HomeMy WebLinkAbout2018-301Resolution No. 2018-301 RESOLUTION NO. 2018-301 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, AUTHORIZING AND DIRECTING THE CITY MANAGER TO AUTHORIZE A THIRD AMENDMENT OF THE VENDOR SERVICES AGREEMENT WITH WEST COAST ARBORISTS, INC. AND INCREASE PURCHASE ORDER NO. 2019-167 FOR THE CYCLE PRUNING (GRID TRIMMING) OF TREES CITYWIDE AND OTHER RELATED TREE SERVICES WHEREAS, The Department of Public Works, Operations and Maintenance Division is responsible for the operation and maintenance of the City's infrastructure. It includes streetlights, traffic signals and signs, pavement markings, right of way maintenance, land maintenance district management, stormwater infrastructure maintenance, graffiti, and the maintenance/preservation of the City's urban forest --to include cycle (grid) pruning; and WHEREAS, West Coast Arborist (WCA) has been providing tree services (including emergency removal services) for the City since 2014 per RFQ F-14-27 which authorized WCA to perform grid tree pruning as necessary within the City boundaries and established a purchase order in the amount of $442,400. The original agreement has been amended twice since to increase the purchase order by $466,700 in 2013 and by $966,700 in 2016. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Manager or designee is hereby authorized to execute the Third Amendment to increase the contract value by additional $700,000 for the continuation of the grid tree trimming work, removal of dead or declining trees, and emergency tree removals due to weather events or other natural disasters. SECTION 3. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. SECTION 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. Resolution No. 2018-301 SECTION 5. Effective Date. This Resolution shall become effective immediately.
