FAC Business Plan Draft - 2014 -15
Description of the FAC (Duties, etc)
The Fine Arts Commission of the City of San Bernardino is established by ordinance as an
Advisory Commission to the Mayor and the City Council. There are eleven commissioners appointed by
the Mayor and Council members, nine regular and two alternates. Some funding is available through
the cultural development construction fees (Ordinance 50.57). The duties of the Commission, as stated
in the current recommended revision are:
A. Make recommendations to the Mayor and Common Council for the development and
promotion of the visual and performing arts in San Bernardino.
B. Work with public and private cultural organizations to promote the efficient utilization of
community art resources and to enlarge the opportunities for the diverse City population to
participate in and enjoy culturally rewarding experiences.
C. Develop a master plan for fine arts objectives and development in San Bernardino
D. Review the financial needs of fine arts organizations in San Bernardino and recommend
specific grants within the City budget allocation for approval by the Mayor and the Common
Council to achieve overall cultural objectives
E. Promote other art related activities as resources are available.
Goals of Commission for 2014 -15
1. Showcase the arts as an economic booster for the City.
2. Be a clearing house of art activities for the City, and promote art - related activities
3. Provide networking opportunities for arts organizations and artists �.
Projects for 2014 -15 (Numbers correspond to numbers of purposes)
Mural Policy - - -(2) —The Commission is currently working on a policy regarding murals in the City.
This policy will establish a process for obtaining permits for mural painting on both private and
public property. The recommended policy will be ready for review by the LRC by the middle of
October. From that point, if approved by the LRC, it will be presented for Council approval. We
would hope to have it in effect by the end of November. The policy will include a plan for _
assessing current murals in the city, in terms of acceptability. --6;-r.
Public Art -1 This is a long -term objective, and will be discus ed by the Commission in the
spring of 2015. The plan would be to define "public art," and to discuss current public art, and
ways of funding future such endeavors.
Networking opportunities -3 The Commission will host quarterly gatherings of arts leaders in
the City, giving them an opportunity to share ideas, and to possibly collaborate on projects.

Community Arts Calendar -2 Currently, the FAC is accepting information about arts events, and
putting those announcements on a Facebook page which has been established. This will
continue, with the possibility of moving the calendar to the City's website and making contact
with newspapers to include such a calendar in their local news pages.
Grants to arts organizations -1 and 2 -- A sub - committee of the Commision is currently looking
at the criteria and process that was established several years ago. The sub - committee will
report to the Commission by the end of October. At that time, arts organizations will be
notified of the timeline for applying for a grant. Because we are well into the fiscal year
2014 -15, the grants for this fiscal year will most likely be for a partial year, beginning in January.
Databases of arts organizations, venues and artists -3 This is an on -going project. The
Commission members are currently in the process of gathering this information. These
databases may be available on the city's website.
Film Production Booklet -1 This is currently a project in the office of the City Clerk, with input
from Commission members. Venues for possible film production will be photographed, and
contact information provided to film companies looking for sites to use for filming.

Mr. Saenz,
Per the California Public Service Act the Fine Arts Commission is respectfully requesting
in writing the fund balance available for the Fine Arts development fee. With the current
bankruptcy of the City the Fine Arts Commission would like to know if it is legally
feasible to use the funding for grants and if so what is readily available for said grants?

Fine Arts Grants Proposal _and Plan
The Fine Arts Commission has proposed to change the grant process and focus from
local fine arts 501c3 applications to awarding the San Bernardino City School
District and the City of San Bernardino Parks Department with funding to hire fine
arts instructors to facilitate workshops for children and adults.
Timeline and Plan.
November
Submit a written request under the California Public Records Act to the City
Attorney's office requesting a Fund Balance for the development fees held by the
city that are restricted to fine arts utilization.
In addition, request an exact figure on monies that would be available at this time to
disburse for fine arts projects. Request clarification on what funding is available
while the city is still in the bankruptcy process and whether those funds can be
accessed immediately.
December
If a response has been received from the City Attorney's office and funds are
available, the members of the commission will request to be put on the agenda for
the City Council Meeting and request permission from the council to disburse the
monies to the proposed Workshop Grants.
January
If approved by the City Council, a representative from the Fine Arts Commission
will meet with the Superintendent of Curriculum for the San Bernardino City School
District and the Head of the City Parks and Recreation Department to discuss the
program and the timeline.
The Fine Arts Commission will meet and decide the amounts of the awards and
write the requirements for the facilitators and the duration of the workshops.
School District and Parks and Recreation hiring requirements and background
checks will be included in these guidelines.

It was announced that Jack Hill Day will be on Thursday, October 16, 2014.
APPROVAL OF MINUTES
A motion was made by Tony Barber to approve the Minutes from September 23, 2014. The
motion was seconded by Michael Segura. Motion passed.
OLD BUSINESS — Mural Policy
GUEST SPEAKER
Steven Graham, Deputy City Attorney stated that he was asked to look over the Proposed
Original Artwork Mural Ordinance submitted by the FAC. He stated that he was super excited

to be assigned to the FAC and he volunteered for this assignment. He is also an advisor to the
Library and Parks.
He noticed the Proposed Original Artwork Mural Ordinance attempts to address both "private"
and "public" property murals. He highly recommends separating them out and have redundant
sections that have the same language. They can be within the same ordinance.
He stated that as it now stands there is no process in place for public art.
After looking at what the FAC has put together, it would most likely have to go within the
Development Code. It would become a Development Code amendment. The Development
Code requires that amendments go to the Planning Commission and then to the Council. He just
wanted to let the FAC know that there are some other procedural things that the FAC is going to
have to deal with.
Mr. Graham's recommendation would be to spend more time with what the FAC has put
together. He recommended being given 35 -45 days to go over it. While he is reviewing this he
suggests that the FAC assign someone in the commission to serve as his point of contact while
he is doing research. He said they could bring back a draft with recommended changes as they
relate to the legal analysis of it.
His recommendation would be to minimize the possibility of litigation against the City and to
make it as smooth as possible.
A motion was made by Bronica Taylor that our Chairperson Dorothy Garcia and Michael
Segura, Chairperson of the Mural Subcommittee meet with Steven Graham, Deputy City
Attorney to further discuss the proposed Mural policy. The motion was seconded by Deborah
Bunger. Motion passed.
Gigi Hanna indicated that she met with Mark Persico, Director of Community Development to
discuss some of his concerns.
First of all, he indicated that we needed to delete "non- commercial signage" which is
public /private.

The following were some of the concerns that Mr. Persico had:
N. Grandfathered /Legacy Murals - Mr. Persico thought that some of the wording about non-
conforming which was changed to legacy murals may legalize murals the FAC may not want to
legalize. That again is something the City Attorney's office can look at.
E. Development Standards states the mural shall remain in place without alterations for a
minimum of three years from the date. Mr. Persico was concerned that we are using a minimum
length and not a maximum length. He thought that was probably more up to Code since we
don't know how long they're going to be up. If you have to have a start and end date three to
five years, just be more specific.
F. Prohibited Murals - Mr. Persico stated we need to keep this paragraph in because the mural
indicates a large space and you are not going to get a large space on a single family house or a
small apartment.
L (1) Application Process — The FAC talked about murals on public property being approved by
the Department Director responsible for the property involved. Public buildings would be the
purview of the Public Works Director.
I. (4) Application Process - Mr. Persico stated that if the Ordinance doesn't require Council
approval you delegate it to the staff, but that gets into what Mr. Graham was talking about as far
as the selection process. That is going to be something legal is going to be looking at. (2) Mr.
Persico suggested replacing "summarily" with "removed ".
M. (2) Removal of a Permitted Mural — The FAC needs to define what artists' rights are.
N. (1) Non - Conforming Murals /Grandfathered /Legacy Murals - Mr. Persico said to put it back
to 12 months because of staffing issues. (2) In regards to removal of mural Mr. Persico suggested
the FAC put three months instead of six.
Ms. Hanna stated she would also be sharing these concerns with Mr. Graham of the City
Attorney's office. She said that this gave City staff a very good idea of where the FAC wants to
go with this and then they will come up with an ordinance that will try to meet the FAC's needs.

NEW BUSINESS — Grants Committee Report
Chairperson Garcia stated that the Business Plan Subcommittee met some time ago and came up
with a rough draft of description, goals, funding, and longer term projects for a business plan. A
copy was provided to the FAC.
Chairperson Garcia also stated that she and Gigi Hanna met with Michael McKinney, Mayor's
Chief of Staff and was told by Mr. McKinney that the Mayor was looking for a five year plan.
They felt it would be best to present a one year plan.
Lynette Kaplan stated that the subcommittee met on October 5, 2014 and looked at what grants
used to be which was that the organization had to be a 5010 established and funded for various
projects in all fields of the arts. The subcommittee felt that some of that money should go to
Educational programs in the Arts.
Discussion continued by the FAC regarding grant funds for various projects. It was suggested
that we partner with Parks, Recreation and Community Services and the San Bernardino Unified
School District.
Chairperson Garcia suggested that the subcommittee meet again after speaking to Parks,
Recreation and Community Services and the San Bernardino Unified School District.
Chairperson Garcia also asked that the commissioners look at the request provided by Patrick
Jewett of the Black Culture Foundation regarding donations for the sculpture of Rosa Parks.
THIRD THURSDAY FOOD FEST
Chairperson Garcia stated that the FAC should aim for the November 20, 2014 event.
Jeffrey Thurman stated that he contacted Richardson Prep High and San Gorgonio High School,
about performing at the Third Thursday Food Fest. The problem getting bands here is
economics. The students have to be transported by buses and cannot be privately transported
here.
Chairperson Garcia stated that she has tickets for performances from the Sinfonia, Cal State
Showcase, and the Symphony.
Lynette Kaplan made a motion to wait until the November 20, 2014 First Thursday Food Fest for
the art display and to hold on to raffle tickets for drawing until then. The motion was seconded
by Barbara Babcock. Motion passed.

PUBLIC COMMENTS
Jacob Cook, San Bernardino musician spoke about an Art Town Grant.
Elizabeth Flores, San Bernardino artist spoke about her interests in murals and about the mural
she painted at 777 North Waterman Avenue, San Bernardino.
Jennifer Billens, San Bernardino spoke about her feedback on specific items within the draft
Mural ordinance.
Jorge Heredia, member of Generation Now spoke about his interest in the mural ordinance. He
met with Mayor Davis and he stated that what he would like from Generation Now to be
involved with youth to prevent them from joining gangs. He stated that doing art with these kids
would be a perfect opportunity for them.
Doug Rickert of Bud Rickert Art Center, San Bernardino spoke about his support of placing
short termed murals on "E" Street.

Character- defining Feature: A prominent or distinctive physical feature of a structure that contributes
significantly to its historic character.
Commission: The Fine Arts Commission of the City of San Bernardino.
Historical Structure: A locally designated historic landmark structure or structure located within the boundaries
of a locally designated historic district; or single landmark building or building located within a district
designated on the National Register of Historic Places.

ordinance. Note: the word "legacy" was approved by the commission at the September 23rd meeting.
Original Artwork Mural: A painting that is applied to and made an integral part of an exterior wall, or a tiled
artwork applied to an exterior building wall, with the property owner's permission or consent. An "Original
Artwork Mural" does not include:
1. Mechanically produced or computer - generated prints or images, including but not limited to digitally
printed vinyl;
2. Murals containing electrical or mechanical components; or
3. Changing Image Murals, as defined above.
For all future reference to Original Artwork Mural(s) in this Ordinance, the term "mural(s) is used.
Private property: Commercial sites, business sites, or residences owned by individuals, corporations:, etc.
Public property: Property owned by any government entity, i.e., city, county, state.
E. DEVELOPMENT STANDARDS Original Art Murals shall comply with all the following:
1. The mural shall remain in place without alterations for a minimum of . three years from the date
the mural is completed. The applicant shall certify in the permit application that the applicant agrees to
maintain the mural in place for a minimum period of five - years three years without alteration.
2. The mural shall not extend more than six inches from the plane of the wall to which it is attached.

F. PROHIBITED MURALS. The following are prohibited in the City
2. A mural that is placed on historical structures unless approve by the Historical Preservation Commission
al if compensation is given or received, there must be
an agreement signed by both parties.
4.A mural that contains obscene matters, as defined in Section 311 of the California Penal Code, or images that
would incite immediate violence, so as to constitute "fighting words."
G. GUIDELINES FOR ORIGINAL ARTWORK MURALS
Murals shall comply with all of the following:
1. The Original Artwork Mural must demonstrate the higher aesthetic qualities, originality and artistic
excellence,

1 The mural shall be durable, permanent, and easily protected from vandalism and weathering. Substantial
consideration shall be given to the structural and surface integrity and stability of the building facade, the
permanence and durability of the mural, and the mural's resistance against weathering, theft and
vandalism,
4. The mural shall not have any unsafe features or conditions that may affect public safety, and
5. The mural shall not disrupt traffic, nor create any unsafe conditions or distractions to motorists and
pedestrians.
H. APPLICATION REQUIREMENTS. An application for a mural permit shall be filed with the ` =� �.���4z�
Fire Arts Commission first, and shall include the following:
1. Name of the artist (s);
2. Examples of previous work done by the artist(s) with references;
3. Description of the materials to comprise the proposed mural and manner of application;
4. Statement regarding durability of the materials considering the location and positioning of the proposed
mural;

S. Plans and specifications for the proposed mural including an exact picture, graphic or other description;
6. and application fee as established by resolution of the City Council; to be paid when approval is final, Y of

the Department Director responsible for the property involved (i.e., Parks— Director of Parks and
Recreation; Historic public structure --- Historic and Preservation Commission; tither --- Community
Development Department. The remainder of the application procedure shall be the same as required
for private property,

Within 10 days of the determination that the application is processed by the Planning DepaAmen

Advisory Committee shall review the application and make a recommendation on whether to approve
the application, The c issi Committee shall recommend approval of the application if all of the
following findings are made:
The mural meets all of the Development Standards listed in sub- section E and is consistent with
all of the Guidelines listed in sub - section G.
b. The artist, or artist team, is capable of completing the work in accordance with the plans and
specifications.
c. The information contained in the application regarding the durability and maintenance requirements of
the mural is accurate.
d. The proposed materials to be used and the manner of application will not require excessive
maintenance and repair costs by the owner.
Commission Review. Within Is days of the submittal of the Advisory Committee's recommendation, the
Commission shall review the application at a public hearing. The scheduling of the hearing for
consideration of the application may be more than 10 days after the submittal of the Advisory
Committee's recommendation, with the applicant's approval. Notice of the public hearing shall be
mailed to all property owners and occupants of property immediately adjacent to and directly across the
street from the property where the mural is to be placed. The notice of public hearing shall be mailed
not less than ten days before the date of the public hearing. The Commission shall consider the
application, and may approve, approve with changes or deny the application, based on the findings set
forth in Sub - section 1.2. The Commission shall approve the application if all of the findings listed in Sub-
section 1.2 are made. The decision to approve or deny the permit shall be made and announced at the
public hearing. In making its decision, the Commission may consider evidence of property values and the
opinions of the owners and occupants of adjacent properties. Within 5 days of the approval of the
Commission, the Planning Depawnent Community Development Department shall issue the mural
permit.
4. After Staff Review, the recommendation for approval of a mural on public property shall be forwarder)
f. Appeal. The applicant may file a written request for an appeal to the City Council within 20 days of the
decision of the Commission. The City Council shall only review applications that have been denied by the
Commission. The City Clerk shall receive the original application, written reports and the appeal request.
The City Council may affirm, reverse or modify in whole or in part any Commission decision or
requirement. The City Council shall reverse the Commission's decision and approve the original
application, if all of the findings listed in Sub - section 1.2 are made. The decision by the City Council shall
be final.
J. PERMIT EXPIRATION AND EXTENSIONS
1. Except as provided in Subsection J.2 below, if installation of the permitted Original Artwork Mural has not
taken place within 12 months of the date of issuance of the mural permit, the permit is void and no further
work on the mural may be done at the site until a new permit has been approved and the fee paid.
2. An approved mural permit may be extended by the Planning gepaFtmeA Community development
Department for an additional period of no more than 12 months upon the Planning Department's finding
that the applicant was unable to begin or continue the installation of the approved mural for reasons
beyond his or her control. A request for permit extension must be in writing and must be received by the
Planning Community Development Department before the original permit's expiration date. If the approved
mural has not been completed within this extended time period, the permit is void. A permit may be
extended only once.

� 3. A photograph of the completed mural shall be submitted to the Fine Arts Commission within 10 days of
completion as proof of completion of the mural, inscribed with the date of completion.
K. MAINTENANCE
1. The property owner is responsible for ensuring that a permitted Original Artwork Mural is maintained in
good condition and fully repaired in the case of vandalism or accidental clestruction.1 he property owner iu
alloweci 3o days to repair, the mural before consequences occur, as delineated in section K- 2,
2. Failure to maintain the Original Artwork Mural as provided herein is declared to be a public nuisance, and

may be summarily abated or repaired by the City. The City may pursue additional remedies tuobtain

compliance with the provisions of this Section asappropriate.

mural permit completion.
4. Before removal of the mural, the applicant or property owner must notify the Community Developm eW.
Department and the Fine Arts Commission with a letter stating intent to remove the mural and an
explanation of the circumstances necessitating the removal. At that same time, the applicant shall also
provide proof that the applicant has notified the artist or artists who created the mural of the applicant's
intent bz remove the mural.
S. Within 45 days of the applicant's or property owner's notification, the Planning community Development
Department shall approve the request provided it meets at least one of the circumstances described under
M.1 and that the applicant has shown sufficient proof of notification of the artist or artists who created the
mural of the applicant's intent to remove the mural.
6. After the term of five three years from the date of completion, a mural may be removed without
notification. Any associated materials that were used to secure the mural to the wall, including,but not
limited to, mounting hardware, brackets, caulk, grout, adhesives and/or glues, must be removed at the time
of removal of the mural, and the building must be fully restored to its original, pre-mural condition.
N. NON G NFORMING MURAL6 G RkNDFA[H ERED/ LEGACY MURALS
1. VVithin-12B months of the effective date of this ordinance, an assessment shall be done of all existing
murals in the City. After the assessment and listing of the murals and their conditions, the Gky4llaffniog

may be issued without a fee, provided that the mural is in compliance with this ordinance, and be given the

I. Unless amural permit is issued to a "nonconforming mural" the mural existing at the time of the assessment
shall be removed within six months of the notification by the City pursuant to Section N that the mural is not
in conformance with this section. Additional time may be granted by the Commission.

location.
That supporting role was
just the idea supervisors
Jeff Stone and John Benoit
had in mind last year wher
they proposed amending
county ordinance to give
commercial production
companies temporary, free
use of county -owned pro-
perty and facilities during
filming.
"This is exactly the kind
of assistance we wanted to
provide," said Stone, chair-
man of the board. "It stim-
ulates the economy, pro-
vides jobs and helps the mo-
vie industry thrive in Cali-
fornia."
The ordinance was
amended in October amid
reports that many movie
production companies
were abandoning California
for more film-friendly`loca-
tions.
On Sept. 3, panicked pro -
ducers of the movie "Chalk
It Up" wound up without a
shooting location and con-
tacted the Riverside Coun-
ty Film and Television Of-

Hoo and Tarah Paige, the
lead actresses in "Stick It,"
joined forces again in
"Chalk It Up." Written and
produced by Curley and
Brooke Buffington, the film
tells the tale of a girl who is
dumped by her boyfriend
and decides to win him
back, an effort that includes
building a college gymnas-
tics team.
"The Film and Television
Office eliminated red tape
and, in one stop, kept our
production moving for-
ward. Riverside County is
filled with wonderful loca-
tions and filming opportun-
ities," Buffington said.
Since the county ordi-
nance was amended, pro-
duction companies have
used county facilities and
property several times on
projects such as "Little
Loopers," starring singer
and actress Natalie Imbru-
glia.
