RESOLUTION NO. 82--462
RESOLUTION OF THE CITY OF SAN BERNARDINO PROHIBITING THE
CONSIDERATION OF SPECIFIC REQUESTS FOR WAIVER OF FEES FOR PERMITS,
LICENSES OR APPROVAL OF ACTIVITIES UNLESS AUTHORIZED BY LAW OR
UNDER CITY SPONSORSHIP; AND REPEALING SECTION 1 SUBSECTION (d) OF
RESOLUTION NO. 81-549.
WHEREAS, various resolutions establish fees for permits,
licenses and authorization to use municipal facilities, obtain
services or permission to conduct activities pursuant to
ordinances of the City of San Bernardino; and
WHEREAS, occasionally organizations and citizens request
waiver of such fees for economical or justifiable reasons or f -( ,)U
charitable or civic purposes; and
WHEREAS, unless exempted by law under appropriate standards
or through sponsorship of the City, a waiver of the fees would be
contrary to law and for a private purpose,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Any request or application for a waiver of a fee
for a permit or license or authorization or approval to use
municipal facilities or property, obtain service or permission to
conduct any activity or program or otherwise to obtain approval of
the legislative body pursuant to any ordinance or resolution of
the City of San Bernardino shall not be placed upon the agenda of
or presented to the Mayor and Common Council for consideration
unless such request or application for a waiver of a fee or fees
is reasonably believed by the City Administrator to be authorized
by law. However, a request or appeal for sponsorship or
participation by the City of San Bernardino may be submitted. The
City Administrator shall have authority to reject any

application for waiver of fees unless sponsorship by the City is
requested.
SECTION 2. Section 1 Subsection (d) of Resolution No.
81-549 is hereby repealed.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a regular meeting thereof, held
on the 15th day of November , 1982, by the following
vote, to wit:

marks, Quiel, Hobbs, Strickler
