HomeMy WebLinkAbout2019-047Resolution No. 2019-47 RESOLUTION NO. 2019-47 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING THE AWARD OF A CONSTRUCTION CONTRACT WITH CONSERVE LANDCARE, IN THE AMOUNT OF $102,500 FOR FELDHEYM LIBRARY LANDSCAPE RENOVATIONS; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONSTRUCTION CONTINGENCY IN THE AMOUNT OF $15,500; AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXPEND THE CONTINGENCY FUND, IF NECESSARY, TO COMPLETE THE PROJECT; AND AUTHORIZE THE FINANCE DIRCTOR TO AMEND THE FY 2018/19 CIP TO ADD THE FELDHEYM LIBRARY LANDSCAPE RENOVATION PROJECT WHEREAS, Conserve LandCare, 72265 Manufacturing Road, Thousand Palms, California 92276 is the lowest responsive responsible bidder for Feldheym Library Landscape Renovation and Special Provision No. 13283. WHEREAS, The Feldheym Library Landscape Renovation Project is not part of the adopted 2018/2019 CIP. WHEREAS, Funding are available through a Settlement Agreement between the City of San Bernardino Municipal Water Department, East Valley Water District, and the San Bernardino Valley Municipal Water District. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Manager or his designee is hereby authorized and directed to award a construction contract to Conserve LandCare in the amount of $102,500. SECTION 3. The City Manager or designee is hereby authorized and directed to execute said contingency not to exceed $15,500 on behalf of the City. SECTION 4. The City Manager or designee is hereby authorized to amend the FY 2018/2019 CIP to include Feldheym Library Landscape Renovation Project and authorize the use of Settlement Agreement Funds to fund the project SECTION 5. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the Resolution No. 2019-47 environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 6. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. SECTION 7. Effective Date. This Resolution shall become effective immediately.
