Resolution of the City of San Bernardino supporting the repeal of Booking Fees in San
Bernardino County.

The State legislature authorized counties to charge cities booking fees with the passage of
Senate Bill 2557 in 1991.
On March 6, 1998, the Sheriff of San Bernardino County directed a letter to the
Chairman of the County Board of Supervisors requesting that booking fees in San
Bernardino County be eliminated. The letter included several facts: (1) that imposition
of booking fees was a necessity during a time of spiraling costs and a sharp downturn in
the local and state economies; (2) the economy has improved and it is believed that the
trend will continue; (3) a number of counties, including Orange and Ventura, have
eliminated booking fees; (4)the booking fee adversely affects law enforcement officers at
the street level as some cities directed officers not to arrest on some misdemeanors or
infractions; and (5) the elimination of booking fees would go a long way toward
improving relations with all of the cities in San Bernardino County.
Law enforcement agencies within the County agree with the Sheriff and want to show
support by sending resolutions to the San Bernardino County Board of Supervisors
requesting that booking fees be eliminated. If booking fees were to be eliminated, each
city would be encouraged to reinvest the monies in public safety. The total amount of
booking fees paid by all cities would be better used providing increased police services
county wide.
Financial Impact
The City of San Bernardino Police Department has budgeted $570,000 for booking fees
for Fiscal Year 1998/99.
Recommendation
Adopt Resolution supporting the repeal of Booking Fees in San Bernardino County.

5 WHEREAS,the State Legislators adopted Senate Bill 2557 in 1991 enabling counties
to charge cities for the cost of booking prisoners; and
6
WHEREAS, Cities have been charged for booking fees by the County since 1991;
and

WHEREAS, the imposition of booking fees was a necessity during a time of
9 spiraling costs and a sharp downturn in the local and state economies; and
10 WHEREAS, the economy has improved and it is believed that the trend will
11 continue; and
12 VTIEREAS, some counties comparable to San Bernardino are eliminating booking
fees at this time; and

• 14 WTIF.REAS,the booking fee adversely affected law enforcement officers at the street
level as some cities directed officers not to arrest on some misdemeanors or infractions; and

WIIEREAS,the elimination of booking fees would go a long way toward improving
16 relations with all of the cities in San Bernardino County; and
17 WfIEREAS, the Sheriff of San Bernardino County has directed a letter to the
18 County Board of Supervisors requesting the elimination of booking fees; and
19 WHEREAS,the cities support the decision of the Sheriff and join him to encourage
the San Bernardino County Board of Supervisors to eliminate the payment of booking bees
20 by cities in San Bernardino County.
21 NOW, THFRFFORE, BE IT RESOLVED that the Mayor and Common Council of City
22 of San Bernardino does support the elimination of booking fees and encourages the San
Bernardino County Board of Supervisors to discontinue booking fees.
