PURPOSE AND INTENT: The purpose of this ordinance is to permit and encourage Original Artwork Murals (as defined below) on a content- neutral basis, that are ( i. )sufficiently durable and will be properly maintained; (ii) are located in appropriate places on buildings, and constitute a particular scale of the building fa4ade; (iii) do not include any unsafe features,or would not pose any unsafe conditions to vehicular or pedestrian traffic; (iv) provide venues for artistic expression, and (v) are assets to the community. It is the intent of this ordinance to establish regulations for the installation and application of Original Artwork Murals on Public property. B. ORIGINAL ARTWORK MURAL PERMIT REQUIREMENT. An Original Artwork Mural may be located on any publicly owned building in the City, provided it is first approved by permit issued by the City's Community Development Department in accordance with the procedures and criteria listed in this section. C. EXEMPTIONS: The following murals are exempt from this section: i. Murals that are proposed as Public Art for private development as regulated by..... ii. Murals that are funded by In -Lieu contributions and donations to the City's Public Art Fund and that are .... D. DEFINITIONS Alteration: Any change in a permitted Original Artwork Mural including, but not limited to, any change in the image or images, materials, colors, or size of the mural. "Alteration" does not include: (i) naturally occurring changes to the mural that result from the maintenance of repair of the mural, including but not limited to the mural caused by exposure to the elements or the passage of time; (ii)minor changes to the mural that result from the maintenance or repair of the mural, including, but not Limited to, slight and unintended deviations from the original image, colors or materials. Building Fw4ade: That portion of any exterior elevation on the building extending from grade to top of the parapet, wall or eaves and the entire width of the building elevation. Changing Image Mural: A mural that through the use of moving structural elements, flashing or sequential lights, lighting elements, or other automated method, results in movement, the appearance of movement or a change of mural image or message. "Changing image" murals do not include otherwise static murals where illumination is turned off and back on not more than once every 24 hours. Character - defining Feature: A prominent or distinctive physical feature of a structure that contributes significantly to its historic character. Commission: The Fine Arts Commission of the City of San Bernardino. Historical Structure: A locally designated historic landmark structure or structure located within the boundaries of a locally designated historic district; or single landmark building or building located within a district designated on the National Register of Historic Places. Grandfather Mural: A mural already in existence as of the effective date of this ordinance. Original Artwork Mural: A painting that is applied to and made an integral part of an exterior wall, or a tiled artwork applied to an exterior building wall, with the property owner's permission or consent. An "Original Artwork Mural does not include: i. Mechanically produced or computer - generated prints or images, including but not limited to digitally printed vinyl; ii. Murals containing electrical or mechanical components; or 9 -23 -14 Old Business Item 2 2 iii. Changing Image Murals, as defined above. For all future reference to Original Artwork Mural(s) in this Ordinance, the term " mural(s) is used. E. DEVELOPMENT STANDARDS Mural(s) shall comply with all the following: i. The mural shall remain in place without alterations for a minimum of three years from the date the mural is completed. The applicant shall certify in the permit application that the applicant agrees to maintain the mural in place for a minimum period of three years without alteration. ii. The mural shall not extend more than six inches from the plane of the wall to which it is attached. F. PROHIBITED MURALS. The following are prohibited in the City A mural that is placed on historical structures unless approved by Historical Preservation Commission. A mural that contains obscene matters, as defined in Section 311 of the California Penal Code, or images that would incite immediate violence, so as to constitute "fighting words." G. GUIDELINES FOR ORIGINAL ARTWORK MURALS Murals) shall comply with all of the following: i. The mural(s) must demonstrate high aesthetic qualities, originality and artistic excellence. ii. The mural(s) is appropriate in scale, material, form, content and value with the immediate social and physical environment. iii. The mural shall be durable, permanent, and easily protected from vandalism and weathering. Substantial consideration shalt be given to the structural and surface integrity and stability of the building fa4ade, the permanence and durability of the mural(s), and the mural's resistance against weathering, theft and vandalism. iv. The mural(s) shall not have any unsafe features or conditions that may affect public safety, and v. The mural(s) shall not disrupt traffic, nor create any unsafe conditions or distractions to motorists and pedestrians. H. APPLICATION REQUIREMENTS. An application for a mural permit shall be filed with the Fine Arts Commission first, and be recommended to Community development Department and shall include the following: i. Name of the artist (s); ii. Examples of previous work done by the artist(s) with references; iii. Description of the materials to comprise the proposed mural and manner of application; iv. Statement regarding durability of the materials considering the location and positioning of the proposed mural; v. Plans and specifications for the proposed mural including an exact picture, graphic or other description; vi. and application fee -is established by resolution of the City Council.( Should only have to pay fee if approved to paint. Also fee would be 50 dollars. 25 to the public art fund and 25 to department processing paperwork) (we should have a model form /template to make the process easier for artist) I. APPLICATION PROCEDURE i. *Advisory Committee Review. Within days of the determination that the application is processed by the Fine Art Commission, the application shall be considered by the Advisory Committee on Murals. The Advisory Committee shall review the application and make a recommendation on whether to approve the application. The Commission shall recommend approval of the application if all of the following findings are made: i. The mural meets all of the Development Standards listed in subsection E and is consistent with all of the Guidelines listed in sub - section G. ii. The artist, or artist team, is capable of completing the work in accordance with the plans and specifications. iii. The information contained in the application regarding the durability and maintenance requirements of the mural is accurate. iv. The proposed materials to be used and the manner of application will not require excessive maintenance and repair costs by the owner. i. Commission Review. Within _days of the submittal of the Advisory Committee's recommendation, the Commission shall review the application at a public hearing. The scheduling of the hearing for consideration of the application may be more than _ days after the submittal of the Advisory Committee's recommendation, with the applicant's approval. Notice of the public hearing shall be mailed to all property owners and occupants of property immediately 9 -23 -14 Old Business Item 2 adjacent to and directly across the street from the property where the mural is to be placed. The notice of public hearing shall be mailed no less than ten days before the date of the public hearing. The Commission shall consider the application, and may approve, approve with changes or deny the application, based on the findings set forth in Sub- section 1.2. The Commission shall approve the application if all of the findings listed in Sub - section 1.2 are made. The decision to approve or deny the permit shall be made and announced at the public hearing. In making its decision, the Commission may consider evidence of property values and the opinions of the owners and occupants of adjacent properties. Within _days of the approval of the Commission, the Community Development Department shall issue the mural permit after staff review. ii. Staff Review. The application for a(n) mural(s) permit shall be submitted to the City Planning Department for final review by Planning staff. Planning staff shall make a determination on completeness of the application within 30 days of its submittal to the Planning Department. iii. Appeal. The applicant may file a written request for an appeal to the City Council within 20 days of the decision of the Commission. The City Council shall only review applications that have been denied by the Commission. The City Clerk shall receive the original application, written reports and the appeal request. The City Council may affirm, reverse or modify in whole or in part any Commission decision or requirement. The City Council shall reverse the Commission's decision and approve the original application, if all of the findings listed in Sub - section 1.2 are made. The decision by the City Council shall be final. J. PERMIT EXPIRATION AND EXTENSIONS i. Except as provided in Subsection J.2 below, if installation of the permitted mural(s) has not taken place within 12 months of the date of issuance of the mural permit, the permit is void and no further work on the mural may be done at the site until a new permit has been approved and the fee paid. ii. An approved mural permit may be extended by the Planning Department for an additional period of no more than 12 months upon the Planning Department's finding that the applicant was unable to begin or continue the installation of the approved mural for reasons beyond his or her control. A request for permit extension must be in writing and must be received by the Planning Department before the original permit's expiration date. If the approved mural has not been completed within this extended time period, the permit is void. A permit may be extended only once. K. MAINTENANCE i. The property owner is responsible for ensuring that a permitted mural(s) is maintained in good condition and fully repaired in the case of vandalism or accidental destruction. Property owner is allowed 30 days to repair mural before consequences occur. ii. Failure to maintain the mural(s) as provided herein is declared to be a public nuisance, and may be summarily abated or repaired by the City. The City may pursue additional remedies to obtain compliance with the provisions of this Section as appropriate. iii. In addition to other remedies provided by law, in the event the property owner fails to maintain the mural, upon reasonable notice, the City may perform all necessary repairs or maintenance to the mural or secure insurance, and all costs incurred by the City shall become a lien against the property. L. MURAL ALTERATIONS. Alterations to an mural(s) with in three years from the date of completion shall only occur pursuant to a new mural permit, approved and issued by the procedures described in Sub - section 1. A new mural permit for Alterations shalt only be issued under the following circumstances: i. The building on which the mural is located is sold, or ii. The building or property is substantially remodeled or altered in a way that precludes continuance of the mural. M. REMOVAL OF A PERMITTED MURAL. i. Removal of an mural(s) within the first three years of the date of completion shall only be approved under the following circumstances: ii. The building on which the mural is located is sold, or iii. The building or property is substantially remodeled or altered in a way that precludes continuance of the mural. iv. The removal of the mural shall be in accordance with all federal and state laws and regulations pertaining to artists' rights. V. Removal of the permitted mural for reasons other than the circumstances described above preclude approval of a new mural permit at the site for a three -year period after the date of the original mural permit completion. vi. Before removal of the mural, the applicant or property owner must notify the Community Development Department and the Art Commission with a letter stating intent to remove the mural and an explanation of the circumstances necessitating the removal. At that same time, the applicant shall also provide proof that the applicant has notified the artist or artists who created the mural of the applicant's intent to remove the mural. Within 45 days of the applicant's or property owner's notification, the Community Development Department shall approve the request provided it meets at least one of the circumstances described under M.1 and that the applicant has shown sufficient proof of notification of the artist or artists who created the mural of the applicant's intent to remove the mural. viii. After the term of three years from the date of completion, an mural(s) may be (replaced with another Mural) or removed without notification. Any associated materials that were used to secure the mural to the wall, including,but not limited to, mounting hardware, brackets, caulk, grout, adhesives and /or glues, must be removed at the time of removal of the mural, and the building must be fully restored to its original, pre -mural condition. N. GRANDFATHER MURALS i. Within 6 months of the effective date of this ordinance, an assessment shall be done of all existing murals in the City. After the assessment and listing of the murals and their conditions, the City Planning Dept. (Community Development Department) shall notify the owner's with properties that feature these existing murals, that the Mural is deemed a "Grandfather Mural." A mural permit may be issued without a fee, provided that the mural is in compliance with this ordinance. ii. Unless a mural permit is issued to a "Grandfather Mural" the mural existing at the time of the assessment shall be removed within six months of the notification by the City pursuant to Section N that the mural is not in conformance with this section. Additional time can be granted by the Fine Art Commission. iii. The expansion of a "Grandfather Murat" is prohibited unless by original artist(s). iv. Repair of a "Grandfather Mural" by other artist is possible with artist consent. 9 -23 -14 Old Business Item 2 FAC Business Plan Draft - 2014 -15 Description of the FAC (Duties, etc) The Fine Arts Commission of the City of San Bernardino is established by ordinance as an Advisory Commission to the Mayor and the City Council. There are eleven commissioners appointed by the Mayor and Council members, nine regular and two alternates. Some funding is available through the cultural development construction fees (Ordinance 50.57). The duties of the Commission, as stated in the current recommended revision are: A. Make recommendations to the Mayor and Common Council for the development and promotion of the visual and performing arts in San Bernardino. B. Work with public and private cultural organizations to promote the efficient utilization of community art resources and to enlarge the opportunities for the diverse City population to participate in and enjoy culturally rewarding experiences. C. Develop a master plan for fine arts objectives and development in San Bernardino D. Review the financial needs of fine arts organizations in San Bernardino and recommend specific grants within the City budget allocation for approval by the Mayor and the Common Council to achieve overall cultural objectives E. Promote other art related activities as resources are available. Purposes of Commission for 2014 -15 1. Showcase the arts as an economic booster for the City. 2. Be a clearing house of art activities for the City, and promote art - related activities 3. Provide networking opportunities for arts organizations and artists Projects for 2014 -15 (Numbers correspond to numbers of purposes) Mural Policy - - -(2) —The Commission is currently working on a policy regarding murals in the City. This policy will establish a process for obtaining permits for mural painting on both private and public property. The recommended policy will be ready for review by the LRC by the middle of October. From that point, if approved by the LRC, it will be presented for Council approval. We would hope to have it in effect by the end of November. The policy will include a plan for assessing current murals in the city, in terms of acceptability. Public Art -1 This is a long -term objective, and will be discussed by the Commission in the spring of 2015. The plan would be to define "public art," and to discuss current public art, and ways of funding future such endeavors. Networking opportunities -3 The Commission will host quarterly gatherings of arts leaders in the City, giving them an opportunity to share ideas, and to possibly collaborate on projects. 9 -23 -14 New Business Item 1 Community Arts Calendar -2 Currently, the FAC is accepting information about arts events, and putting those announcements on a Facebook page which has been established. This will continue, with the possibility of moving the calendar to the City's website and making contact with newspapers to include such a calendar in their local news pages. Grants to arts organizations -1 and 2 -- A sub - committee of the Commision is currently looking at the criteria and process that was established several years ago. The sub - committee will report to the Commission by the end of October. At that time, arts organizations will be notified of the timeline for applying for a grant. Because we are well into the fiscal year 2014 -15, the grants for this fiscal year will most likely be for a partial year, beginning in January. Databases of arts organizations, venues and artists -3 This is an on -going project. The Commission members are currently in the process of gathering this information. These databases may be available on the city's website. Film Production Booklet -1 This is currently a project in the office of the City Clerk, with input from Commission members. Venues for possible film production will be photographed, and contact information provided to film companies looking for sites to use for filming. Funding available for 2014 -2015= $437,000 Grants to Arts Organzations -- Recommended amount of funds to be allocated in 2014 -15 $130,000? Film Production Booklet— Recommended amount of funds allocated in 2014 -15 ? ? ?? Community -wide projects-- - Includes possibility of Roosevelt Bowl renovation? Long term project: By 2017, develop a master plan for fine arts objectives and development in San Bernardino 2014 -15— Review master plans of other cities, receive input from community members, developers, and other stake - holders. 2015 -16 -- -Begin writing goals, objectives and expected outcomes of a master plan. 2016 -17 -- -Have final draft ready for Mayor and Common Council approval by January of 2017. 9 -23 -14 New Business Item 1 11 ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING SECTION 2.30.020 OF THE SAN BERNARDINO MUNICIPAL CODE REGARDING THE FINE ARTS COMMISSSION THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: Section 1. The prelude for this local gem goes back more than a century when a future site of a reservoir in San Bernardino — at the crest of a hill just south of Highland Avenue — was christened "Perris Hill" as a compliment to Fred T. Perris. Perris was a member of the city's Board of Water Commissioners who deeded to the city a site near the hill for a pumping plant. On Dec. 9, 1910, The San Bernardino Sun reported on this tribute to Perris while also hinting at the potential for this location to evolve into an attractive tourist destination. "The scenic drive which will encircle the hill will be known as Perris Drive and it will have no equal for scenic wonders in all California Southland." By the end of the month, teams had been hard at work leveling the reservoir site on top of the hill. Within a few years, Perris Hill was being touted as "one of the unique show places of Southern California, in addition to a delight pleasure place for our own people." The new park near Perris Hill was becoming a reality by 1927, and The Sun had this to say in its July 30 edition: "San Bernardino has the possibility of a park on and about Perris Hill unequaled in its sightlines, from the top and slopes of which would be afforded an unrivaled view of the valley and mountains, a place of beauty that would make the city famous and sought by visitors from far and near, as Smiley Heights is at Redlands — and water is the first requisite for the realization of such a dream." By the mid- 1930s, "Perris Hill Park" had become a favorite playground for families in San Bernardino. Then on Feb. 4, 1935, the San Bernardino Sun proudly announced the grand jewel of Perris Hill Park. "San Bernardino took a long stride forward in civic achievement yesterday afternoon when the outdoor bowl at Perris Hill Park was dedicated in honor of the man whose expansive work relief program made its construction possible — Franklin D. Roosevelt." "The impressive ceremonies at Roosevelt Bowl drew a throng of more than 3,000 in the amphitheater itself while others outlined the hill surrounding the structure completed at a cost of $26,000. The bowl has a capacity of 4,000." Mayor Ormonde W. Seccombe unveiled a bronze plaque indicating that the Franklin D. Roosevelt Bowl was erected A.D. 1934 and included the names and organizations of those responsible for the structure. Seccombe started the ceremony by thanking the gallant efforts from the administration of our 32nd president for making this project possible. The mayor said in part: "In unveiling the plaque that signifies San Bernardino's dedication of this bowl as a monument to President Roosevelt and his national re- employment program, I wish to emphasize the importance to our community and to the entire county, of the millions of dollars of Government money being paid in the form of Federal work relief wages to our citizens." Those participating with the dedication echoed the unified enthusiasm of the beautiful bowl hosting pageants and plays, entertainment, concerts shows and meetings. Since its grand opening nearly 80 years ago, the Roosevelt Bowl has been a popular venue for plays, concerts, musicals and church services but needs major upgrades today such as lighting, sound system, and seating improvements. The patrons of the Roosevelt Bowl Board of Directors are working to facilitate these upgrades to bring families, local businesses and the community together to continue sharing history, arts, culture, and entertainment at Perris Hill Park, but they need your help! One way you can contribute is to come out and enjoy San Bernardino's Farmers Fair and Market Night while providing patronage to our local vendors. Every dollar spent is money toward the improvements needed to bring the Roosevelt Bowl back to its former glory. The San Bernardino Farmers Fair and Market is every Monday from 6 to 9:30 p.m. at Perris Hill Park — the season is May 5 through Oct. 27.
