HomeMy WebLinkAbout1983-279 1 RESOLUTION NO. 83- 279 2 RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND ESTABLISHING CHARGES FOR SERVICES AND FACILITIES FURNISHED BY THE 3 CITY SEWERAGE COLLECTION AND TREATMENT SYSTEM LOCATED INSIDE THE INCORPORATED TERRITORY OF THE CITY; PROVIDING THAT USERS LOCATED 4 OUTSIDE THE INCORPORATED TERRITORY OF THE CITY MAY RECEIVE SEWER SERVICES; AUTHORIZING THE DIRECTOR OF PUBLIC WORKS/CITY ENGINEER 5 TO EXECUTE AGREEMENTS FOR USERS LOCATED OUTSIDE THE INCORPORATED TERRITORY OF THE CITY SUBJECT TO CERTAIN TERMS AND CONDITIONS; AND 6 REPEALING RESOLUTION NO. 82-201 . 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 8 9 SECTION 1. Users Located Within the Incorporated Territory 10 of the City. Pursuant to the provisions of Sections 13 . 16 . 020 and 11 13 . 32 . 170 of the San Bernardino Municipal Code , any premises which 12 are served by a connection to the system of sewage and waste 13 treatment of the City or are within 200 feet of, or are situated 14 on real property adjoining an existing sewer system and not 15 connected thereto , shall be charged and the owner thereof shall 16 pay a sewer service charge based upon the following schedule: 17 18 Sewer Utility Rate 19 Regional Facilities Collection Total 20 & Treatment System City Classification Charge Charge Charge 21 Residential $6. 05 Per Mo. $1. 15 Per Mo . $7. 20 Per Mo . 22 Commercial 0 . 37 Per HCF* 0 . 08 Per HCF* 0 . 45 Per HCF* 23 *HCF = 100 cubic feet 24 25 Commercial dischargers, for the purpose of this resolution, 26 shall include all dischargers and all premises obligated to pay 27 sewer service charges under this resolution other than residential 28 dischargers . I Charges for commercial dischargers shall be computed based 2 upon actual water consumption as reflected by water meter readings 3 for the billing period. Billings based on such water consumption 4 may be reduced for the purpose of establishing sewer service 5 charges subject to "seasonal" or "consumptive" use as recognized 6 and approved by the Board of Water Commissioners of the City of 7 San Bernardino . 8 Residential dischargers, for the purpose of this resolution, 9 shall be any single family dwelling unit, any duplex or triplex 10 family dwelling unit not requiring a City license for occupancy 11 and operation. 12 SECTION 2 . Users Located Outside the Incorporated Territory 13 of the City. 14 (a) A policy is hereby adopted of providing sewer services 15 to users located outside the incorporated territory of the City of 16 San Bernardino . The City ' s Director of Public Works/City Engineer 17 is hereby authorized and directed to execute on behalf of said 18 City, subject to approval of the Board of Water Commissioners, a 19 standard form agreement approved as to form by the City Attorney 20 and containing the minimum terms and conditions hereinafter set 21 forth, with any prospective users of sewer services and owners of 22 real property to receive sewer services extended to premises 23 located outside the corporate limits of said City. 24 (b) Said agreement shall require that the user and owner 25 shall pay the applicable sewer connection fee or fees and shall 26 pay each month the applicable sewer service charge or charges as 27 may from time to time be established . As of October 1, 1983, the 28 sewer service charges applicable are the following: -2- 1 Sewer Utility Rate 2 Regional Facilities Collection Total 3 & Treatment System City Classification Charge Charge Charge 4 Residential $6 . 05 Per Mo. $4 . 95 Per Mo. $11 . 00 Per Mo. 5 (Single family, duplex or triplex 6 family dwelling units) 7 Commercial 0 . 37 Per HCF* 0 . 33 Per HCF* 0 . 70 Per HCF* 8 *HCF 100 cubic feet 9 10 Rates for users other than "residential" shall be computed 11 on the basis of actual water consumption as reflected by water 12 meter readings for the billing period, provided that billings 13 based on seasonal or consumptive uses as specified in Section 1 , 14 may be adjusted as provided for in Section 1 . 15 (c) City shall have the right to terminate such services 16 by giving a ninety (90) day notice in writing to the user ; that 17 said user and owner shall be subject to any increase in said fee 18 or fees , charges and amounts , which may be imposed from time to 19 time by amending this resolution. 20 (d) The authority delegated to the City' s Director of 21 Public Works/City Engineer under this resolution is limited to 22 the express terms and conditions herein set forth and any 23 agreement which is not executed in strict compliance herewith 24 shall_ be void and shall not be binding upon the City of San 25 Bernardino and its legislative body. 26 SECTION 3 . The rates established pursuant to Sections 1 27 and 2 of this resolution shall be effective October 1 , 1983. 28 SECTION 4 .
