BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA AS FOLLOWS: SECTION 1. The Mayor and City Council of the City of San Bernardino, California, approve the destruction of certain obsolete records by the San Bernardino Police Department. Subject to written consent of the City Attorney, as provided in Sections 34090, 34090.5, and 34090.6 of the Government Code, the following city records, documents, instruments, books, or papers may be destroyed as of the date of the Resolution's approval. (a) All Personnel Complaints and Internal Investigations with disposition dates prior to July 1, 2012; (b) Service Complaints with disposition dates prior to July 1, 2015; (c) All other Internal Affairs files, that are not defined in (a), dated prior to July 1, 2015; (d) Pitchess Motion files with disposition dates prior to July 1, 2015; (e) Police canine activity and apprehension reports dated prior to July 1, 2012; (f) Employee grievances with disposition dates prior to July 1, 2012; (g) Internal promotional tests and evaluations dated prior to July 1, 2015; (h) Supervisory Use of Force Reports with disposition dates prior to July 1, 2015; (i) Supervisory Pursuit Reports with disposition dates prior to July 1, 2015; 0) Supervisory Vehicle Accident Reports with disposition dates prior to July 1, 2015; 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE RECORDS BY THE SAN BERNARDINO POLICE DEPARTMENT (k) Lawsuits and claims with adjudication dates prior to July 1, 2015; (1) Accidental Discharges and Dog shooting files disposition dates prior to July 1, 2015; (m) Public Records Request files dated prior to July 1, 2015; (n) Subpoena Duces Tecum files dated prior to July 1, 2015; (o) Personnel Applicant files with processing dates prior to July 1, 2015; (p) Off-duty work permits dated prior to July 1, 2016; (q) Obsolete administrative files dated prior to July 1, 2015. 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARINO, CALIFORNIA, APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE RECORDS BY THE SAN BERNARDINO POLICE DEPARTMENT I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the Mayor and City Council of the City of San Bernardino at a Joint Regular Meeting thereof, held on the 6'h day of September 2017, by the following vote, to wit: Council Members: MARQUEZ BARRIOS VALDIVIA SHORETT NICKEL RICHARD MULVIHILL AYES NAYS x X x XM x x ABSTAIN ABSENT X(S) GeorgeanixA arena, CM City Clerk The foregoing Resolution is hereby approved this 6t" day of September 2017.
