BE IT RESOLVED BY THE MAYOR AND CO[`IMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby' authorized and directed to execute on behalf of said City a First Amendment to Agreement with Omnitrans which will provide for a one year extension of the term of the agreement relating to conducting a worker's compensation/loss prevention program for OnLnitrans, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and Common Council of the City of Sari Bernardino at a regular meeting thereof, held on the 2nd day of August 1982, by the following vote, to wit: AYES: NAYS: ABSENT: Council Members Castaneda, Reili-%7, TT,ernandez r nuiel, Hobbs, Strickler None None City Clerk The foregoing resolution is hereby approv is day of August , 1982. 28 mayor (of t .e City off" San Bernardino Approved as to form: ity T ktorn 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 FIRST AMENDMENT TO AGREEMENT (Worker's Compensation/Loss Prevention Program) THIS FIRST AMENDMENT TO AGREEMENT is entered into between the CITY OF SAN BERNARDINO, a municipal corporation, ("City"), and OMNITRANS, a joint powers authority, ("Omnitrans"). City and Omnitrans agree as follows: 1. Recitals. (a) City and Omnitrans entered into an agreement on August 5, 1981, ("the agreement"), relating to City conducting a worker's compensation/loss prevention program for Omnitrans. (b) The parties now desire to amend the agreement to provide for a one year extension of the term. 2. Term. The term of the agreement is extended for an additional period of one year commencing July 1, 1982, and (terminating June 30, 1983. 3. Payment for Services. Omnitrans shall pay to City for the services provided for under this agreement, the total sum of $9,000.00, payable in equal quarterly installments of $2,250.00, on August 1, November 1, February 1, and May 1, during the term of this agreement. Omnitrans shall also bear all costs of the program and shall promptly reimburse City for all expenditures made in connection with the program, whether such expenditures are made from the trust account or otherwise. 4. Other Provisions. All other terms, conditions and covenants of the agreement shall remain the same and be in full force and effect.
