approved vendor for electronic filing, the City may require all officials who must file such reports to do so electronically; and WHEREAS, in order to take advantage of the savings inherent in electronic filing, the City now wishes to require all officials who must file such reports to do so electronically. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. All City officials required to file FPPC Form 700 shall do so electronically, using the City's vendor. SECTION 3. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this ordinance are declared to be severable. SECTION 5. Effective Date. This Resolution shall become effective immediately.
