ORDINANCE NO. MC -1459
ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN
BERNARDINO, CALIFORNIA REPEALING SAN BERNARDINO MUNICIPAL CODE
CHAPTER 2.31 REGARDING THE RELOCATION APPEALS BOARD; REPEALING
SAN BERNARDINO MUNICIPAL CODE CHAPTER 2.40 REGARDING THE
COMMUNITY DEVELOPMENT COMMISSION; AND REPEALING SAN
BERNARDINO MUNICIPAL CODE CHAPTER 2.46 REGARDING THE DISASTER
COUNCIL
WHEREAS, the People of the City of San Bernardino adopted a new Charter at the
November 8, 2016 municipal election; and
WHEREAS, the new Charter was filed with the California Secretary of State on January
31, 2017 and became effective on that date; and
WHEREAS, existing provisions of the City's Municipal Code are inconsistent with the
new Charter and require revision; and
WHEREAS, at the November 3, 2017 Strategic Planning Meeting, the Mayor and City
Council discussed the dissolution of Council Sub -Committees, Commissions and Boards; and
WHEREAS, Chapter 2.31 of the San Bernardino Municipal Code was created by
Ordinance No. 3875 on October 16, 1979; and
WHEREAS, pursuant to Health and Safety Code (the "HSC") §34172 (a) (1), the
Redevelopment Agency of the City of San Bernardino was dissolved February 1, 2012; and
WHEREAS, Resolution 2016-199 adopted by the City Council on September 22, 2016
provides for a relocation appeals process; and
WHEREAS, Chapter 2.40 of the San Bernardino Municipal Code was created by
Ordinance No. MC -105 on October 7, 1980; and
WHEREAS, pursuant to Resolution 2012-19, the City Council serves as the Successor
Housing Agency to the Redevelopment Agency of the City of San Bernardino; and
WHEREAS, Chapter 2.46 of the San Bernardino Municipal Code was created by
Ordinance No. 3180 on June 29, 1971; and
WHEREAS, pursuant to Resolution 2017-162, the City Council authorized the
establishment of an Emergency Operations Manager classification within the Police Department
to lead the City of San Bernardino's disaster response.

NOW, THEREFORE, THE MAYOR AND CITY COUNCIL OF THE CITY OF
SAN BERNARDINO DO ORDAIN AS FOLLOWS:
SECTION 1. Chapter 2.31 of the San Bernardino Municipal Code establishing the
Relocation Appeals Board is hereby repealed.
SECTION 2. Chapter 2.40 of the San Bernardino Municipal Code establishing the
Community Development Commission is hereby repealed.
SECTION 3. Chapter 2.46 of the San Bernardino Municipal Code establishing the
Disaster Council is hereby repealed.
