This agreement is entered into between LOMA LINDA UNIVERSITY, RIVERSIDE, CALIFORNIA, Hereinafter known as the "Institution", and C ity of San Bernardino and Clean Community hereinafter known as the "Agency", (a private nonprofit organization within the meaning of that term as defined in section 1104.2 (g) of the regulations governing the college Work Study Program), for the purpose of providing work to students eligible to participate in .the college Work-Study Program. 2. Schedules to be attached to this agreement from time to time, bearing the signatures of an authorized official of the Institution and of the Agency, will set forth: (1) A. brief description of the work to be performed by students . on this project. (2) The hourly rates of pay. (3) The approximate number of hours per week each student will be utilized. (4) The total length of time the project is expected to run. (5) And the director under which the student will be working. 3. Students will be made available to the Agency by the Institution for perfor- mance of specified work .-assignments_ Students may be removed from work on a particular assignment or from the Agency, by request of the Agency to the Institution or by the initiative of the Institution. The Agency agrees that no student- will be denied work or subjected to different treatment under this agreement on the grounds of race, color, or national origin, and that it will comply with the provisions of the Civil Rights Act of 1964 (P. L. 88-352; 78 Stat. 252) and the regulations ofthe Department of Health, Education, and Welfare which implement that Act. 4. The Institution shall be deemed the employer for purposes of this agreement. It has the ultimate right to control and direct the services of the student for the Agency. It shall also determine that the students meet the eligibility requirements for employement under the college Work-Study Program, assign stu- dents to work for the Agency, determine that the students do perform their work in fact,' and disburse the appropriate amounts to them_ The Agency's right shall be limited to determining the project and to direct the details and means by which the result is to be accomplished. 5. Compensation of students for work performed on a project under this agreement will be paid by the Institution. All payments due as an employer's contribution under state or local workmen's compensation laws, under Federal or state social security laws, or under other applicable laws, will be borne by the Agency, by reimbursment to the Institution. 6. The Agency is to reimburse the Institution for 20% of all compensation paid to the student and 5% for Workmen's Compensation and other applicable costs (a total of 25%) as billed monthly. 7. In accordance with the requirements of the Federal program, work to be performed under this agreement must be in the public interest, which (1) will not result in the displacement of employed workers or impair existing contracts for services (2) will be governed by such conditions of employements, including compensation, as will be appropriate and reasonable in light of such factors as type of -work performed, geographical region and proficiency of employee, and (3) does not involve the cons' -uction, operation, or maintenance of so much of any facility Page. 2 FEDERAL WORK-STUDY AGREEMENT as is used, or is to be used for secretarian instruction or as a place for religious worship. Further, no project may involve political activity or work for any political party. Under the College Work Study Regulations, no student may perform work on any project under the Workstudy Program for more than forty hours per week or such lesser number of hours per week as his Institution may determine in ac- cordance with its own standards and practices and considering (1 ) the extent of the student's financial need, and (2) the potential harm of particular combination of hours of work and hours of study on a given student's health or academic progress. Activities will enclude the following,: a. Answer the "Litter Hotline" , refer complaints to appropriate agency and followup said complaints . b. Perform routine clerical tasks for Coordinator and Executive Committee. including filing, simple typing and specific tasks required by the Coordinator or Committee. 3. ) The wages to be paid are $4. 00 an hour. The committee of Citizens for a Clean Community/Natural Beauty Program will be paying $1.00 an hour toward said wages .
