Art Walk Public Comment Adjournment The next meeting of the Fine Arts Commission is set for 4: 00 p.m. Tuesday, September 9, 2014 in the City Clerk's Conference Room, Second Floor of San Bernardino City Hall. CITY OF SAN BERNARDINO FINE ARTS COMMISSION AMENDMENTS TO MUNICIPAL CODE CHAPTER 2.30 Resolution to Provide Technical Changes to the Definition of Fine Arts and to Redefine Certain Authorities of the Fine Arts Commission Office of the Mayor (Introduced at the Request of the Fine Arts Commission) Existing Law: Resolution MC -309, passed October 11, 1983, established the Fine Arts Commission as Chapter 2.30 of the Municipal Code which consists of nine (9) members and two (2) alternates. Commissioners are appointed by each Member of the Council with two (2) Commissioners and the two (2) alternates appointed by the Mayor. The Commissions responsibilities are: • Make recommendations to the Mayor and Common Council for the development and promotion of fine arts in San Bernardino • Work with public and private cultural organizations to promote the efficient utilization of community art resources and to enlarge the opportunities for the divers City population to participate in and enjoy culturally rewarding experiences • Develop a Master Plan for fine arts objectives and development in San Bernardino • Review the financial needs of fine arts organizations in San Bernardino and recommend specific grants within the City Budget allocation for approval by the Mayor and Common Council to achieve overall cultural objectives • Accomplish specific projects related to fine arts as determined by the Mayor and Common Council Chapter 2.17.010(f) of the Municipal Code provides the general provisions of the Fine Arts Commission. An Further, Chapter 15.57, passed September 9, 1986, established the imposition of "Cultural Development Construction Fees" within the Development Impact Fee schedule pursuant to the California Mitigation Fee Act. The fee is imposed on all new commercial construction as defined as is levied at one -half of one percent of total construction costs. The fee has been temporarily reduced to one - quarter of one - percent by Council action for a period of 24 months. Requirements of the Mitigation Fee Act are articulated in 15.57.070 which states: The funds derived from this fee shall be deposited in a separate fund with identification as to the source, so that the Mayor and Common Council may consider appropriate expenditures in its annual budget for allocation to cultural development activities in the City. The use of the funds shall be reviewed annually by the Mayor and Common Council. Recommendations for the use and allocation of the funds collected under Chapter 15.57 are provided by the Fine Arts Commission pursuant to their requirements under 2.30.020. The current fund balance of funds collected pursuant to Chapter 15.57 is $1.173 Million. This Resolution would make technical changes updating the definition of "fine arts" and would broaden the authority of the Fine Arts Commission to promote art- related activities as resources are available. E Discussion: On Tuesday, August 5, 2014, the Fine Arts Commission met and recommended by majority vote to proposed changes to Chapter 2.30.020 of the Municipal Code relating to defining fine arts and broadening authority of the Commission to promote art- related activities. Under the current Municipal Code "Fine Art" is left undefined. Under current definition "Fine Art" is art developed primarily for aesthetics, distinguishing it from applied art that also has to serve some practical function. Historically, the five main fine arts were painting, sculpture, architecture, music and poetry, with performing arts including theater and dance. Today, the Fine Arts commonly include additional forms, such as film, photography, conceptual art, and printmaking. Fine Arts are currently associated exclusively with visual art forms. One definition of fine art includes: "A visual art considered to have been created primarily for aesthetic and intellectual purposes and judged for its beauty and meaningfulness, specifically, painting, sculpture, drawing, watercolor, graphics, and architecture." There are conceptual differences between the "Fine Arts" and the "Applied Arts." As originally conceived, and as understood for much of the modern era, the perception of aesthetic qualities required a refined judgment usually referred to as having good taste, which differentiated fine art from popular art and entertainment. The term "Fine Art" is now rarely found in art history, but remains common in the art trade and as a title for university departments and degrees, even if rarely used in teaching. The recommendation of the Fine Arts Commission would better define those artistic expressions considered under the more current definition of "visual and performing arts." This definition would conform to more common and current definitions and would provide a more descriptive meaning to those arts under the purview of the Commission. Chapter 2.030.020 establishes the duties of the Fine Arts Commission as follows: A. Make recommendations to the Mayor and Common Council for the development and promotion of fine arts in San Bernardino B. Work with public and private cultural organizations to promote the efficient utilization of community art resources and to enlarge the opportunities for the divers City population to participate in and enjoy culturally rewarding experiences C. Develop a Master Plan for fine arts objectives and development in San Bernardino D. Review the financial needs of fine arts organizations in San Bernardino and recommend specific grants within the City Budget allocation for approval by the Mayor and Common Council to achieve overall cultural objectives E. Accomplish specific projects related to fine arts as determined by the Mayor and Common Council The Commission recommends changes that strike and replace §(E) to the following language: "(E) Promote other art- related activities as resources are available." The language is intended to broaden the permissive authority of the Commission to allow for promotion of art within the City of San Bernardino. Discussion by the Commission included concerns over previous Administration's directing the full- resources of the Commission for projects supported by the Administration as opposed to those directed by the Commission. Further, the section allows the Commission greater responsibility outside of the mere recommendation of grant funds for approval by the Council and Mayor. It is the intent of the Fine Arts Commission to update the City's Fine Arts Master Plan by 2017. No funding in the past two (2) fiscal years has been allocated from those collected under Chapter 15.57. Such funding is restricted in use by both the Mitigation Fee Act requirements and pursuant to Chapter 15.57. All funding requests will still require Council/Mayoral approval. As Ex- Officio Member of the Fine Arts Commission the Office of the Mayor concurs with the recommendations of the Fine Arts Commission and refers the matter to the Council for consideration.
