HomeMy WebLinkAbout1983-282 1 RESOLUTION NO. 83--282 2 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND THE IMMEDIATE EXPENDITURE OF 3 MONEY FOR CERTAIN PUBLIC PROJECTS TO SAFEGUARD LIFE , HEALTH, AND PROPERTY AS THE RESULT OF AN EXTRAORDINARY STORM AND FLOOD WHICH 4 CAUSED DAMAGE AT DESIGNATED LOCATIONS; AND EXEMPTING SUCH PUBLIC PROJECTS FROM THE COMPETITIVE BIDDING REQUIREMENTS (TERRACE ROAD 5 AND SIXTH STREET , SHASTA DRIVE , ET CETERA) . 6 WHEREAS , an extraordinary rain storm occurred on August 17 , 7 1983 , causing extensive damage at Terrace Road and Sixth Street, 8 Shasta Drive, east of Hemlock Drive, and Mill Street and Meridian 9 Avenue to sewer mains, water lines , drainage systems, water tanks, 10 Pipe culverts and supporting banks; and 11 WHEREAS, the Director of Public Works/City Engineer has 12 submitted a report and recommendations dated August 29, 1983 , on 13 file with the City Clerk, concerning such damages and recommended 14 Public projects; and 15 WHEREAS , Chapter 12 . 20 of the San Bernardino Municipal Code 16 adopts Public Contract Code Section 20168 ( formerly Government 17 Code Section 37906) ; and 18 WHEREAS, Public Contract Code Section 20168 permits the 19 legislative body to pass a resolution by a six-sevenths vote of 20 its members declaring that the public interest and necessity 21 demand the immediate expenditure of money to safeguard life, 22 health, and property as a result of an extraordinary storm, and 23 thereby avoid the competitive bidding requirements of Chapter 24 12 . 20 of the San Bernardino Municipal Code , 25 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF 26 SAN BERNARDINO DO RESOLVE that the public interest and necessity 27 demand the immediate expenditure of public money, as set forth 28 herein, to safeguard life, health, and property as a result of an 1 extraordinary storm occurring on August 17, 1983 , without comply- 2 ing with Chapter 1 of Part 3 of the Public Contract Code of the 3 State of California (commencing with Section 20100) cited as the 4 Local Agency Construction Act and Chapter 12 . 20 of the San 5 Bernardino Municipal Code. 6 I HEREBY CERTIFY that the foregoing resolution was duly 7 adopted by the Mayor and Common Council of the City of San 8 Bernardino at a _ regular meeting thereof, held 9 on the 6th day of regular �, 1983, by the following 10 vote, to wit: 11 AYES: Council Members Reilly, Hernandez , Plarks , 12 Quiel, Frazier, Strickler 13 NAYS: None 14 ABSENT: Councilman Castaneda 15 16 City Clerk 17 The foregoing resolution is hereby approved this day 18 of September 1983 . 19 20 N1 y r of i City San Bernardino Approved as to form: 21 00 22 A444 ity Ajtorney 23 24 25 26 27 28 -2-
