HomeMy WebLinkAbout2018-307Resolution No. 2018-307 RESOLUTION NO. 2018-307 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING THE CHANGE OF OWNERSHIP OF WILSON TOWING, LLC, IN ORDER TO CONTINUE PARTICIPATION IN THE SAN BERNARDINO POLICE DEPARTMENT TOW ROTATION WHEREAS, Mr. Bahaeddin (Ray) Hassan, owner of Wilson Towing, LLC, desires to sell his business to Ms. Lilliana Vach; and WHEREAS, on April 4, 2011, the Mayor and City Council adopted Resolution No. 2011-80, authorizing a Tow Service Agreement with Wilson Towing; and, WHEREAS, on August 13, 2018, a letter was received by the San Bernardino Police Department advising that Wilson Towing is requesting approval for the sale and transfer of the business interest. The potential buyer is Ms. Lilliana Vach; and, WHEREAS, Wilson Towing, located at 2310 E. 3'd Street, has been a part of the City of San Bernardino's Tow Service Agreement (TSA) since the agreement was approved under Resolution No. 2011-80; and, WHEREAS, per Section 15 of the Tow Service Agreement, any change in ownership requires approval of the Mayor and City Council to continue on the tow rotation; and, WHEREAS, within 30 days of notification, the Police Department shall report the results of a review to the City Council. The City Council shall approve or deny the assignment of this agreement to the new owner. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. The Mayor and City Council hereby approve the change of ownership of Wilson Towing, LLC, from Mr. Bahaeddin (Ray) Hassan to Ms. Lilliana Vach pursuant to the San Bernardino City Tow Service Agreement. SECTION 3. The City Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Resolution No. 2018-307 SECTION 4. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable. SECTION 5. Effective Date. This Resolution shall become effective immediately.
