HomeMy WebLinkAbout10223 1 RESOLUTION 2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF 3 THE CITY OF SAN BERNARDINO TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED ANNEXATION DISTRICT NO. 246 (LAFC 874), AND 4 GIVING NOTICE OF THE PROPOSED ANNEXATION. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 6 BERNARDINO AS FOLLOWS: 7 SECTION ONE: That pursuant to the provisions of the Annexation of 8 Uninhabited Territory Act of 1939, proceedings have been initiated by the 9 Council of the City of San Bernardino, on its own motion, to annex to the City 10 of San Bernardino all that uninhabited territory situate in the County of San 11 Bernardino, State of California, hereby designated as Annexation District No. 12 246 (LAFC 874), and described as follows: 13 That portion of Tract 5111 as per plat thereof recorded in Book 89 of Maps, Pages 47, and 48; tLat portion of Tract 5112 14 as per plat thereof recorded in Book 103 of Maps, Pages 80, and 81; that portion of Tract 4920 as per plat thereof recorded 15 in Book 78 of Maps, Pages 19, and 20; and that portion of the Southeast one-quarter of Section 32, Township 1 North, Range 3 16 West, San Bernardino Meridian, all records of the County Recorder of San Bernardino County, State of California, and those portions 17 of adjoining streets, described as follows: 18 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the intersection of the 19 center line of Pacific Street and the center line of Central Avenue, said point also being 20.00 feet West of the center one 20quarter corner of said Section 32 as delineated on the said Map of Tract 4920; thence leaving said City Limit Line East along the 21 center line of said Pacific Street a distance of 1355.00 feet, more or less to the center line of Orange Street, 60.00 feet wide; 22 thence South along the center line of said Orange Street a distance of 663.00 feet, more or less to the Easterly prolongation of the 23 North line of Lot 8 of said Tract 5111; thence Westerly along said Easterly prolongation and the North line of Lots 8 thru 16 24 inclusive of said Tract 5111, and the North line of Lots 33 thru 41 inclusive of Tract 5023 as per plat thereof recorded in Book 25 61 of Maps, Pages 80, and 81 records of said County and the Westerly prolongation thereof a distance of 1280.00 feet, more 26 or less to the center line of Central Avenue; thence North along the center line of said Central Avenue a distance of 360.00 feet 27 more or less to the center line of Mansfield Street, 60.00 feet wide; thence West along the center line of said Mansfield Street 28 a distance of 253.39 feet, more or less to the Southerly prolonga- tion of the West line of Lot 18 of said Tract 4920; thence North 29 along said Southerly prolongation, the West line of said Lot 18, the Northerly prolongation thereof, the West line of Lot 23 of 30 said Tract 4920 and the Northerly prolongation thereof a distance of 302.90 feet, more or less to the center line of said Pacific 31 Street and said City Limit Line; thence East along the center line of said Pacific Street and said City Limit Line a distance 32 of 215.00 feet, more or less to the point of beginning. Containing 23 acres, more or less. -1- 1 That there are less than twelve qualified electors residing in said 2 territory, and that said territory is uninhabited as defined by said Act. 3 SECTION TWO: That the said council of the City of San Bernardino 4 desires to annex said uninhabited territory to the City of San Bernardino for 5 the following reasons: Said territory is contiguous to the City of San 6 Bernardino and its proposed annexation will contribute and facilitate the 7 orderly growth and development of both the City of San Bernardino and the 8 territory proposed to be annexed, and will provide and facilitate proper 9 over-all planning and zoning of lands in said City and said uninhabited 10 territory in a manner most conducive to the welfare of said city and said 11 uninhabited territory. 12 SECTION THREE: That upon the completion of said annexation of said 13 1 territory, all of the property included in said Annexation-District No. 246 14 I (LAFC 874) shall be taxed equally with the other property within the City of 15 San Bernardino to pay the bonded indebtedness and any and all general indebted- 16 ness of the City of San Bernardino contracted prior to or existing or outstand- 17 ing at the time of the aforesaid proposed annexation of said described property as 18 provided in said Act. 19 SECTION FOUR: That Monday, the lst day of June, 1970, at the hour 201 of 9:30 o'clock A.M. , of said day in the Council Chambers located in the Garner 21ii Building, 392 Court Street, San Bernardino, California, is hereby fixed as the 22 time and place when and where any person owning real property within the 23 uninhabited territory, above described and proposed to be annexed to the City 24 of San Bernardino, and having any objections to the proposed annexation may 25 appear before the Council of the City of San Bernardino and show cause why such 26 uninhabited territory should not be so annexed to the City of San Bernardino. 27 Such protest must be in writing, may be filed with the City Clerk at any time 28 before the hour set for hearing objections to the proposed annexation, and 29 shall state the name or names of the owner or owners of property affected, and 30 the description of such property in general terms. 31 SECTION FIVE: The City Clerk of the City of San Bernardino is hereby 32 authorized and directed to cause a copy of this resolution to be published at -2- 1 least twice but not oftener than once a week in the San Bernardino Free Press, 2 a newspaper of general circulation published in the City of San Bernardino, 3 the city to which it is proposed to annex the aforesaid territory, and also in 4 the Highland Messenger, a newspaper of general circulation published outside 5 the City of San Bernardino but in the County of San Bernardino, California, the 6 county in which is located the territory proposed to be annexed to the City of 7 San Bernardino, said publication to be complete at least twenty (20) days prior 8 to the date set for hearing; 9 The said City Clerk is further authorized and directed to cause 10 written notice of such proposed annexation to be mailed to each person to whom 11 lands within the territory proposed to be annexed is assessed in the last 12 equalized county assessment roll available to said clerk on the date the above 13 said proceedings were initiated, at the addresses shown on said assessment roll, 14 or known to said Clerk, and to any person who has filed his name and address 15 and the designation of the lands in which he has an interest, either legal or 16 equitable, with said Clerk, such notice to be given not less than twenty (20) 1 7 days before the first public hearing on the proposed annexation; 18And in the event that any land within the territory proposed to be 19 annexed is owned by a county, the said City Clerk is directed to cause written 201 notice of such proposed annexation to be mailed to the Board of Supervisors of 21 such county, such notice to be given not less than twenty (20) days before the 22 first public hearing on the proposed annexation; 23 And in the event there is upon the land proposed to be annexed a 24 structural improvement owned, being acquired or leased by a county fire protec- t 5 tion district, the said City Clerk is directed to cause written notice of such 26 proposed annexation to be mailed to the governing body of such district, such 27 notice to be sent not less than ten (10) days before the first public hearing 28 upon such proposed annexation; 29 And the City Clerk is directed to cause written notice to be given to 30 such other persons as may be legally entitled thereto, in the manner required 31 by law. 32 I HEREBY CERTIFY that the foregoing resolution was adopted by the -3- 1.
