HomeMy WebLinkAbout10218 1 RE33LUTI)N NJ. 2 A RES3LUTION OF THE MAYOR ANO CJMMJN COUNCIL OF THE CITY OF SAN BERNARDINO DE- CLARING ITS INTENTION TO JRJER THE VACATI)N OF THAT PORTION JF "D" STREET BE- 3 TWEEN RIALTO AVENUE AND THE ATCHISON, TOPEKA AND SANTA FE RAILROAD RIGHT-OF- WAY. 4 BE IT RESOLVED BY THE ,MAYOR AND COMMON CJJNCIL JF THE CITY )F SAN 5 BERNARDINO AS FOLLOWS: 6 7SECTION 1. That the Mayor and Common Council of the City of San '' 8 Bernardino hereby declares its intention to order the vacation of that portion of "D" Street between Rialto Avenue and the Atchison, Topeka and Santa Fe Rail- 9 10 road right-of-way, in said City, which said portion more particularly is de.,, scribed as follows : 11 , That portion of "0" Street, 80.00 feet wide lying between 12 ! the South line of Rialto Avenue 82.50 feet and the North line of the Atchison, Topeka and Santa Fe Railroad right- 13 of-way 50,00 feet wide and lying Westerly of a line that is parallel with and 40.00 feet Westerly of, measured at right 14 ! angles from the following described line: 15 1 Beginning at the intersection of the center lines of said Rialto Avenue and said "0" Street; thence South along said 16j center line of "0" Street, 83. 12 feet to the beginning of 17I a tangent curve concave to the East having a radius of 200.00 feet; thence Southerly along said curve, through a central angle of 270 00' 0011, a distance of 94.25 feet; 18 thence South 270 00' 00" East, a distance of 61.68 feet to the beginning of a tangent curve concave to the West, 19 having a radius of 300000 feet; thence Southerly along said curve through a central angle of 27° 00' 00", a dis- 20 tance of 141037 feet to the point of termination on the 21 North line of said railroad right-of-way. 22 SECTION 2. That the Mayor and Common Council of the City of San 23I Bernardino, in vacating the above described portion of said Street, elects 24 to proceed under and in accordance with the provisions of the "Street 'Vacation 25 Act of 1941", being Division 9, Part 3, of the Streets and Highways Code of the -State of California. t 26 SECTIJN 3. That the hour of 9:30 A.M., on the kith day of May, 27 1970, in the Council Chamber, Garner 3uilding, 392 Court Street, San 3ernardino, 28I 29 I, California, be, and the same hereby is fixed as the time and place when and 30 where all persons interested in or objecting to the proposed vacation may ap- jpear pear before the said Mayor and Common Council and offer evidence in relation 31 . _ thereto. For further particulars as to the proposed vacation of the herein- before described portion of said Street, reference is made to that certain map i I 1 marked "Plan No. 376 5'a pproved A pr i 1 28, 13 9, on file in the office of the 2 City Clerk of said City. 3I SECTION 4. Nothing in this Resolution shall in any way affect or 4 disturb any existing easements for public utility purposes belonging either to 5 � the City of San Bernardino or to any public utility and there is hereby reserved 6 for future general public utility purposes and for this City an easement reason- 7j ably necessary to locate public utility facilities over, in, under, or across I i 9 a portion of the real property described hereinbefore and to use, maintain, re- I pair, replace or renew such facilities. 10I SECTION 5.
