Welcome to a meeting of the Mayor and City Council of the City of San Bernardino.
o Anyone who wishes to speak during public comment or on a particular item will be required to fill out a
speaker slip. Speaker slips must be turned in to the City Clerk by 4:30 pm the day of the meeting.
o You may email your request to speak to publiccomments@sbcity.org if you cannot turn it in in person
prior to 4:30 pm. Each request will cover one speaker. Those who wish to speak must submit their
own request to be called on by the Mayor.
o Public comments for agenda items that are not public hearings will be limited to three minutes.
o There is a 6-minute-per-person time limit for all comments, excluding public hearings.
o All who wish to speak, including Council members and staff, need to be recognized by the Mayor or
Mayor Pro Tempore before speaking.

A three-minute limitation shall apply to each member of the public who wishes to
address the Mayor and City Council on any item on the agenda, excluding public
hearings. There is no limit to the number of items that may be discussed within the
three-minute time limit. To be called on by the Mayor, please turn in individual speaker

Replacement Project.

Professional Services Agreement with Keyser Marston Associates
Recommendation: Adopt a Resolution of the Mayor and City Council of
the City of San Bernardino, California, approving a
Professional Services Agreement with Keyser
Marston Associates (KMA) in an amount not to
exceed $55,000 for real estate, economic and
negotiation advisory services related to the evaluation
and negotiation of financial submittals, business terms
and agreements assistance related to the Carousel
Mall Project.
18. Police Department
Purchase of Bullet Proof Vests for Police Personnel
Recommendation: Adopt a Resolution of the Mayor and City Council of
the City of San Bernardino, California, to increase the
FY 2016/17 Purchase Order issued to Adamson
Police Products, Inc. by $150,000 for the purchase of
ballistic and SWAT vests in accordance with RFQ F-
17-02, with three optional one-year renewals.

Recommendation: Continue the Public Hearing that opened at the Mayor

adopt a Resolution.

Reallocation of Community Development Block Grant Public Service Funds
Recommendation: That the Mayor and City Council direct staff to move
forward with the FY 2017/18 Community
Development Block Grant (CDBG) application
assuming that the allowable 15% Public Service funds
will be allocated to federally-mandated Fair Housing
Programs and to City capital improvement activities
for a period of up to five years.

Recommendation: Adopt a Resolution of the Mayor and City Council of
the City of San Bernardino, California, authorizing an
increase from $5,000 to $10,000 to Purchase Order
2017-00000742 issued to Out of the Box Printing/R81
for military banners and hardware.

Recommendation: Open nominations for a member of the City Council to

Recommendation: 1. Adopt a Resolution of the Mayor and City

approving the Purchase and Sale Agreement
between the City of San Bernardino and the
Successor Agency to the Redevelopment Agency of
the City of San Bernardino with respect to 280 South
“E” Street, San Bernardino, California (APN 0136-11-
26), and approving certain related actions; and
2. Adopt a Resolution of the Successor Agency to
the Redevelopment Agency of the City of San

Code relating to ordinances and resolutions; Ordinance repealing and replacing
Chapter 2.02 regarding the position of City Manager; Ordinance repealing and
replacing Section 2.01.010 of the Municipal Code regarding the Mayor Pro
Tempore; Ordinance repealing and replacing Charter 2.58 regarding meetings;
and reaffirm the appointment of Mark Scott as City Manager to conform to the
City’s Charter
Recommendation: 1. Introduce for first reading an Ordinance
amending portions of Chapter 1.08 of the City of San
Bernardino Municipal Code relating to ordinances and
resolutions to implement the provisions of the newly
adopted Charter;
2. Introduce for first reading an Ordinance
repealing and replacing Chapter 2.02 regarding the
position of City Manager;
3. Introduce for first reading an Ordinance
repealing and replacing Section 2.01.010 of the
Municipal Code regarding the Mayor Pro Tempore to
conform to the City’s Charter;
4. Introduce for first reading an Ordinance
repealing and replacing Charter 2.58 regarding
meetings; and

scheduled for 2:00 p.m., Monday, April 3, 2017, in the Council Chamber of
City Hall, 300 North “D” Street, San Bernardino, California.

NOTICE: Any member of the public may address this meeting of the Mayor and City Council
and the Mayor and City Council Acting as the Successor Agency to the Redevelopment Agency
on any item appearing on the agenda by approaching the microphone in the Council Chamber
when the item about which the member desires to speak is called and by asking to be
recognized.
Any member of the public desiring to speak to the Mayor and City Council and the Mayor and
City Council Acting as the Successor Agency to the Redevelopment Agency concerning any
matter not on the agenda but which is within the subject matter jurisdiction of the Mayor and City
Council and the Mayor and City Council Acting as the Successor Agency to the Redevelopment
Agency may address the body at the end of the meeting, during the period reserved for public
comments. Said total period for public comments shall not exceed 60 minutes, unless
such time limit is extended by the Mayor and City Council and the Mayor and Cit y
Council Acting as the Successor Agency to the Redevelopment Agency. A three minute
limitation shall apply to each member of the public, unless such time limit is extended by the
Mayor and City Council and the Mayor and City Council Acting as the Successor Agency to the
Redevelopment Agency. No member of the public shall be permitted to “share” his/her three

Speakers who wish to present documents to the governing body may hand the documents to
the staff member responsible for collecting speaker request slips at the time the request to
speak is made.
The Mayor and City Council and the Mayor and City Council Acting as the Successor Agency to
the Redevelopment Agency may refer any item raised by the public to staff, or to any
commission, board, bureau, or committee for appropriate action or have the item placed on the
next agenda of the Mayor and City Council and the Mayor and City Council Acting as the
Successor Agency to the Redevelopment Agency. However, no other action shall be taken nor
discussion held by the Mayor and City Council and the Mayor and City Council Acting as the
Successor Agency to the Redevelopment Agency on any item which does not appear on the
agenda unless the action is otherwise authorized in accordance with the provisions of
subdivision (b) of Section 54954.2 of the Government Code.
Public comments will not be received on any item on the agenda when a public hearing has
been conducted and closed.

Chief Assistant City Attorney Jolena Grider, citing Government Code section 54954.4(e)
and 54957(c), announced that the council should meet with the police chief to discuss
potential danger to city buildings, and that this issue arose after the posting of the
agenda. The council agreed to take both issues up in a single vote.

City Clerk Gigi Hanna read into the record the titles of all the resolutions and ordinances
on the agenda for March 6, 2017.
Invocation/Pledge of Allegiance
Following a moment of silence in honor Civil Service Commissioner and 40-year City
employee Evelyn Alexander, Dr. Clyde Stewart of Westside Christian Center, led the
invocation. The Pledge of Allegiance was given by Dezerai Ponce, a fifth grade student
at Graciano Gomez Elementary School.

28. Public Comments for Items Not on the Agenda
Daniel Duffy, student of social work at CSUSB, spoke about a survey that found that
people want regulation of the marijuana shops. He requested that th council do this
soon in order to use funds raised from the regulation for other needs in the city.
Teresa Angulo, spoke about the project she nd other CSUSB students have been
working on, assessing community needs.
Scott Olson, San Bernardino, said that Measure O passed and Prop 64 passed and
the voters have given you their answer about their feelings regarding marijuana. He said
the situation in the city regarding marijuana shops is the responsibility of Gary Saenz,
as legal advisor to the city. He also admonished the mayor for not seeking advice from
Paul Chabot.
James Penman, San Bernardino, spoke about a letter from his firm to the City
regarding towing contracts and city policies.
Amelia Lopez, San Bernardino, announced that the kick-off for the 2017 Sober
Graduation event is Thursday, March 9 at Indian Springs High School .
Sandra Ibarra, San Bernardino, said she was glad to see the young voters come out to
the meeting and said she had voted no n all of the city initiatives on the November 2016
ballot. She said the Charter would not be implemented as it should, and said that the
dispensary ban is not working as it should. She suggested $100,000 fines for them. She
said that that by targeting marijuana, the city is targeting the poor and minorities. The
voters spoke, she said, and we have to respect their votes.
Jay Lindberg said the city has to deal with Measure O because it negotiated in bad
faith with people for 20 years. He discussed problems of climate change and showed a
map showing temperature anomalies in the Artic.
Blanca Lopez, discussed the California Earned Income Tax Credit and added a flier
about it into the record.
Matthew Ag uayo, San Bernardino, asked why the city is still criminalizing people for
the use of marijuana. He said Community Development Block Grant funds should not
be used for infrastructure, but to support social service agencies. He said he would not
be a 21-year-old City commissioner without the help of such agencies.
John Abad, San Bernardino, said the city needs federal funds and people here didn't
understand that the letter (discussed in Item 25) would bring money into the city. We
lack a tax base. People don't live here because they are afraid of the city. The city
needs housing.
William Ciocci, San Bernardino, congratulated people for coming out about the letter
(discussed in Item 25). He said, however, that when people come out, their voices aren't
heard, their will isn’t done; instead, they are labeled a gadfly. He said he had warned
city officials about the perils of Measure O early in the initiative process, but they
avoided him in order to keep the status quo.

Roxana Barrera, said she was Vice President of representing San Bernardino Valley
College Progressives group.

Erika Ruiz, San Bernardino, said she represented Inland Congregations United for
Change.
Luis Tirado, San Bernardino, said he represented San Bernardino County Young
Democrats.
Fabian Leon Torres, San Bernardino, said he represented San Bernardino Generation
Now and that the main concerns the group had to the letter (discussed in Item 25) were
the ideologies embedded in the letter. He asked the Mayor and City Council if they
serve a selected demographic. He said the group wants the MCC to acknowledge the
letter was an error, make a statement to that effect.
Miriam Nieto, said she was a member of San Bernardino Gneeration Now said that
many of her fellow young adults do not attend council meetings regularly because they
work at that time. Not everyone is privileged enough to sit for this many hours to find out
what is going on. She said: We are representing our city well and we wish you guys
would do the same thing. You need to apologize to the community for sending the letter
without the community's knowledge and agreement on the letter.
Ariana Corona, representing ICUC, said another request was to retract the letter.
Luis Lozano, representing CSUSB College Democrats, said another demand is that all
the officials who signed the letter attend a town hall hosted by the community on April
20, 2017.
Michael Segura, representing San Bernardino Generation Now and ICUC said the
Mayor and Council need to listen to all of the community. He said some of the
responses the council made (regarding Item 25) were rude and he is disappointed in
that, after allt he work he had put in on behalf of the city.
Allen Bartelman, San Bernardino, said the letter (discussed in Item 25) was clearly out
of line and the just demands of the people should be heard. He said the City needs to
withdraw the letter and revote every portion of it in another letter to Trump. He said the
City is still subject to a Brown Act complaint on the matter. He also said he is a disabled
vet, occasionally used medical marijuana and advocated for the Carosel Mall to become
a cannabis emporium.
Marven Norman, Colton, said the letter (discussed in Item 25) was disconcerting; they
are looking for resources, but only one resource was being asked for. A multi-prong
strategy is needed to address recovery for the city.

Discussion- Charter Implementation

City Manager Mark Scott opened the workshop explaining that implementation of
the new Charter is taking some time because it requires Municipal Code
changes, review of administrative regulations, policies and employee
agreements.
The Council will need to direct some of the coming changes, and staff had
prepared a work plan that would be a checklist of those issues the Mayor and
Council would be reviewing in the coming weeks via various work sessions.
The three ordinances in the agenda packet are the most critical time-wise and
that is why they were brought forward first, he said.
Scott introduced Kimberly Barlow, special counsel to the city on Charter
implementation, who went through the March 7, 2017 memo to the MCC,
discussing the immediate changes required by the new charter, the impact of the
new charter on the City Manager’s ability to reorganize staff, the scope of the

ongoing contract with the elected Clerk, Attorney and Treasurer, and the impact
on boards and commissions. The three ordinances in the agenda packet covered
these issues and will be in the agenda packet on Monday March 20, 2017 for
official introduction, she said.
MS. Barlow recommended the appointment of the City Manager within 60 days to
be in line with the new Charter.
After questions from Council members about boards and commissions, Ms.
Barlow said that the Council may want to combine the function of several of
them, that San Bernardino has more than any city she’s ever seen. Mr. Scott
concurred that a periodic review of boards and their functions is important.
City Attorney Gary Saenz said that the new Charter makes significant changes in
what constitutes a voting quorum. Councilmember Shorett asked about breaking
a tie vote in those instances where the Mayor votes and there is a 4-4 split. In
those cases, a split vote would mean the item failed, Saenz said. Council
Member Valdivia said there needs to be a provision for breaking a tie, but
Council Member Nickel said he likes the idea of having to confront a tie and work
out the issues and if they cannot garner 5 votes for a critical decision, then the
Mayor and Council need to reconsider the issue altogether.
Ms. Barlow clarified that in those cases where the mayor is voting, the entire
council does not need to be there, just a quorum.
In reviewing the Ordinance repealing and replacing Chapter 2.02 of the Municipal
Code (regarding the position of City Manager), there was discussion of the
appropriate spending authority the City Manager should have without Council
approval and where it should be delineated.
Ms. Barlow said that spending caps are typically addresses in purchasing
ordinances and that that can be addressed there. Assistant City Manager Andrea
Miller suggested that the proposed ordinance state that the City Manager’s
spending authority is “subject to limitations set in other ordinances,” and there
was consensus.
There was discussion about expanding the language under MC 2.02.060(L) to
clarify that the City Manager’s role in overseeing and supervising staff providing
service to the Mayor and City Council was a supportive role.
In reviewing the work plan, Ms. Miller said the next step would be to discuss the
specifics of meetings and she said staff would provide a packet of previous
actions the council has taken regarding conduct of meetings, and the conduct of
Council Members at the meetings. Council Members questioned the need for
another resolution directing how they would act at meetings, and mentioned one
passed in the 1980s and 2010-252.
Ms. Barlow passed out an ordinance setting the meeting day and times. Council
Member Nickel said he did not like meeting Mondays because it did not give
enough time to contact the City Manager with questions prior to a meeting. There
was discussion of which day would be preferable and the council came to
consensus on the second and fourth Tuesdays of the month, with Council
Member Valdivia suggesting that open session begin after 5 and closed session

be kept to an hour in length. Ms. Miller said that an ordinance to that effect would
be included on the Monday March 20, 2017 agenda for the council to consider.
3. PUBLIC COMMENTS FOR ITEMS NOT ON THE AGENDA
Sandra Ibarra, San Bernardino, asked that action on the Water Department
happen sooner rather than later because2015 rate increases were tied to the
need for infrastructure improvements which have not yet begun.
Jim Smith, San Bernardino, said he was pleased to see movement on Charter
implementation. He also mentioned that the memorial service for Evelyn
Alexander will be 10 a.m. Friday, March 17 at Mt. View Cemetery, with a
reception following at the Native Sons of the Golden West lodge.
Phil Savage, San Bernardino, said the Charter discussion was exciting and that
the Charter Committee intended that the council have flexibility under the new
Charter. He also discussed the issue of whether David Kennedy is interested in
retiring.
