HomeMy WebLinkAbout10193 i I 1 RESOLUTION NO. 2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF 3 THE CITY OF SAN BERNARDINO TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED ANNEXATION DISTRICT NO. 244 (LAFC 859), AND 4 GIVING NOTICE OF THE PROPOSED ANNEXATION. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 6 BERNARDINO AS FOLLOWS: 7 SECTION ONE: That pursuant to the provisions of the Annexation of 8 Uninhabited Territory Act of 1939, proceedings have been initiated by the 91 Council of the City of San Bernardino, on its own motion, to annex to the City 10 of San Bernardino all that uninhabited territory situate in the County of San 11 Bernardino, State of California, hereby designated as Annexation District No. 12 244 (LAFC 859), and described as follows: 13I That portion of Tract 2404 as per plat recorded in Book 34 1 of Maps, pages 52 and 53, and that portion of the Northeast one- 14 ne»14 quarter of Section 18, Township 1 North, Range 4 West, San Bernardino Meridian if said Section lines were extended across 15 the Muscupiabe Rancho as per plat thereof recorded in Book 7 of Maps, page 23, all of records of the County Recorder of 16 San Bernardino County, State of California, and those portions of adjoining streets, described as follows: 17 Beginning at a point on the Present Corporate Limits of the 181 City of San Bernardino, said point being the intersection of the center line of Kendall Drive and the Southwesterly prolonga- tionof the Northwesterly line of Lot 21 of said Tract 2404; thence leaving said City Limit Line Northeasterly along said 20 Southwesterly prolongation and the Northwesterly line of said Lot 21 a distance of 653.25 feet to the most Northerly Corner 21 thereof and being on said City Limit Line; thence along said 22 �I City Limit Line the following courses and distance; thence Southeasterly along the Northerly line of said Tract 2404 and following its various courses and distances a distance of 23 2,978.48 feet more or less to the most Easterly Corner of Lot 1 of said Tract 2404, said point also being on the North line 24 of said Section 18; thence West along the South line of said Lot 1 and the North line of said Section 18 a distance of 25 565.00 feet, more or less, to the Southeasterly line of the property conveyed to John V. and Naomi L. Bahr by deed recorded 26 May 7, 1964, Document No. 81 in Book 6143, page 882, Official Records of said County; thence Southwesterly along said 27 Southeasterly line and the Southwesterly prolongation thereof a distance of 100.00 feet, more or less to the center line of 28 said Kendall Drive; thence Northwesterly along the center line of said Kendall Drive a distance of 2200.00 feet, more 29 or less, to t'lie point of beginning. Containing 40 acres, more or less. 30 31 That there are less than twelve qualified electors residing in said 32 territory, and that said territory is uninhabited as defined by said Act. ..lUl I 1 SECTION TWO: That the said council of the City of San Bernardino 2 desires to annex said uninhabited territory to the City of San Bernardino for 3 the following reasons: Said territory is contiguous to the City of San 4 Bernardino and its proposed annexation will contribute and facilitate the 5 orderly growth and development of both the City of San Bernardino and the 6 territory proposed to be annexed, and will provide and facilitate proper 7 over-all planning and zoning of lands in said City and said uninhabited 8 territory in a manner most conducive to the welfare of said city and said 9 uninhabited territory. 10 SECTION THREE: That upon the completion of said annexation of said 11 territory, all of the property included in said Annexation District No. 244 12 (I.AFC 859) shall be taxed equally with the other property within the City of 13 San Bernardino to pay the bonded indebtedness and any and all general indebted- 14 ness of the City of San Bernardino contracted prior to or existing or outstared» 1 5 ing at the time of the aforesaid proposed annexation of said described property 16 as provided in said Act. 17 SECTION FOUR: That Monday., the 25th day of May, 1970, at the hour 18of 9:30 o'clock A. M. of said day in the Council Chambers located in the 19 Garner Building, 392 Court Street, San Bernardino, California, is hereby fixed 20 as the time and place when and where any person owning real property within the 21 uninhabited territory, above described and proposed to be annexed to the City 22 of San Bernardino, and having any objections to the proposed annexation may 23 appear before the Council of the City of San Bernardino and show cause why 24 such uninhabited territory should not be so annexed to the City of San 25 Bernardino. Such protest must be in writing, may be filed with the City Clerk 26 at any time before the hour set for hearing objections to the proposed 27 annexation, and shall state the name or names of the owner or owners of 28 property affected, and the description of such property in general terms. 29 SECTION FIVE: The City Clerk of the City of San Bernardino is hereby 30 authorized and directed to cause a copy of this resolution to be published at 31 least twice but not oftener than once a week in the San Bernardino Free Press, 32- a newspaper of general circulation published in the City of San Bernardino, -2- i 1 the city to which it is proposed to annex the aforesaid territory, and also in 2 the Highland Messenger, a newspaper of general circulation published outside 3 the City of San Bernardino but in thwCounty of San Bernardino, California, the 4 county in which is located the territory proposed to be annexed to the City of 5 San Bernardino, said publication to be complete at least twenty (20) days 6 prior to the date set for hearing; 7 The said City Clerk is further authorized and directed to cause 8 written notice of such proposed annexation to be mailed to each person to whom 9lands within the territory proposed to be annexed is assessed in the last 10 equalized county assessment roll available to said clerk on the date the above 11 said proceedings were initiated, at the addresses shown on said assessment 12 roll, or known to said Clerk., and to any person who has filed his name and 13 address and the designation of the lands in which he has an interest, either 141 legal or equitable, with said Clerk, such notice to be given not less than 15 twenty (20) days before the first public hearing on the proposed annexation; 16 And in the event that any land within the territory proposed to be 17 annexed is owned by a county, the said City Clerk is directed to cause written 18 notice of such proposed annexation to be mailed to the Board of Supervisors of 19 such county, such notice to be given not less than twenty (20) days before the 20first public hearing on the proposed annexation; 21 And in the event there is upon the land proposed to be annexed a 22 structural improvement owned, being acquired or leased by a county fire protec- t 3 tion district, the said City Clerk is directed to cause written notice of such 24 proposed annexation to be mailed to the governing body of such district, such 25 notice to be sent not less than ten (10) days before the first public hearing 26 upon such proposed annexation; 27 And the City Clerk is directed to cause written notice to be given to 28 such other persons as may be legally entitled thereto, in the manner required 29 by law. 30 I HEREBY CERTIFY that the foregoing resolution was adopted by the 31 Mayor and Common Council of the City of San Bernardino at an adjourned regular 32 meeting thereof, held on the 30th day of March, 1970, by the following vote, to wit: -3- �I 1, AYES: Councilmen 7 i 2 r 3 NOES: 4 ABSENT: 5 6 City erk 7 8 The foregoing resolution is hereby approved thi %jay of 9 March, 1970.
