At our meeting of March 10, 2015, the Fine Arts Commission approved the proposal of San
Bernardino Generation Now for their project at Seccombe Lake Park which will take place on
April 18, 2015. The proposal is extremely well - planned, and almost fully funded by grants from
the Cal State, San Bernardino Office of Community Engagement and the South Coast Air
Quality Management District. Further, in -kind support is through the City's Parks and
Recreation Department. As of the date of our meeting, the group was seeking further support
from various sources. The enthusiasm of the group for this is contagious, and is shown by the
support they have already received.
The project includes clean -up of the park, and the painting of several murals, which will
certainly aid in revitalizing this mid -city park. The murals will be the result of much planning
and coordination with city officials and other consultants. Involvement of both experienced and
apprentice muralists, including children of the neighborhood, is part of the project, along with
color coordination and major themes.
The Fine Arts Commission is pleased to support the Seccombe Lake Mural Project, as a way to
beautify the city, to attract visitors to the park, and to unite people from many backgrounds who
wish to show pride in this city.

Fourth Floor Conference, Room A of City Hall.
COMMISSIONER/STAFF ANNOUNCEMENTS
GUEST SPEAKERS
A presentation was given by Melody Segura- Suarez of IPS and Susan Carol of Church of the
Nazarene regarding the mural project of the Institute for Public Strategies. Ms. Carol spoke
about murals and what they symbolize. Dr. David Morrow from Center for Learning and
students, Andrew Sorcina and Xialena St. Andrew spoke about the mural project.
A presentation of "The Witness — Community Talk Show" was given by Whitley Porter of
Kingdom Culture Worship Centre. Ms. Porter presented a budget and grant request for this
project to the FAC. No action taken.

APPROVAL OF MINUTES
A motion was made by Commissioner Michael Segura to approve the Minutes from February 10,
2015. The motion was seconded by Commissioner Donna Howard. Motion passed.
NEW BUSINESS
Multicultural Festival — Commissioner Bronica Taylor spoke briefly about putting
together a Multicultural Festival in 2016. It was recommended by Commissioner Lynette
Kaplan that Commissioner Taylor look into forming a committee for this project.
Commissioner Taylor asked that this item be placed on the April 14, 2015 FAC agenda
for further discussion.
OLD BUSINESS
March Arts Calendar — Copy inserted in Agenda Packet for commissioners' review.
2. Third Thursdays Food Fest — March 19, 2015 — Chairperson Garcia announced that the
FAC would no longer have a table at the Third Thursdays Food Fests.
3. Public Art policy and Seccombe Lake Project by S. B. Generation Now — Presentation
of the Seccombe Lake Park Murals Project Proposal was given by Jennica Billens of San
Bernardino Generation Now.
A motion was made by Commissioner Taylor that the Fine Arts Commission draft a letter in
support of San Bernardino Generation Now's Seccombe Lake Mural Project. The motion was
seconded by Commissioner Babcock. Motion passed.
4. Window Display at Arts on 5th Street — A presentation on "The Faces and Stories of
Downtown" project was given by Tom McGovern, Juan Delgado, professors from Cal
State University and Gregory Villanueva, owner of the Arts of 5th building. A grant
request was made in the amount of $3,664.00 to assist in the creation of this art project.
A motion was made by Commissioner Segura to approve the grant request for "The Faces and
Stories of Downtown" project in the amount of $3,664.00. The motion was seconded by
Commissioner Howard. Motion passed.

5. Grants Process Revision — Commissioners reviewed revisions to the Application
Guidelines for Funding Requests for Visual and Performing Arts.
A motion was made by Commissioner Lynette Kaplan to accept the revised grant application and
timelines. The motion was seconded by Commissioner Deborah Bunger. Motion passed.
6. Reports from Council Members on status of micro - grants — Chairperson Garcia read
email responses from Council Members regarding possible projects in their respective
wards.
PUBLIC COMMENTS
Anthony Victoria, reporter for El Chicano newspaper asked that the FAC contact him with
regard to future arts projects and events in the City of San Bernardino.
ADJOURNMENT
Meeting adjourned March 10, 2015 at 6:10 p.m. The next Fine Arts Commission meeting will
be on Tuesday, April 14, 2015 at 4:00 p.m., in the MIC Room, Sixth Floor of San Bernardino

BERNARDINO AMENDING SECTION 2.30.020 OF THE SAN BERNARDINO
MUNICIPAL CODE REGARDING THE FINE ARTS COMMISSSION
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:
Section 1. Section 2.30.020 of the San Bernardino Municipal Code is hereby amended to
read as follows:

"2.30.020 Duties.
The Fine Arts Commission shall:
Make recommendations to the Mayor and Common Council for the development and
promotion of the visual and performing arts in San Bernardino.
Work with public and private cultural organizations to promote the efficient utilization of
community art resources and to enlarge the opportunities for the diverse City
population to participate in and enjoy culturally rewarding experiences.
Develop a master plan for fine arts objectives and development in San Bernardino
Review the financial needs of fine arts organizations in San Bernardino and
recommend specific grants within the City budget allocation for approval by the Mayor
and Common Council to achieve overall cultural objectives.
Promote other art related activities as resources are available. 1AT4
Approve the design and location of all works of art"before they are acquired,
transferred or sold by the City, or are placed upon or removed from City property, or
are altered in any way."

CITY OF SAN BERNARDINO ART ACQUISITION POLICY
DRAFT: This is a draft policy concerning the acquisition of art for City of San Bernardino
property. It has not been reviewed or approved by the Fine Arts Commission. The policy is based
on the "Proposed Original Artwork Mural Ordinance" submitted to the City Attorney's Office by
the Fine Arts Commission. Wording is subject to change before approval. The draft policy has
been formatted to allow for easy editing. The final version will have substantial changes to the
formatting. Definitions will be added to final version. Waivers by artists will be added to the
final version.
SECTION ONE - PURPOSE
The purpose of this policy is to encourage is to establish guidelines for and encourage the
acquisition of art in the public spaces of the City of San Bernardino.
SECTION TWO — ART ACQUISITION GUIDELINES
Artwork for City Facilities should comply with the following:
2.1 The artwork should demonstrate higher aesthetic qualities, originality, and artistic
excellence;
2.2 The artwork is appropriate in scale, material, form, content and value such that it
contributes to the identity and viability of the community and promotes the image
of the City of San Bernardino;
2.3 The artwork is durable, permanent, and easily protected from vandalism and
weathering. Substantial consideration shall be given to the structural and surface
integrity and stability of the foundation (or building facade), the permanence and
durability of the artwork, and the artwork's resistance against weathering, theft,
and vandalism;
2.4 The artwork shall not have any unsafe feature or conditions that may affect public
safety; and,
2.5 The artwork shall not disrupt traffic, nor create any unsafe conditions or
distractions to motorists and pedestrians.
SECTION THREE - COMMISSION PROCESS
There are three methods by which the City of San Bernardino may commission art for City
Facilities.
3.1 OPEN: Artists submit proposals in response to a public advertisement. The Fine
Arts Commission then reviews the proposals and recommends and artist or artists
to the Mayor and Common Council for acquisitions or requests more detailed
proposals from selected artists.
3.2 INVITATIONAL: The Fine Arts Commission recommends a limited number of
artists on the basis of interview or review of previous work. The artists are then
invited to develop a site - specific proposal for a particular project. The artists may
then present a proposal to the Commission. The Commission then reviews the
submitted proposals and recommends acquisitions to the Mayor and Common
Council.
3.3 DIRECT: In this process, upon the recommendation of a majority of the
Commission who feel that one artist is particularly well qualified for a project,
s /he may be invited to submit a proposal directly to the Commission without a
competition process.
SECTION FOUR - ACQUISITION PROCEDURE
4.1 STEP ONE — The Fine Arts Commission defines a public art project by selecting
the location (ensuring the project is on City of San Bernardino property) and the
method of selection (see above).
4.2 STEP TWO — The Commission defines the parameters of the project to be used in
the call for artists or direct selection, develops a budget for the project, and adopts
a proposed call for artists for Department and Mayor and Common Council
approval. Public comment will be invited by the Commission.
4.3 STEP THREE — The proposed call for artists is considered by the appropriate
department charged with management of the particular location selected, such as,
the Board of Library Trustees, the Parks and Recreation Commission, or the
Director of Public Works. The proposed call for artists is then considered for
approval by the Mayor and Common Council. If either the department or Mayor
and Common Council do not approve the proposed call for artists, the Fine Arts
Commission may revise, revisit, or cancel the proposed call for artists.
4.4 STEP FOUR — The Commission reviews initial submissions, including the artist's
experience and qualifications, references, and preliminary proposals for the
project or specific works of art to determine compliance with the call for artists.
4.5 STEP FIVE — The Commission selects semi - finalists. The artists may present
their work at a public meeting of the Commission. The artists' work may be
displayed in a public place for a fixed time period and public comment invited.
4.6 STEP SIX — The Commission selects a final proposal and artist. The final
proposal and artist is considered by the appropriate department charged with
management of the particular location selected, such as, the Board of Library
Trustees, the Parks and Recreation Commission, or the Director of Public Works.
The recommendation of the Fine Arts Commission and the appropriate
department is made to the Mayor and Common Council and includes a timeframe
for completion, proposed contract with artist, and final budget.
4.7 STEP SEVEN — The Mayor and Common Council approve or denies the
selection, timeframe, contract, and budget.
SECTION FIVE - MAINTENANCE
Before a work is accepted into the City's collection, the artist must submit:
- A detailed list of exact types, brands, and colors of materials used;
A summary of cleaning instructions; and,
Estimated annual maintenance needs and costs in dollars.
This information will be kept on file with the Department of Public Works. Any maintenance
responsibilities of the artist or City must be clearly described in the contract with the artist. A
maintenance and inspection schedule suitable for the site and work will be implemented upon
possession of the work. Complete records of inspections, cleaning, and conditions of the work
will be kept on file with the Department of Public Works. If the work becomes damaged, the
City may contact the artist to see if s /he is willing to make the necessary repairs, or contract with
another party to repair the work in the City's discretion.
SECTION SIX - REMOVAL
The Fine Arts Commission may recommend to the Mayor and Common Council that a work be
removed from the City's collection. It is contemplated that removal may be necessary when any
of the following are present:
6.1 The artwork is its present state poses a safety hazard to the public or the
environment.
6.2 Restoration of the work aesthetically and /or structurally is not feasible, or the
expense of such restoration would be disproportionate to the value of the work.
6.3 The architectural support (building, wall, streetscape) is to be demolished and
relocation is not feasible.
6.4 Prolonged protest of the work persists to the extent that the work detracts rather
than enhances the site and the community.
6.5 The work acts as an encumbrance to the use of public property.
6.6 The public use of the site has changed or is proposed to change in a manner that is
no longer compatible with the artwork.
The artist shall be notified before any relocation or removal, if possible. The artist shall be given
the opportunity to purchase the art from the City.
SECTION SEVEN - DONATIONS
The City of San Bernardino welcomes any financial donations to benefit this art program.
Donations may be tax deductible and may be directed towards a specific project or purpose. The
City of San Bernardino also welcomes donations of art, however, before accepting or placing any
donated art the other requirements of this policy for art acquisition must be followed.
SECTION EIGHT - COMMUNITY INITIATED PUBLIC ART
In furtherance of the City's purpose to encourage art in public places, this section describes how
members of the community may come forth with beneficial art collection proposals.
8.1 The Community Initiated Public Art Application should be completed and
submitted with proposals to the Fine Arts Commission for their review and
possible recommendation to the City Council for final consideration.
8.2 Applications can be submitted to the City Clerk's Office at the 2nd Floor of City
Hall no later than 10 days before the next scheduled meeting to be included on the
agenda or the application can be submitted to the Commission at their meeting
during "Public Comments of any item not on the Agenda ". Applications presented
at "Public Comments" cannot be officially discussed or acted upon by the
Commission until the next meeting when it can be placed on the agenda.
SECTION NINE - SELECTION CRITERIA
All artwork proposals will be reviewed by the Fine Arts Commission for recommendation to the
Mayor and Common Council. The Commission will evaluate the works of art based on the
following criteria:
9.1 Verification that the artwork will be located on public property and be publicly
accessible.
9.2 Ability of the artist /applicant to complete the project within the proposed
timeframe and budget.
9.3 Commitment of proposed partners involved in the project. Application should
include a clear explanation of the responsibilities of each entity involved in the
project.
9.4 Ability /willingness of the artist /applicant to work with the FAC /City Staff.
9.5 Ability of the applicant to provide funding (if proposed).
9.6 Verification that the completed and installed artwork will become the property of
the City of San Bernardino.
9.7 Artwork meets design, safety and maintenance criteria, funding availability,
appropriateness of the artwork for the site and how well it contributes to the
identity and viability of the community and promotes the image of the City of San
Bernardino.
SECTION TEN - SUBMITTAL REQUIREMENTS
10.1 A completed Application Form
10.2 A site plan with building and grade elevation and building facades, showing the
placement of the proposed artwork within the site proposed.
10.3 A narrative statement to demonstrate that the artwork will be displayed in an area
open and freely available to the general public.
10.4 A narrative of the artist's concept.
10.5 Evidence of the value of the proposed artwork.
10.6 Description of maintenance requirements.
10.7 Visual representations of the artwork will be submitted in one of the following
formats:
10.7.1 8 "x 10" photographs or digital photos on CD depicting several
views of the artwork;
10.7.2 A model of the artwork; or
10.7.3 A graphic or artist illustration depicting several views of the
artwork.
10.8 Budget detail.
10.9 An application fee as set by the Mayor and Common Council.
SECTION ELEVEN - CURRENTLY EXISTING ARTWORK
Within 6 months of the effective date of this Policy, an assessment shall be done of all existing
artwork in City Facilities. After assessment and listing of the artwork, their conditions, and their
anticipated maintenance requirements, the Commission will recommend action on the currently
existing artwork to the Mayor and Common Council. Recommended action may include
maintenance, modification, relocation, or removal of the artwork.

EXPERIENCE PROFILE
Elwood & Associates (EA) was formed in 1993
to assist governmental agencies in cultural
planning to satisfy their public art requirement.
All projects are overseen by Lesley A. Elwood,
personally.
Lesley A. Elwood began her career in fine arts
in 1986 by working as a sales associate, and
later as an assistant director, for two well -
known Los Angeles -based contemporary
galleries. Curating exhibitions in community art
centers and alternative venues complemented
her private sector experience. In 1991, she
was employed by the City of Los Angeles
Cultural Affairs Department Public Arts
Program as Public Art Program Administrator.
In that capacity, Ms. Elwood began working on
a program to train artists and art consultants in
the policies and procedures of the City of Los
Angeles Percent - for -Art Requirement. In
cooperation with other departmental staff,
Elwood organized and conducted workshops
which addressed criteria for program or project
requirements, artists' presentations, artists'
contracts, public art maintenance, artists' rights,
and processes established for departmental
approval at various stages of artist commission.
Since 1993, numerous governmental agencies
and private developers have contracted EA,
including: the City of Los Angeles Community
Redevelopment Agency, City of Santa Fe
Springs, City of Los Angeles Cultural Affairs
Department, Long Beach Transit, Los Angeles
to Pasadena Metro Gold Line Construction
Authority, County of Los Angeles Community
Development Commission, and the Omnitrans
transit agency that services San Bernardino
County. These projects have all required
intensive community interaction, governmental
agency coordination, and artist oversight. In
addition to project management services, E &A
has also worked with several cities in
conducting studies that resulted in the creation
of policies and programs to support the
inclusion of public artworks into the urban
landscape.

and South America. EA has also conducted
public art educational tours for the City of Santa
Fe Springs, City of West Covina and the
National Gallery of Art, Palais de Glace in
Buenos Aires, Argentina.
PROJECT EXPERIENCE
Project Name and Location: Los Angeles to
Pasadena Metro Gold Line Project, Los
Angeles County, California.
Project Role: In 1999, the Los Angeles to
Pasadena Metro Construction Authority was
formed to construct the Gold Line light rail
system from Downtown Los Angeles to
Pasadena. Using the design /build process, the
Authority contracted with EA to provide project
management services for 12 artists (11 station
artists, 1 alignment artist) who had been
originally selected by the Metropolitan Transit
Authority in 1993 -94. E &A worked with a team
of design consultants representing the general
contractor. Total project budget for artwork was
$1.8 million. Project completed in July 2003.
Project Name and Location: Metro Gold Line
Foothill Extension Project — Phase 2
Pasadena to Montclair.
Project Role: In 2006 EA was brought on to
the project to oversee the program
development to create Station Art & Design
Committees with each Phase 2 corridor city.
EA services included development of an RFQ,
artist selection and design development of
concepts for all Phase 2 a/b stations. During
this process EA worked with a variety of
stakeholders to allow each city to select 2
finalists. All finalists for Phase 2a completed
80% schematic design services. Construction
will begin in late Fall of 2011.
Project Name and Location: Metro Gold Line
Foothill Extension Project, - Gold Line Bridge
Project Role— EA began services in 2009
provided planning with stakeholders for the
selection of artist to design IFS light rail bridge.

services to oversee an RFP process for the
selection of artists who created temporary
installations and a complimentary bus shelter
poster to encourage residents to "Go to the
Park" and experience the park in a new way.
Project was completed in 2009.
Project Name and Location: 5 Year Plan,
West Covina California
Project Role— E &A partnered with Gail
Goldman & Associates to review the ordinance
and program guidelines for the public art
requirement within the City. EA specifically
provided services related to the development of
a 5 -year plan for the arts commission. EA
continues to provide ongoing consultant
services to the City as they review proposal
submission and develop opportunities for
upcoming public art projects.
Project Name and Location: Omnitrans SBX
E Street Corridor Project, San Bernardino,
California
Project Role— EA drafted public art program
guidelines for Omnitrans transit agency. The
SBX project represented the first effort by the
agency to adopt guidelines and implement a
percent- for -art requirement for a new dedicated
bus line. In addition to planning services, EA
coordinated all work related to the outreach and
selection of artists for 14 transit stations that
are planned for east San Bernardino to Loma
Linda in the Inland Empire of Southern
California.

The City of San Bernardino Parks, Recreation and Community
Services is sponsor.
We are gearing up for the 011ie McDonald Talent Show at Sturges
Center for the Fine Arts on Saturday April 18th & Sunday April
19th. Note two performance dates!
011ie Me Donald was gifted with a beautiful tenor voice. 011ie
volunteered his talent at many events here. The showcase is
dedicated in his memory. All of the talent both on stage and off
volunteer their talent and preparatory expenses to entertain.
Performers are rehearsing for this 27th year and the theme is Back
to the Cabaret.
Colleen Sayles and Stevie Bruce are co- producers and directors
developing the two -hours of entertainment. Colleen has produced .
and directed 24 of the 27 shows. She said to me " Just because you
are old or mature doesn't mean you have to stop living, let young
people know we are talented!" She shares the outlook on life that
seniors do get up and do something and are giving back!
And what these 50 to over 90 year olds do with their voices and
dance will amaze you. Many have past professional careers in
entertainment.
I was in the show last year and performed with Ginny Aceves.
This show is a gem for our City and I ask that our citizens,
councilpersons and city public relation resources help to fill the
seats at Sturges. This year we'll have two shows -Sat April 18th
and Sunday April 19th. at 1:30 p.m.
Tickets are a donation of $7 and benefit senior activities. Tickets
are available at either 5th. Street Senior or Perris Hill Centers.
