RESOLUTION NO. 2018-295
RESOLUTION OF THE MAYOR AND CITY COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA,
AUTHORIZING THE SUBMITTAL OF AN APPLICATION
FOR PAYMENT PROGRAMS FOR RECYCLING
BEVERAGE CONTAINERS OFFERED BY CALRECYCLE
AND APPROVING RELATED AUTHORIZATIONS.
WHEREAS, pursuant to Public Resources Code sections 48000 et seq., 14581, and
42023.1(g), the Department of Resources Recycling and Recovery (CalRecycle) has
established various payment programs to make payments to qualifying jurisdictions; and
WHEREAS, in furtherance of this authority, CalRecycle is required to establish
procedures governing the administration of the payment programs; and
WHEREAS, CalRecycle's procedures for administering payment programs require,
among other things, an applicant's governing body to declare by resolution certain authorizations
related to the administration of the payment program; and
WHEREAS, City proposes to utilize the grant funds to provide education and outreach for
beverage container recycling, which involves support for new and existing beverage container recycling
programs for businesses, multi -family residential dwellings, single-family residential dwellings, public
education and outreach related to beverage container recycling.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by this
reference.
SECTION 2. The City Manager, or her designee, is authorized to submit an
application to CalRecycle for any and all payment programs offered.
SECTION 3. The City Manager, or her designee, is hereby authorized as
Signature Authority to execute all documents necessary to implement and secured payment
under the CCPP.
SECTION 4. This authorization is effective until rescinded by the Signature Authority or
this governing body.
SECTION 5. The Finance Director is authorized to amend the 19/20 budget if the
grant is awarded.

SECTION 6. The City Council finds this Resolution is not subject to the California
Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA
applies only to projects which have the potential for causing a significant effect on the
environment. Where it can be seen with certainty, as in this case, that there is no possibility that
the activity in question may have a significant effect on the environment, the activity is not
subject to CEQA.
SECTION 4. Severability. If any provision of this Resolution or the application thereof
to any person or circumstance is held invalid, such invalidity shall not affect other provisions or
applications, and to this end the provisions of this Resolution are declared to be severable.
SECTION 5. Effective Date. This Resolution shall become effective immediately.
APPROVED and ADOPTED by the City Council and signed by the Mayor and attested
by the City Clerk this 7t' day of November 2018.
