RESOLUTION NO. 2017-86
RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN
BERNARDINO, CALIFORNIA, ADOPTING THE FISCAL YEAR (FY) 2017-2018
UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
(HUD) ANNUAL ACTION PLAN
WHEREAS, the City of San Bernardino participates in the United States Department
of Housing and Urban Development's (HUD) Community Development Block Grant
(CDBG), HOME Investment Partnerships (HOME), and Emergency Solutions Grant (ESG)
Programs; and
WHEREAS, to receive CDBG, HOME and ESG funds, the City must produce an
Annual Action Plan that describes the City's planned investments for the coming year,
including projected actions for the proposed CDBG, HOME, and ESG projects; and
WHEREAS, the City of San Bernardino anticipates receiving $2,739,216 in CDBG
funds and $245,643 in ESG funds for Fiscal Year 2017-2018; and
WHEREAS, as a member of the San Bernardino County HOME Consortium, the
City's HOME allocation will be redirected to the San Bernardino County Consortium to be
used for the development of affordable housing for person with low- and moderate -incomes
within the County.
WHEREAS, the City of San Bernardino has approximately $1,538,695 in unspent
CDBG funds, $1,192,397 in unspent HOME funds and $194,542 in unspent ESG funds that
the City will program to eligible activities that meet the City's FY 2015-2019 Consolidated
Plan goals and objectives; and
WHEREAS, the total amount of CDBG, HOME and ESG funds for Fiscal Year 2017-
2018 is $5,910,493; and
WHEREAS, under the City's Citizen Participation Plan for HUD funding, funding
recommendations for public service activities are made by the Community Development
Citizen Advisory Committee and reviewed and approved by the Mayor and City Council; and
WHEREAS, At the March 6, 2017, the Mayor and City Council adopted a policy that
directs CDBG public service funds for the next three to five years to eligible capital
improvement activities. This action made Community Development Citizen Advisory
Committee consultation unnecessary; and
WHEREAS, on March 30, 2017, a notice (in English and Spanish) of a City Council
public hearing was published in the San Bernardino Sun regarding the allocation of CDBG
and ESG funds and the availability of the Draft FY 2017-2018 Annual Action Plan for public
review and comment between March 30 — May 1, 2017; and

WHEREAS, the Mayor and City Council have considered the community needs,
priorities and strategies set forth in the 2015-2019 Consolidated Plan and the Housing
Element of the General Plan and concludes the proposed activities identified in the Draft FY
2017-2018 Action Plan are consistent with the strategies established in the Consolidated Plan
and Housing Element; and
WHEREAS, pursuant to Section 15378 of the State of California Environmental
Quality Act (CEQA) the proposed 2017-2018 Action Plan is considered a planning document
and is not and are therefore, exempt from the requirements of CEQA; and
WHEREAS, the proposed 2017-2018 Action Plan is subject to the provisions of the
National Environmental Protection Act (NEPA) of which any and all projects funded shall
comply.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, AS FOLLOWS:
SECTION 1. The Action Plan (Exhibit A) outlining the City's housing and
community development needs, priorities and strategies for FY 2017-2018 is hereby adopted,
and the City Council does hereby authorize the City Manager or his designee to be the official
representative of the City of San Bernardino to submit the Action Plan and certification
required to HUD.
SECTION 2. That CDBG, HOME and ESG funds for capital expenditure activities in
Fiscal Years 2017-2018 will be allocated to the agencies indicated on Exhibit A.
SECTION 3. That $547,843 in FY 2017-2018 CDBG funds, $18,423 in FY 2017-
2018 ESG funds, and $35,000 in available administration reimbursements of HOME funds
will be allocated for administrative costs necessary to administer the three (3) programs as
listed on Attachment 1.
SECTION 4. That approximately $1,192,397 in HOME funds from previous fiscal
years prior to the City's participation in the San Bernardino County Consortium be used to
support the creation of affordable housing within the City of San Bernardino.
SECTION 5. That the Mayor and City Council do hereby authorize the City
Manager, or his designee, to proportionately adjust the federal allocations to each approved
activity, in the event the City receives more or less federal funds than anticipated.
SECTION 6. That the Mayor and City Council do hereby authorize the City
Manager, or his designee, to be the official representative of the City of San Bernardino to
submit the Action Plan and certifications required for the CDBG, HOME and ESG funds.
SECTION 7. That the Mayor and City Council do hereby authorize the Acting City
Manager, or his designee, to be the official representative of the City of San Bernardino to
submit required environmental documentation for the CDBG, HOME and ESG activities.

SECTION 8. That the proposed Fiscal Year 2017-2018 Action Plan activities shall
undergo an environmental review prior to any release of funds consistent with the program
regulations found in 24 CFR, Part 58.5. Any violation of its provisions may result in
disapproval or modification of City funding.
SECTION 9. This Resolution shall take effect upon adoption. The City Clerk shall
certify to the adoption of this Resolution.
