BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY
7 OF SAN BERNARDINO AS FOLLOWS:
8 SECTION 1. That Engineering Resources of Southern California, Inc., located at
9
1820 Commercenter Circle, San Bernardino, CA 92408, is a competent, experienced
10
11 consulting engineering firm and has provided the most advantageous and best proposal to
12 provide environmental and civil engineering design services for the widening of 40th Street
13 from Johnson Street to Electric Avenue (SSO4-014). An Agreement in the not-to-exceed
14 amount of $178,555.00 including five potholes, with said firm to provide said services, is
15
attached hereto as Exhibit "A", incorporated herein, and made a part hereof. Pursuant to this
16
17 determination, the Purchasing Manager is hereby authorized and directed to issue a Purchase
18 Order for said services to said firm, which references this Resolution.
19 SECTION 2. That the City Manager is hereby authorized and directed to execute said
20 Agreement on behalf of the City.
21 SECTION 3. That the authorization to execute the above-referenced Agreement is
22
rescinded, if it is not executed and returned to the Office of the City Clerk within sixty (60)
23
24 days of the passage of this Resolution.

AGREEMENT FOR PROFESSIONAL ENVIRONMENTAL AND CIVIL
ENGINEERING DESIGN SERVICES FOR THE WIDENING OF 40TH STREET
FROM JOHNSON STREET TO ELECTRIC AVENUE (SSO4-014)
THIS AGREEMENT is made and entered into this gth day of January
2017 ("Effective Date"), by and between the CITY OF SAN BERNARDINO, a charter city
("City"), and ENGINEERING RESOURCES OF SOUTHERN CALIFORNIA, INC.
("Consultant").
WITNESSETH :
A. WHEREAS, City proposes to have Consultant provide Professional Environmental
and Civil Engineering Design Services for the Widening of 40th Street from Johnson Street
to Electric Avenue (SSO4-014) as described herein below; and
B. WHEREAS, Consultant represents that it has that degree of specialized expertise
contemplated within California Government Code, Section 37103, and holds all necessary
licenses to practice and perform the services herein contemplated; and
C. WHEREAS, City and Consultant desire to contract for specific services in connection
with the project described below and desire to set forth their rights, duties and liabilities in
connection with the services to be performed; and
D. WHEREAS, no official or employee of City has a financial interest, within the
provisions of California Government Code, Sections 1090-1092, in the subject matter of this
Agreement.
NOW, THEREFORE, for and in consideration of the mutual covenants and
conditions contained herein, the parties hereby agree as follows:
1.0. SERVICES PROVIDED BY CONSULTANT
1.1. Scope of Services. Consultant shall provide Environmental and Civil
Engineering Design Services for the Widening of 40th Street from Johnson Street to Electric
Avenue (SSO4-014) (the "Project") in accordance with Consultant's proposal dated August 4,
2016, attached and incorporated herein as Attachment"1".
1.2. Professional Practices. All professional and contracting services to be
provided by Consultant pursuant to this Agreement shall be provided by personnel
experienced in their respective fields and in a manner consistent with the standards of care,
diligence and skill ordinarily exercised by professional consultants in similar fields and
circumstances in accordance with sound professional practices. Consultant also warrants
that it is familiar with all laws that may affect its performance of this Agreement and shall
advise City of any changes in any laws that may affect Consultant's performance of this
Agreement.

1.3. Warranty. Consultant warrants that it shall perform the services required by
this Agreement in compliance with all applicable Federal and California employment laws
including, but not limited to, those laws related to minimum hours and wages; occupational
health and safety; fair employment and employment practices; workers' compensation
insurance and safety in employment; and all other Federal, State and local laws and
ordinances applicable to the services required under this Agreement. Consultant shall
indemnify, defend, and hold harmless City from and against all claims, demands, payments,
suits, actions, proceedings, and judgments of every nature and description including
attorneys' fees and costs, presented, brought, or recovered against City for, or on account of
any liability under any of the above-mentioned laws, which may be incurred by reason of
Consultant's performance under this Agreement.
1.4. Non-discrimination. In performing this Agreement, Consultant shall not
engage in, nor permit its agents to engage in, discrimination in employment of persons
because of their race, religion, color, national origin, ancestry, age, physical handicap,
medical condition, marital status, sexual gender or sexual orientation, or any other category
protected by law, except as permitted pursuant to Section 12940 of the Government Code.
Violation of this provision may result in the imposition of penalties referred to in Labor
Code, Section 1735.
1.5 Non-Exclusive Agreement. Consultant acknowledges that City may enter into
agreements with other Consultants for services similar to the services that are subject to this
Agreement or may have its own employees perform services similar to those services
contemplated by this Agreement.
1.6. Delegation and Assignment. This is a personal service contract, and the duties
set forth herein shall not be delegated or assigned to any person or entity without the prior
written consent of City.
1.7. Business License: The Consultant shall obtain and maintain a valid City
Business Registration Certificate during the term of this Agreement.
1.8. Duty of Loyalty/Conflict of Interest: The Consultant understands and agrees
that as the City's representative the Consultant shall maintain a fiduciary duty and a duty of
loyalty to the City in performing Consultant's obligations under this Agreement. Consultant,
in performing its obligations under this Agreement, is governed by California's conflict of
interest laws, Government Code Section 87100 et seq., and Title 2, California Code of
Regulations Section 18700 et seq.
1.8.1 Prior to performing any services to City under this Agreement,
Consultant shall provide the City Engineer a written list of the Assessor Parcel Numbers and
general location or address of any and all real property located in the City of San Bernardino
in which Consultant has any ownership interest, or which is the location of any pending
project that is a source of income for Consultant. Consultant shall keep this list current on a
monthly basis during the entire term of this Agreement.

1.8.2 Consultant shall not work on any task that is related to any real property that
is located within 500 feet of any parcel in which Consultant has any ownership interest or
which is the location of any pending project that is a source of income for Consultant.
2.0. COMPENSATION AND BILLING
2.1. Compensation. Over the term of this Agreement, Consultant shall be paid for
such services the not-to-exceed amount of $173,805.00 plus $4,750 for five potholes at
$950.00 each in accordance with the Fee Proposal from Consultant dated August 4, 2016,
attached and incorporated herein as Attachment"2".
2.2. Additional Services. Consultant shall not receive compensation for any
services provided outside the scope of services specified in this Agreement unless the City or
its Project Manager for this Project, prior to Consultant performing the additional services,
approves such additional services in writing. It is specifically understood that oral requests
and/or approvals of such additional services or additional compensation shall be barred and
are unenforceable.
2.3. Method of Billing. Consultant may submit invoices to City's Project Manager
for approval on a progress basis, but no more often than monthly. Said invoice shall be
based on the total of all Consultant's services which have been completed to City's sole
satisfaction. City shall pay Consultant's invoice within forty-five (45) days from the date
City receives said invoice. Each invoice shall describe in detail, the services performed and
the associated time for completion. Any additional services approved and performed
pursuant to this Agreement shall be designated as "Additional Services" and shall identify
the number of the authorized change order, where applicable, on all invoices.
2.4. Records and Audits. Records of Consultant's services relating to this
Agreement shall be maintained in accordance with generally recognized accounting
principles and shall be made available to City or its Project Manager and/or audit at mutually
convenient times for a period of three (3) years from the Effective Date.
3.0. TIME OF PERFORMANCE
3.1. Commencement and Completion of Work. The obligation to perform the
professional and contracting services to be performed pursuant to this Agreement shall
commence within five (5) days from the Effective Date of this Agreement. Said services
shall be performed in strict compliance with the Project Schedule approved by the City's
Project Manager. Failure to commence work in a timely manner and/or diligently pursue
work to completion may be grounds for termination of this Agreement.
3.2. Excusable Delays. Neither party shall be responsible for delays or lack of
performance resulting from acts beyond the reasonable control of the party or parties. Such
acts shall include, but not be limited to, acts of God, fire, strikes, material shortages,
compliance with laws or regulations, riots, acts of war, or any other conditions beyond the
reasonable control of a party.

4.0. TERM AND TERMINATION
4.1. Term. This Agreement shall commence on the date approved by the City
Manager and continue until the Environmental and Civil Engineering Design Services for the
Widening of 40th Street from Johnson Street to Electric Avenue (SSO4-014) are completed
or June 30, 2018 whichever is sooner, unless previously terminated as provided herein or as
otherwise agreed to in writing by the parties.
4.2. Notice of Termination. The City reserves and has the right and privilege of
canceling, suspending or abandoning the execution of all or any part of the work
contemplated by this Agreement, with or without cause, at any time, by providing written
notice to Consultant. The termination of this Agreement shall be deemed effective upon
receipt of the notice of termination. In the event of such termination, Consultant shall
immediately stop rendering services under this Agreement unless directed otherwise by the
City.
4.3. Compensation. In the event of termination, City shall pay Consultant for
reasonable costs incurred and professional and contracting services satisfactorily performed
up to and including the date of City's written notice of termination. Compensation for work
in progress shall be prorated as to the percentage of work completed as of the effective date
of termination in accordance with the fees set forth herein. In ascertaining the professional
and contracting services actually rendered hereunder up to the effective date of termination
of this Agreement, consideration shall be given to both completed work and work in
progress, to complete and incomplete drawings, and to other documents pertaining to the
services contemplated herein whether delivered to the City or in the possession of the
Consultant.
4.4 Documents. In the event of termination of this Agreement, all documents
prepared by Consultant in its performance of this Agreement including, but not limited to,
finished or unfinished design, development and construction documents, data studies,
drawings, maps and reports, shall be delivered to the City within ten (10) days of delivery of
termination notice to Consultant, at no cost to City. Any use of uncompleted documents
without specific written authorization from Consultant shall be at City's sole risk and without
liability or legal expense to Consultant.
5.0. INSURANCE
5.1. Minimum Scope and Limits of Insurance. Consultant shall obtain and
maintain during the life of this Agreement all of the following insurance coverages:
(a) Comprehensive general liability, including premises-operations,
products/completed operations, broad form property damage, blanket
contractual liability, independent Consultants, personal injury with a
policy limit of not less than One Million Dollars ($1,000,000.00),
combined single limits,per occurrence and aggregate.

(b) Automobile liability for owned vehicles, hired, and non-owned
vehicles, with a policy limit of not less than One Million Dollars
($1,000,000.00), combined single limits, per occurrence and
aggregate.
(c) Workers' compensation insurance as required by the State of
California.
(d) Professional errors and omissions ("E&O") liability insurance with
policy limits of not less than One Million Dollars ($1,000,000.00),
combined single limits, per occurrence and aggregate. Consultant
shall obtain and maintain, said E&O liability insurance during the life
of this Agreement and for three years after completion of the work
hereunder.
5.2. Endorsements. The comprehensive general liability insurance policy shall
contain or be endorsed to contain the following provisions:
(a) Additional insureds: "The City of San Bernardino and its elected and
appointed boards, officers, agents, and employees are additional
insureds with respect to this subject project and contract with City."
(b) Notice: "Said policy shall not terminate, nor shall it be cancelled, nor
the coverage reduced, until thirty(30) days after written notice is given
to City."
(c) Other insurance: "Any other insurance maintained by the City of San
Bernardino shall be excess and not contributing with the insurance
provided by this policy."
5.3. Certificates of Insurance. Consultant shall provide to City certificates of
insurance showing the insurance coverages and required endorsements described above, in a
form and content approved by City, prior to performing any services under this Agreement.
5.4. Non-limiting. Nothing in this Section shall be construed as limiting in any
way, the indemnification provision contained in this Agreement, or the extent to which
Consultant may be held responsible for payments of damages to persons or property.
6.0. GENERAL PROVISIONS
6.1. Entire Agreement. This Agreement constitutes the entire Agreement between
the parties with respect to any matter referenced herein and supersedes any and all other prior
writings and oral negotiations. This Agreement may be modified only in writing, and signed
by the parties in interest at the time of such modification. The terms of this Agreement shall
prevail over any inconsistent provision in any other contract document appurtenant hereto,
including exhibits to this Agreement.

6.2. Representatives. The Public Works Director or his designee shall be the
representative of City for purposes of this Agreement and may issue all consents, approvals,
directives and agreements on behalf of the City, called for by this Agreement, except as
otherwise expressly provided in this Agreement.
Consultant shall designate a representative for purposes of this Agreement
who shall be authorized to issue all consents, approvals, directives and agreements on behalf
of Consultant called for by this Agreement, except as otherwise expressly provided in this
Agreement.
6.3. Project Managers. City shall designate a Project Manager to work directly
with Consultant in the performance of this Agreement.
Consultant shall designate a Project Manager who shall represent it and be its
agent in all consultations with City during the term of this Agreement. Consultant's Project
Manager shall attend and assist in all coordination meetings called by City.
6.4. Notices. Any notices, documents, correspondence or other communications
concerning this Agreement or the work hereunder may be provided by personal delivery,
facsimile or mail and shall be addressed as set forth below. Such communication shall be
deemed served or delivered: a) at the time of delivery if such communication is sent by
personal delivery; b) at the time of transmission if such communication is sent by facsimile;
and c) 48 hours after deposit in the U.S. Mail as reflected by the official U.S. postmark if
such communication is sent through regular United States mail.

6.5. Attorneys' Fees. In the event that litigation is brought by any party in
connection with this Agreement, the prevailing party shall be entitled to recover from the
opposing party all costs and expenses, including reasonable attorneys' fees, incurred by the
prevailing party in the exercise of any of its rights or remedies hereunder or the enforcement
of any of the terms, conditions, or provisions hereof. The costs, salary and expenses of the
City Attorney and members of his office in enforcing this contract on behalf of the City shall
be considered as"attorneys' fees" for the purposes of this paragraph.
6.6. Governing. This Agreement shall be governed by and construed under
the laws of the State of California without giving effect to that body of laws pertaining to
conflict of laws. In the event of any legal action to enforce or interpret this Agreement, the
parties hereto agree that the sole and exclusive venue shall be the Superior Court for the State
of California located in San Bernardino County, California.

6.7. Assignment. Consultant shall not voluntarily or by operation of law assign,
transfer, sublet or encumber all or any part of Consultant's interest in this Agreement without
City's prior written consent. Any attempted assignment, transfer, subletting or encumbrance
shall be void and shall constitute a breach of this Agreement and cause for termination of this
Agreement. Regardless of City's consent, no subletting or assignment shall release
Consultant of Consultant's obligation to perform all other obligations to be performed by
Consultant hereunder for the term of this Agreement.
6.8 Indemnification and Hold Harmless. Consultant shall protect, defend,
indemnify and hold harmless City and its elected and appointed officials, officers, and
employees from any and all claims, liabilities, expenses, including attorney fees, damage to
property or injuries to or death of any person or persons or damages of any nature including,
but not by way of limitation, all civil claims or workers' compensation claims, arising out of
or in any way connected with the intentional or negligent acts, errors or omissions of
Consultant, its employees, agents or subcontractors in the performance of this Agreement.
6.9. Independent Contractor. Consultant is and shall be acting at all times as an
independent Contractor and not as an employee of City. Consultant shall secure, at its
expense, and be responsible for any and all payment of Income Tax, Social Security, State
Disability Insurance Compensation, Unemployment Compensation, and other payroll
deductions for Consultant and its officers, agents, and employees, and all business licenses, if
any are required, in connection with the services to be performed hereunder.
6.10 Ownership of Documents. All findings, reports, documents, information and
data including, but not limited to, computer tapes or discs, files and tapes furnished or
prepared by Consultant or any of its subcontractors in the course of performance of this
Agreement, shall be and remain the sole property of City. Consultant agrees that any such
documents or information shall not be made available to any individual or organization
without the prior consent of City. Any use of such documents for other projects not
contemplated by this Agreement, and any use of incomplete documents, shall be at the sole
risk of City and without liability or legal exposure to Consultant. City shall indemnify and
hold harmless Consultant from all claims, damages, losses, and expenses, including
attorneys' fees, arising out of or resulting from City's use of such documents for other
projects not contemplated by this Agreement or use of incomplete documents furnished by
Consultant. Consultant shall deliver to City any findings, reports, documents, information,
data, in any form, including but not limited to, computer tapes, discs, files audio tapes or any
other Project related items as requested by City or its authorized representative, at no
additional cost to the City.
6.11 Public Records Act Disclosure. Consultant has been advised and is aware that
all reports, documents, information and data including, but not limited to, computer tapes,
discs or files furnished or prepared by Consultant, or any of its subcontractors, and provided
to City may be subject to public disclosure as required by the California Public Records Act
(California Government Code Section 6250 et. seq.). Exceptions to public disclosure may be
those documents or information that qualify as trade secrets, as that term is defined in the
California Government Code Section 6254.7, and of which Consultant informs City of such

trade secret. The City will endeavor to maintain as confidential all information obtained by it
that is designated as a trade secret. The City shall not, in any way, be liable or responsible for
the disclosure of any trade secret including, without limitation, those records so marked if
disclosure is deemed to be required by law or by order of the Court.
6.12. Responsibility for Errors. Consultant shall be responsible for its work and
results under this Agreement. Consultant, when requested, shall furnish clarification and/or
explanation as may be required by the City's representative, regarding any services rendered
under this Agreement at no additional cost to City. In the event that an error or omission
attributable to Consultant occurs, then Consultant shall, at no cost to City, provide all
necessary design drawings, estimates and other professional of contracting services necessary
to rectify and correct the matter to the sole satisfaction of City and to participate in any
meeting required with regard to the correction.
6.13. Prohibited Employment. Consultant will not employ any regular employee of
City while this Agreement is in effect.
6.14. Order of Precedence. In the event of an inconsistency or conflict in this
Agreement and any of the attached Exhibits or Attachments, the terms set forth in this
Agreement shall prevail.
6.15. Costs. Each party shall bear its own costs and fees incurred in the preparation
and negotiation of this Agreement and in the performance of its obligations hereunder except
as expressly provided herein.
6.16. No Third Party Beneficiary Rights. This Agreement is entered into for the
sole benefit of City and Consultant and no other parties are intended to be direct or incidental
beneficiaries of this Agreement and no third party shall have any right in, under or to this
Agreement.
6.17. Headings. Paragraphs and subparagraph headings contained in this
Agreement are included solely for convenience and are not intended to modify, explain or to
be a full or accurate description of the content thereof and shall not in any way affect the
meaning or interpretation of this Agreement.
6.18. Construction. The parties have participated jointly in the negotiation and
drafting of this Agreement. In the event an ambiguity or question of intent or interpretation
arises with respect to this Agreement, this Agreement shall be construed as if drafted jointly
by the parties and in accordance with its fair meaning. There shall be no presumption or
burden of proof favoring or disfavoring any party by virtue of the authorship of any of the
provisions of this Agreement.
6.19 Amendments. Only a writing executed by the parties hereto or their respective
successors and assigns may amend this Agreement.
6.20. Waiver. The delay or failure of either party at any time to require
performance or compliance by the other of any of its obligations or agreements shall in no

way be deemed a waiver of those rights to require such performance or compliance. No
waiver of any provision of this Agreement shall be effective unless in writing and signed by a
duly authorized representative of the party against whom enforcement of a waiver is sought.
The waiver of any right or remedy with respect to any occurrence or event shall not be
deemed a waiver of any right or remedy with respect to any other occurrence or event, nor
shall any waiver constitute a continuing waiver.
6.21. Severability. If any provision of this Agreement is determined by a court of
competent jurisdiction to be unenforceable in any circumstance, such determination shall not
affect the validity or enforceability of the remaining terms and provisions hereof or of the
offending provision in any other circumstance.
6.22. Counterparts. This Agreement may be executed in one or more counterparts,
each of which shall be deemed an original. All counterparts shall be construed together and
shall constitute one agreement.
6.23. Corporate Authority. The persons executing this Agreement on behalf of the
parties hereto warrant that they are duly authorized to execute this Agreement on behalf of
said parties and that by doing so, the parties hereto are formally bound to the provisions of
this Agreement.
6.24 Damages. The Parties agree to waive any rights to incidental or consequential
and punitive damages arising out of performance under this Agreement whether in torts or in
contracts or in law or in equity.

A. PROJECT DESCRIPTION
Proposed and Desired Upgrade and Requirements
Concerning the City's Fortieth Street Widening Project,the stated intent is to provide the widening
of Fortieth Street from Johnson Street to Electric Avenue from two lanes to four,upgrade of existing
traffic signal at Fortieth Street and Electric Avenue,and the reconfiguring of that intersection. The
proposed improvement of widening of Fortieth Street to four lanes in this reach will complete the
last link to arterial standards from Kendall Avenue to Valencia Avenue. Applicable City Standard
for this project,that of a major highway, indicates a right-of-way of 100 feet with 72 feet curb-to-
curb.It has,however,been indicated that the City is willing to narrow the widening if it can be done
without compromising pedestrian and vehicle safety to reduce right-of-way take requirements.No
bike lanes are proposed,however.
Expansion of the roadway to four lanes in this stretch will require widening of the pavement, of
course, construction of curb and gutter, significant modifications or removal of some property-
owner-constructed facilities, possibly including structure(s), replacement of driveway approaches
and portions of driveways at some locations, and relocation of utility facilities. Particular utility
impact will be on the north side of Fortieth Street,just to the west of Electric Avenue in which there
are observed to be significant overhead utility lines as well as underground facilities.
Homeowner/property owner facilities in this area are very close to the existing pavement including
fencing, significant trees, and structures. However, a narrower width of right-of-way take could
obviate some of the impact. In any case, significant coordination and communication with the
property owners and residents will be valuable.
Additionally,due to the significant facilities involved and utility relocations,phasing of the project
may be required to allow for initial demolition and relocation before initiating actual widening
construction.
The second significant aspect of the project is the reconfiguring and signal modifications for the
intersection of Fortieth Street at Electric Avenue. Stated objective is to provide four through-lanes
at Fortieth Street and left-turn pockets on all four legs at the intersection.Existing signals will need
to be relocated/replaced.Construction is to include interconnection and remote access capability,and
accommodation made of other existing facilities such as the existing catch basin at the northeast
corner, a hydrant at the northwest corner, and curb ramp on the southeast.

Also to be completed is installation of streetlights on City standards where not currently in place.
Several are already in place in the improved reaches, but two are mounted on SCE power poles.
Coordination with SCE is required to verify feed point/location for signals and streetlights.
Required scope addition, by addendum, is an evaluation of the existing pavement and a proposed
repair/rehabilitation strategies.
Existing Conditions
Fortieth Street from Johnson Street to Electric Avenue is of variable width improved to X36 feet,
Lorraine Drive to the west end of the church parcel and from Newmark to Johnson Street.No such
improvements exist on the south side,however.
The City right-of-way for Fortieth Street in this reach is also variable, constrained to 20 feet each
side of centerline from Electric Avenue westerly to Newmark and 40 to 50 feet each side from
Newmark to Johnson Street. Obviously,placement of the City's major highway section throughout
would require extensive right-of-way acquisition and,therefore, significant impacts upon property
owner improvements or culture.
Summarizing existing and possible future right-of-way is that shown on Figure 1 on the following
page. Evident are the existing right-of-way incursions into current or desired street improvement
prizm.
Underground and overhead utility lines are parallel with and in close proximity to the north edge of
paving just west of Electric Avenue. There are also several instances of overhead utility crossings
of Fortieth Street. Relocation of the facilities will be required in some manner to accommodate the
proposed widening.
Drainage pattern at the project site is from west to east,congregating at the intersection with Electric
Drive.Additional runoff reaching the intersection,from the north,is captured by the two catch basins
on or near the northeast corner.Perhaps much ofthe drainage reaching the street from the west flows
southerly on Electric Avenue. The two catch basins on the northeast corner appear likely to deliver
to a storm drain easterly in Fortieth Street.
Other utilities noted in the street include sewer as well as water pipelines which will be little
impacted aside from grade adjustments of manhole and valve covers.However,hydrants in several
instances would need to be relocated and water service/meters and other utility boxes are also likely
to require relocation.
It is further observed that all hard-wire-type utilities are underground east of Electric Avenue,which
would be possibly be an objective to the west for this project,also.
A single bus stop exists in the reach, on the south side of Fortieth Street between Newmark and
Severance.It is serviced by Omnitrans Route No. 5,to and from south San Bernardino to Cal State
University.Coordination with Omnitrans will be needed during planning,design,and construction
phases for upgrade and possible bus pad.

Preliminary Conceptual Design
To aid and further demonstrate ERSC's understanding of the project and the scope of services
required for the City's Fortieth Street Widening Project, we have prepared a plan of prospective
development entitled"Fortieth Street Widening Preliminary Concept",Figure 2,which is contained
on the following page and prepared based on our field inspection and the concept lane configuration
prepared by the City several years ago and contained in the RFP.It provides a possible,though very
preliminary design concept to the project objective of four vehicle lanes for Fortieth Street.
Displayed are existing and proposed right-of-way and curb and gutter locations. It is believed that
this preliminary conceptual design could well be adopted as the Area of Potential Effect Plan
needed by the environmental subconsultant,Tom Dodson and Associates,to initiate their work.In
view of the very tight schedule the City has adopted for this aspect of the work,it is possibly of great
value,we believe, for that use.
The following is our understanding of project needs,description of existing conditions,and proposed
modifications to meet the City's objective of a four-lane street from Johnson Street to Electric
Avenue.
Johnson Street to Acre Lane
Existing right-of-way on the north side has variable width,20 feet,40 feet,and 44 feet,while on the
south side it is 20 feet and 30 feet. It is noted that there are no curb returns and no cross-gutter at
Johnson Street. Interestingly,existing curb and gutter on the north side is located at±36 feet.
It is proposed that additional right-of-way be obtained on the north side to 40 feet and on the south
side to 50 feet,and proposed curb and gutter be installed on the south side at 36 feet from centerline.
Additionally,curb returns would be installed on both sides of Johnson Street as well as a cross-gutter
and handicap ramps.
Proposed would be an 11-foot wide striped median with lane line striping at 11 feet each on the north
and south sides.The striping would be extended westerly to H Street to adjoin the existing l ane drop
and signage.
Also affected would be the existing AC berm on the south side west of Johnson Street,which would
removed.
It is noted that catch basins are installed on both the north and south sides of Fortieth Street west of
Johnson Street and will,therefore,intercept all street runoff from the west.
Acre Lane to Newmark Avenue
Curb,gutter, and sidewalk with returns are in place for the north side with existing right-of-way at
50 feet.

Proposed for the south side would be expansion of right-of-way from 20 feet to 50 feet with curb,
gutter, and returns at 36 feet with handicap ramps.
Striping would include striped median of 11-feet width and lane line striping at 11 feet,both on the
north and south sides.
Newmark Avenue to Electric Avenue
Concerning right-of-way,Assessor's map records show only 20 feet existing on both the north and
south sides,though it is noted that existing curb and gutter at the church frontage is at about 3 6 feet.
Also noted is the Omnitrans bus stop on the south side between Newmark Avenue and Severance
Avenue.
Proposed right-of-way on the north side would be at 41 feet while that on the south side would be
at 30 or 50 feet.
Proposed improvements include a north side curb at 36 feet matching existing,while on the south
side, it would at 36 feet narrowing to 25 feet on the easterly portion near Electric Avenue. Curb
returns and handicap ramps will be installed at Newmark Avenue, Severance Avenue,and Lorraine
Drive and also on Electric Avenue on the street corners where they don't exist currently. An
upgraded bus stop would be constructed on the south side with ADA access and bus pad in
accordance with Omnitrans Standards. Contractor will be required to maintain a safe stop zone for
passenger drop-off and pick-up throughout construction of the upgrade.
Eleven-foot median centerline, located at street centerline at Newmark will transition to 5.5 feet
north of street centerline at Electric Avenue to provide more widening room to the south. Striping
design/modifications will extend to Mountain View Avenue.
It is noted that even with the minimal street width developed for this preliminary concept,it may be
necessary to acquire one or more residential structures on the north side just to the west of Electric
Avenue.
Electric Avenue intersection will need to be reworked,taking out the existing westbound right-turn
lane,removing the island,and making signal modifications and striping,including the maintenance
of left turn lanes at all four legs and ADA curb ramps at three comers where none exist.
Also likely to be included in this area are new catch basins just to the west of Electric Avenue on
both north and south sides to intercept drainage from the west.Installation/replacement of streetlights
is also required in this reach.
Utility Relocations
Field review indicates conflicts with two types of utilities, overhead and buried hard-wire systems,
that is, electric, telephone, cable, and water facilities. Hard-wire facilities exist on the north side
adjacent to the pavement approximately 250 feet underground from Electric Avenue westerly and
then overhead. These facilities will need to be relocated for the proposed widening. Also,hydrant

relocations will be necessary in at least two locations,on the northeast corner of Electric Avenue and
Fortieth Street, and on the southeast corner of Fortieth Street and Severance Avenue.
Also included in the project is rehabilitation of the pavement.Well worn,it is particularly distressed
at the intersection of Fortieth Street and Electric Avenue. Proposed treatment method will be
determined by the geotechnical subconsultant,with removal and replacement likely in areas followed
by an overlay,with slurry seal a possibility in the less worn reaches.
Services and Expertise Required
Completion of project documents to facilitate bidding and construction of the widening of Fortieth
Street will require the following disciplines and expertise:
► Field survey, aerial photography, and mapping.
► Geotechnical investigation to determine street section,pipeline trench conditions,and
pavement rehabilitation options.
► Determination of environmental impacts and mitigation measures.
► Civil engineering for street widening design, hydrology and hydraulic review and
calculations,preparation ofright-of-way acquisition documents,signal modification,
and preparation of SWPPP and related documents.
► Utility research and potholing of underground utilities.
► Close and regular coordination with the City.
The foregoing is a synopsis of the anticipated services to be required for the project as a minimum.
C. SCOPE OF SER VICES
Survey, engineering, and environmental services to be conducted to complete the design of the
project will include as a minimum the following tasks:
1. Initial effort will be the scheduling and conduct of the kick-off meeting with City
staff. Agenda will include introduction of team members, and with other affected
agencies-utility companies/City departments and Omnitrans,other affected agency
representatives.Review will be made of project features and City objectives,review
of proposed tasks and schedule,utility impacts, and perhaps a site visit. A detailed
and thorough review is also proposed of the conceptual preliminary plan contained
herein with a larger scale version.This hopefully will largely define the project to be
designed.
Minutes of this and all subsequent scheduled meetings will be prepared specifying
subjects addressed,decisions made, and action items/responsibility.
Project Manager will consult with the City on a monthly frequency,and likely more
often,to maintain communication and coordinate inquiries,submittals,and meetings.
2. Obtain available record drawings from the City for all facilities.

3. Conduct topographic survey and mapping by aerial and field crews. Survey effort
will involve research of available survey records to establish control required,will
involve cross-sectioning at 25-foot intervals to 60 feet from centerline for
unimproved areas, extended to the east and west of the project limits, profiling of
driveways, and additional survey at areas for which aerial photography will not be
sufficient; for example,where the ground is not visible or items too small to detect
such as utility boxes and water meters. With this information, base sheets will be
prepared at a scale of V = 20' to provide better clarity for the congested areas of
street widening and necessary for the Fortieth Street and Electric Avenue intersection
reconfiguration and traffic signal design. Separate signal/intersection base sheet will
be prepared, also at a scale of 1" = 20'. Base sheets of the street plans will then be
used for streetlight design.
4. Prepare a first notification letter to the utility companies for City's signature and
mailing to obtain available record drawings.Once information is received,it will be
added to the base plans.
5. Subsequently, as found necessary, underground utilities found to be possibly
conflicting will be potholed and located by the survey crew.We have estimated that
up to five may be required, likely in and just west of the Fortieth Street/Electric
Avenue intersection.
6. Prepare a master right-of-way map of the project area for identifying areas of right-
of-way acquisition that may be required.
7. Update and refine the conceptual preliminary street widening design and plan of
proposed improvements,contained in this proposal,sufficient to identify impact upon
adjacent private properties and the intersection.Conceptual plan will be useful as the
project definition required by our environmental consultant, that is, the Area of
Potential Effect.
8. Prepare and complete all required environmental studies and environmental
documents required for clearance under the California Environmental Quality Act
(CEQA). As set forth in the City's RFP, it is anticipated that the environmental
document will be no higher than a Mitigated Negative Declaration. Prepared,then,
will be an Initial Study,necessary supporting studies and,after approval of the Initial
Study, preparation of Mitigation Monitoring Reporting Program (MMRP), and
Notice of Determination, for use by City staff and presentation to City Council for
adoption.
Detailed scope by Tom Dodson and Associates is contained in its entirety at
Appendix C.
Scope of services does not include preparation of a full Environmental Impact Report
(EIR).

9. Conduct of geotechnical field investigation and report for the project by Converse
Consultants.Efforts will include project set-up or preparation including obtaining
a No-Fee Permit from the City,field reconnaissance, and notification of Dig-Alert.
This will be followed by a field investigation and exploration borings to 20 feet to
ascertain asphalt thickness and aggregate base,if any,obtain subsurface information,
and undisturbed samples.Final phase will be laboratory testing of materials,followed
by engineering analysis and report preparation,presenting recommended pavement
structural section,and subgrade preparation. Also to be provided by Converse will
be evaluation of the existing pavement and repair/rehabilitation methods and traffic
signal poles foundation, and trench excavation and backfill recommendations.
Converse proposal is provided at Appendix D.
10. Prepare preliminary and then final hydrology and hydraulic calculations and report
for means of managing storm water runoff from the site. Analysis is proposed and
anticipated to result in an estimate of surface flow to the intersection of Fortieth
Street and Electric Avenue.ERSC will provide hydrology calculations for the areas
tributary to the project site and the existing storm drain system. To comply with the
City's request, our project team will develop a hydrology map delineating the
drainage boundaries and the tributary subareas draining to Fortieth Street. The
process will be initiated by reviewing available aerial photographs to determine
changes in development patterns, location of new development,and any changes in
drainage patterns.Upon completion of the hydrology map the drainage pattern will
be field verified and incorporated into existing drainage mapping. Utilizing this data
and other hydrology information available from City files,the hydrology calculation
will be provided.The hydrology calculations will be prepared in accordance with the
City of San Bernardino Guidelines for Storm Drain Design,Hydrology and Hydraulic
Calculations, and the San Bernardino County Flood Control District Hydrology
Manual.A hydrology analysis will be performed by developing a"Link Node"model
of the watershed as delineated on the hydrology base map, and determine 10-year,
50-and 100-year storm runoff at the critical location.
Street capacity calculations will also be prepared. Additional catch basins will be
constructed as needed to contain runoff within the limits of the proposed street right-
of-way and the top of curbs based on the above guidelines.
Hydraulic calculations for the proposed drainage improvements will be prepared and
will be incorporated on the plans.
ERSC will prepare a report outlining the outcome and recommendations of the
proposed analysis. The report will provide written dialogue on the intent of the
study, including methods, criteria, existing facilities' descriptions, hydrology
calculations,hydrology map,and preliminary hydraulic calculations for the proposed
drainage improvements.
11. Design and prepare plans for reconfiguration of the intersection of Fortieth Street and
Electric Avenue to provide for four through-lanes on Fortieth Street and left-turn

pockets on all four legs as well as modification of the existing signals.Resulting will
be design of a fully-actuated eight-phase traffic signal including spread spectrum
interconnect capability along Fortieth Street with remote access capability, and to
obtain remote access data link connection for the signal through the local
communication provider. Services will also include obtaining the feed point for the
traffic signal and streetlights from SCE.
12. Design of the street improvement/widening will likely require several iterations,
starting with refinement of the preliminary concept/APE plan, to effect the most
satisfactory outcome. ERSC is aware of this need and committed to assist the City
to achieve this outcome,recognizing,however,that not all"stakeholders"will ever
be satisfied. We have budgeted preparation of visual aids and attendance at one
meeting with property owners and City staff to present/discuss findings and
recommendations.
13. Upon adoption and finalization of the preliminary design and determination of
impact upon existing facilities,a stand-alone demolition plan will be prepared.This
plan will be suitable for issuance in a separate contract should that be necessary due
to extensive delay in relocation of utilities required and/or right-of-way acquisition.
14. Prepare plans, specifications, and quantity and cost estimates for the project street
improvement. Features included in the PS&E will include street widening, with
match-up/overlay paving, curb and gutter, sidewalk, driveway approaches and
driveway modifications,as needed,striping,marking,signage,drainage features,and
ADA ramps at intersections and driveway sidewalk wraparounds in compliance with
Americans with Disabilities Act (ADA). Also included in the documents will be
disposition/relocation ofprivately and City/publicly-owned features located near the
edge of paving, including irrigation, landscaping, wall/fencing features, and water
meters.Disposition design will be in accordance with City acquisition arrangements.
Street improvement plan will be prepared at a scale of 1" = 20' and will include
pavement rehabilitation,method as selected.

Plans,specifications,and estimates to be incorporated into the project documents will
be prepared by subconsultant TJW Engineering for traffic signal modifications with
striping and marking for the Fortieth Street/Electric Avenue intersection and for
streetlights to City standards. Detailed services proposal is contained at Appendix
E.
Submittals will be made with follow-up meetings at the preliminary stage,as well as
60, 95, and 100 percent completion stages. A field walk will be made of the project
site with 95 percent completion plans to verify that onsite conditions are properly
displayed.

A thorough QA/QC review of plans and specifications will be made by an
experienced engineer/designer to assure design integrity.
Upon completion and signature of the 100 percent complete documents, submittal
will be made in the format prescribed by the City, that is,hard copy and electronic
format.
15. Utility relocation coordination will include issuance of a second notice to utility
companies with plans indicating location and identification of facilities from record
data for their review and approval. A third notification will be made identifying
conflicts identified. With this, we would then proceed with relocation efforts
including preparation of notification, coordinated with the City for the necessary
authority. Engineering Resources of Southern California, Inc. (ERSC), then,
would coordinate and monitor the relocation effort in conjunction with the City staff.
16. Identify and prepare right-of-way acquisition documents for permanent and
temporary takes for the project. This effort will involve preparation of legal
descriptions and plats, based on available grant deeds only, for each parcel, signed
and stamped by an authorized RCE. Proposed effort and related fee assumes
preparation of X20 acquisition documents and temporary construction easements.
Documents will be provided to the City for their use in acquiring right-of-way.
See related comment No. 4 at Section I.
17. Prepare a Notice of Intent and Storm Water Pollution Prevention Plan (SWPPP),
preliminary and final, and obtain approval through the Regional Water Quality
Control Board. Effort will also include an Erosion Control Plan in the SWPPP.
Documents prepared will be uploaded to the State's SMARTS system,maintained
by the State Water Resources Control Board. SWPPP will incorporate NPDES
requirements into the project design. Effort will also include Risk Assessment and
Risk Level Determination.
It is observed also that the project may be eligible for a SWPPP waiver depending
upon season of construction as the total disturbed area will be less than five(5)acres.
18. Project schedule submitted with this proposal will be updated as specified within one
week of receiving the City's Notice to Proceed.Prospective changes would be those
resulting from the kick-off meeting. In addition, schedule would be updated and
submitted no less than once a month during the duration of the project.
19. Deliverables- Schedule
Deliveries of conceptual,preliminary,and final documents will be made to the City
for both the environmental phase and the engineering PS&E and right-of-way phases
of work in the number, format, and type as set forth in the City's request. As these

are numerous,they are not restated herein, though they are reflected to some extent
on the project schedule.
D. PROJECT TEAM PERSONNEL
Mr. John Egan, P.E., M.S., Principal Engineer in ERSC's San Bernardino office, who has more
than 50 years experience in municipal,street,storm drain,water and wastewater resource design and
construction management services is designated as Project Manager for the City's Fortieth Street
Widening Project. Mr. Egan has, over the past 25 years, overseen and directed design and
construction management services for over 100 street improvement/pavement rehabilitation projects
for various municipalities in the area including several significant projects for the City of San
Bernardino.
Key staff members and/or subconsultants assigned to assist Mr. Egan on various phases of the
project are identified on the Organization Chart on the following page. Resumes for key
ERSC staff members are contained at Appendix A and for subconsultants at Appendix B.
In addition to City staff and Mr.Egan,key ERSC members on the team will include Moe Ahmadi,
P.E., QSD,John Patterson;Isaac Gomez;Matt Peacock; and Robert Righetti,who will provide
quality assurance/quality control review for the project.
Mr.Egan is a Principal Engineer and Project Manager with ERSC-s San Bernardino office. He has
been selected for the project because of his extensive experience in facilities design including streets,
storm drain features,pavement rehabilitation,and right-of-way acquisition document preparation.
He will be the primary point of contact for the City of San Bernardino,and will have the authority
to commit and control the staff resources required to complete the project.Mr.Egan has extensive
experience in project management and coordination of complex projects, a number of which are
shown on the tabulation in Section F.Proj ects include roadways,site development,storm drains,and
water and wastewater projects.
Specifically relevant to the scope of services required for the Fortieth Street project are projects Mr.
Egan successfully managed for several local cities. Completed for the City of San Bernardino was
the Victoria Avenue Widening and Beautification Project,which included the reach from Highland
Avenue to the San Manuel Casino.Effort involved the coordination of five consultants,right-of-way
acquisition engineering and permitting from San Bernardino County Flood Control District, signal
upgrades at two intersections, and sound mitigation measures. A second project completed for the
City of San Bernardino under Mr. Egan's oversight was that for design for extension of Harriman
Place between Hospitality Lane and Tippecanoe Avenue, and the widening of Tippecanoe in

experience in project management and administration of capital projects for numerous cities in San
Bernardino, Riverside, and Orange Counties. He provides on-call plan check services,
constructability reviews, and design assistance for public works projects.
John Patterson,Senior Engineering Technician,will assist in development of alternative concepts
and preliminary and final design for the street widening,quantity and cost estimate preparation,and
preparation of right-of-way acquisition documents.Mr.Patterson,with over 40 years experience in
the design of a variety of public works projects, was the responsible designer for the projects
mentioned above for the City of San Bernardino,that is,the Victoria Avenue and Harriman Place.
In addition, he has been responsible for a number of street widening projects for the Cities of
Highland and Yucaipa, as well as the Agua Mansa Road Reconstruction for the City of Colton.
Completing the project team are six subconsultants fulfilling the various specialty needs of the
project.Firm names and responsible individual are indicated on the Organization Chart.ERSC has
teamed with all six subconsultants on project assignments in recent years.
Concerning availability of key ERSC staff, all will commit the time necessary to complete the
project in accordance with the schedule of completion.Mr.Egan can commit 25 to 30 percent of his
time,Mr.Ahmadi the same,while the balance of ERSC staff can commit from 40 to 80 percent of
their time, depending on need.
E. PROJECT SCHEDULE
Accompanying and on the following page is a detailed Gantt-type project schedule encompassing
all of the tasks required and contained in the detailed scope of services and the City's RFP. Schedule
contains two phases and is based on the Notice to Proceed from the City dated October 31, 2016.

approval by the City of the preliminary design and will be coincidental with preparation of the Initial
Study,Public Review Period,and City adoption of the IS/MND document.Allowance ofthree weeks
has been made for each City review of design submittals. Completion of PS&E preparation is then
seen to be in early August 2017. Utility relocation coordination would likely continue thereafter.

ERSC is now celebrating its 20" year in existence having been founded in 1996 with offices in
Hemet, San Bernardino, Irvine, and Indio. ERSC's focus is to provide a broad range of civil
engineering, planning, and construction management services to the public sector, cities, special
districts, and utilities. The foundation of the company is based on providing our clients with the
highest quality professional services in a efficient, expedient, and cost-effective manner.
ERSC now provides these services for a variety of public infrastructure projects encompassing site
design,street improvement/widening design and pavement rehabilitation,water/wastewater facilities,
and drainage among other capabilities. As indicated,principal point of contact for the project will
be Mr. John Egan, located in our San Bernardino office; support services may be drawn from our
Hemet office, as required, in order to meet the City's project needs. Each office is staffed by
professionals encompassing a broad range of expertise with special and extensive knowledge and
experience in municipal requirements,administration,design,and construction.Currently,the total
staff in the four offices is 21 personnel,including seven registered engineers.
Related Project Experience
Related experience of ERSC and project personnel in the local area is quite generous.Projects have
been completed of a similar nature for the City of San Bernardino,as well as Cities of Highland and
Colton. Completed for the City of San Bernardino was the design for widening and beautification
of Victoria Avenue from Highland Avenue to the San Manuel Casino entrance. Project
responsibilities involved street widening,traffic signals modification,environmental review,sound
measurement and mitigation measures,drainage,right-of-way engineering and permitting from San
Bernardino County Flood Control District.
An earlier project for Project Manager, Mr. Egan, involved the construction and extension of
Harriman Place to Tippecanoe Avenue,and widening of Tippecanoe Avenue as well as construction
of the intersection with Laurelwood Drive.
Numerous projects have also been completed by Mr. Egan and ERSC for the City of Highland in
recent years involving street widening,pavement rehabilitation,storm drain,sidewalk construction,
and miscellaneous repair projects. Descriptions for these as well as those for San Bernardino are

Past and Previous Experience with the City
ERSC is currently under contract with the City's Municipal Water Department for services involving
plan check,contract administration,and inspection for facilities in various areas of the City. Work
is completed on an on-call or as-needed basis and is expected to continue.
Previous work of a similar nature to that of the Fortieth Street project is that cited for the Victoria
Avenue project, above, and the older project in the south part of the City.
G STATEMENT OF LOCAL PREFERENCE ELIGIBILITY
ERSC applies for Local Preference Eligibility based on the office located in San Bernardino from
which the work will be managed and conducted. Location of the office is at 1820 Commercenter
Circle. There are nine employees stationed at this office, six of whom work in the City of San
Bernardino totally. The balance are assigned to work in the City of Highland.

1. It is suggested that the City schedule a meeting with property owners and residents
east end of the project to review with visual aids the proposed project impacts and
right-of-way needs.
2. Subconsultant Tom Dodson indicates that the City's schedule is very tight.It will be
necessary, he indicates, to immediately define a project footprint, that is, Area of
Potential Effect, within the first few days in order to process the Initial Study on
schedule. Hence, the proposed use of the Conceptual Preliminary Plan submitted
with this proposal.
3. Due to the proximity of proposed curb to the front of several of the structures,
existing street-side parking may be eliminated. This may result in the
opportunity/need to develop alternate parking area(s).While recognizing the possible
design and construction need, that effort is not included in the services proposed.
Research indicates that there are instances ofthe ownership of multiple parcels by the
same party which could expand the opportunity to provide alternative parking.
4. For right-of-way takes,it is often desirable to mark the proposed take for inspection

Environmental Systems Research Institute (ESRI), Redlands, California — Mr. Egan is
responsible for directing planning and design for the significant and aggressive campus expansion
being carried out by ESRI as it seeks to accommodate additional staffing. Projects include design
of new streets,planning for construction of a parking lot over an existing drainage channel,design
for replacement of water and sewer lines from a street to be vacated, and preparation of grading,
water quality management,and storm water pollution prevention plans for ESRI's several building
projects.
Victoria Avenue Beautification Project, San Bernardino, California—To help allay concerns of
neighbors,the City of San Bernardino has undertaken the beautification and improvement of Victoria
Avenue from Highland Avenue to entry to the San Manuel Tribal Casino, consisting of
approximately 4,000 linear feet. Mr. Egan heads up a multi-disciplinary team consisting of ERSC
and six subconsultants conducting the work of planning and design for the City of San Bernardino.
Initial phase of the work included analysis and derivation of alternatives, presentation at public
meetings, and derivation of resident preferences. This information,then,was utilized by planning
and environmental analyses for the development of recommendations to the City.
Mr. Egan oversaw preparation of Phase 1 and Phase 2 design and construction documents for the
project which has resulted in the construction of sound walls adjacent to residential neighborhoods,
a landscaped median extending the length of the project,preparation of documents for acquisition
of additional right-of-way from the County of San Bernardino's Patton Basin including coordination
with the Regional Water Quality Control Board, State Department of Fish and Game,and Corps of
Engineers concerning facilities on the Basin property. The work also included construction of three
new signals and modification of existing signal.
Earlier, Mr. Egan led a team to completion of geotechnical investigation, design, preparation of

ROFESSIONAL EXPERIENCE: Over the past 30 years Mr. Ahmadi has actively
participated in the preparation of numerous feasability studies, design reports, construction
plans, specifications and cost estimates for drainage and flood control facilities throughout
Southern California. Mr. Ahmadi is experienced with numerous computer programs including
AutoCAD 2015, CiviICAD Hydrology programs, Water Surface Profile Gradient (WSPG), and
HEC-RAS flood plain analysis software. Mr. Ahmadi is also experienced in preparation of Stork
Water Prevention Plan (SWPPP) as required by the NPDES Industrial General Permit and the
Construction General Permit (CGP), which identify BMPs used to reduce or eliminate potential
pollutant discharges in storm water runoff. The plans have been prepared for various residential,
commercial, and industrial projects in the Counties of Riverside, San Bernardino,and Orange. As
part of the requirements of 2009 CGP,Mr. Ahmadi has provided SWPPP services to address new
requirements. This work included Data Submitter services, conducting the risk assessment; an
evaluation of a project's sediment risk and receiving water risk, and then determining the overall
Risk Level for traditional projects, or LUP Type for linear utility projects,and assisting clients to
register and submit applications in the SMARTS System to obtain the applicable WDID numbers
from the SWQCB prior to construction.
His recent experience relevant to planning and design of drainage and flood control facilities
utilizing the above software programs includes the following significant assignments:
SAN JACINTo AREA MASTER DRAINAGE PLAN LINE 11E-2" - Mr. Ahmadi served as Managing
Engineer to prepare construction plans for MDP Lines E-2 and E-2A in the City of San Jacinto and
Hemet. The project reach for MDP Line E-2 is over 7100 feet along State Street between Menlo
Avenue and MDP Line E and over 250 feet for MDP Line E-2A along Esplanade Avenue.The size
of the storm drain facilities are from 36-inch to 72-inch diameter. The scope of work included
hydrology analysis to determine the 10-and 100-year storm runoff within the MDP facilities
watershed.using CivilDesign software.The Hydraulic calculations for the proposed MDP facilities
was performed utilizing Water Surface Profile Gradient (WSPG) program, latest version by
CivilDesign.
Currently,the construction plans are at 60 percent complete level The plans include a series of catch
basins and connector pipes to intercept the surface runoff and to minimize flooding at the along the
project reach. The catch basin location were determined in coordination with both City of San
Jacinto and Hemet staff. The post design and construction services are also included assisting the
City with the construction management of this project.
SAN JACINTo AREA MASTER DRAINAGE PLAN LINE "H" - Managing Engineer to prepare a
feasibility study to evaluate alternative al ignments for MDP Line H,H-2 and H-3 per the current City
of San Jacinto MDP . The scope of work also included preparation of construction plans for the
most cost effective alignment of the above facilities.The project included evaluation of the existing
drainage facilities at the intersection of Ramona Expressway and State Street;to mitigate drainage
deficiencies as required. It also includes Rational Method Hydrology using CivilDesign software
to determine the 10- and 100-year storm runoff.The Hydraulic calculations for the proposed MDP
facilities was performed utilizing Water Surface Profile Gradient(WSPG)program, latest version
by CivilDesign.The design of these MDP facilities considered safe conveyance ofthe concentrated

flows from the above intersection to the existing double 6-foot by 3.5-foot Reinforced Concrete Box
(RCB)north of West Community College Drive at State Street, in San Jacinto, California.
The construction plans were developed to include a series of catch basins and connector pipes to
intercept the surface runoff and to minimize flooding at the intersection of Ramona Expressway and
State Street,an 8-foot wide by 4-foot high RCB across Ramona Expressway,a 36-inch RCP(MDP
Line H-3)storm drain system along State Street,east of the intersection and a 48-inch RCP(MDP
Line H-2)in State Street to convey flow to the proposed RCB at this intersection. The post design
and construction services also included assisting the City with the construction management for
completion of a successful project.
MONTGOMERY CHANNEL REPAIRS,CITY OF BANNING—Mr.Ahmadi served as project Manager
for preparation of plans for reconstruction of Montgomery Channel at Wilson Street for the
Riverside County Flood Control and Water Conservation District (RCFC & WCD). The work
included modification to the main channel, the existing junction structure, hydraulic analysis,
construction details , cost estimates and specifications. The plans were prepared per the RCFC &
WCD guidelines and the drafting standard.
PEER REVIEW OF FLOOD PLAIN ANALYSIS FOR WHITEWATER RIVER FOR THE MOUNTAIN VIEW
IV PROJECT FOR INSTALLATION OF WIND TURBINES AND TRANSFORMERS, CITY OF PALM
SPRINGS—As the City of Patin Springs consultant,reviewed the drainage study report,flood plain
and scour depth analysis for the Whitewater river for installation wind turbines and transformers for
the Mountain View IV project. The project was within Zone A of Special Flood Hazard Area
(SFHA).The base flood elevation of determined,the limits of 100 flood was delineated the scouring
depth was determined to be considered in structural design of the foundations accordingly.
PEER REVIEW OF HYDROLOGY STUDY AND FLOOD PLAIN ANALYSIS FOR GARNET WASH FOR
TENTATIVE PARCEL MAP 36073 AND ROSEVILLE SOLAR PROJECT, CITY OF PALM SPRINGS —
As the City of Palm Springs consultant, reviewed the drainage study report, flood plain and scour
depth analysis for the Garnet Wash within West Desert Hot Springs Master Drainage Plan. The
analysis included the crossing under I-10 freeway to determine the backwater affect on the limits of
flood plain for installation solar facilities for Roseville Solar Project. The base flood elevation of
determined,the limits of 100 flood was delineated on the grading plan to avoid grading within the
Garnet Wash flooding area.
CSPD LINE 3-5,AND MASTER DRAINAGE PLAN(MDP)UPDATE,CITY OF COLTON—Managing
Engineer for a Master Plan Update and the design of a regional drainage facility to convey 1,000 efs
from a 2,045-acre area. The MDP included hydrology and hydraulic analysis,preliminary design
and sizing of drainage facilities,cost estimates and a project report for the 3-5 and 3-8 watersheds
within the City of Colton. Storm Drain Project 3-5 required the installation of 11,500 feet of 108-
and 120-inch reinforced concrete pipe from Valley Boulevard south to the Santa Ana River,
including the installation of approximately 1,700 feet of 108-inch RCP by boring and jacking
methods at multiple locations. The final design of the facilities included the preparation of

determinations for the SBCLAFCO. This has included review of all
reorganizations,annexation, detachments,incorporations and other actions
by the Commission. Over 400 CEQA determinations have been overseen
by Tom Dodson on behalf of and in coordination with the SBCLAFCO

Burlington Northern Santa Fe Projects
Over the past fifteen years Mr. Dodson has conducted the environmental assessments and provided
regulatory consulting support for more than a dozen projects with BNSF. This includes projects in San
Diego, Orange,Los Angeles, and San Bernardino Counties and the Central Valley of California. Projects
have ranged from track improvements to new facilities for maintenance of train equipment,two extensive

Inland Valley Development Agency(IVDA)/San Bernardino International Airport Authority(SBIAA)
(1992-Present)
Environmental manager for the IVDA and SBIAA in their role as the redevelopment and reuse agency for
Norton Air Force Base located in San Bernardino, California. Assisted the Air Force in completing its'
first and only air conformity determination for reuse of a closing military base. The analysis was used in
presentations to the federal Environmental Protection Agency (EPA) to revise the Conformity
Regulations to exclude transfers of military bases from conformity findings. TDA has been involved in
every facet of base closure,working closely with the Air Force Base Closure Agency(AFBCA)at Norton
and in Washington D.C. to complete the Final EIS and issue the Record of Decision. This support effort
includes endangered species management programs at the former Base and consultations with the State
and Federal government under endangered species laws.

Tom Dodson
Inland Empire Utilities Agency(IEUA, 1999-Present)
As environmental consultant to the IEUA, TDA prepared the Program EIR for the Optimum Basin
Management Program which evaluated the whole program that is proposed to be implemented to remove
groundwater contamination from the Chino Basin. This EIR was prepared to meet court mandated
deadlines and was certified in a timely manner by the IEUA. TDA has continued consulting with IEUA
and recently completed a Program EIR for IEUA Facilities Masters Plans,which examined the long-term
implementation of wastewater, recycled water and organic waste management programs. TDA is
currently working with ASL/Tetra Tech to implement a major expansion in the organic composting
operations currently being carried out by IEUA as part of the Chino Basin groundwater aquifer
remediation. Site selection, due diligence, and CEQA documentation are part of the tasks that TDA has
assisted with on this project.
Expert Witness Support for Litigation
Beginning in 1988, Tom Dodson began providing expert witness testimony. The first case involving
expert witness testimony was an inverse condemnation suit that went before the federal court regarding a
Corps of Engineer rejection of a permit in the City of Big Bear Lake. Beginning with extensive efforts in
front of the Riverside Superior Court,Mr.Dodson provided expert witness testimony and guidance to the
court for land use development within the City of Indian Wells. Mr.Dodson was qualified as a"land use
expert"with the Fourth District Court of Appeals. For more than one year,Mr. Dodson was successful in
serving as the land use expert for development within the City of Indian Wells. In 1993, Mr. Dodson
testified in a case of inverse condemnation against a property in the City of Indian Wells where the City
assigned a residential designation to a parcel of land that had previously been designated for commercial
uses. The resolution of the case resulted in the property being valued for commercial,not residential uses,
partially based on Mr.Dodson's testimony as a land use expert.
In 1996, Mr. Dodson and other TDA staff provided expert witness testimony regarding"wetland" issues
in relation to a takings case against the City of Lake Elsinore. This court effort was the culmination of
several years of effort that resulted in TDA's client prevailing against the City regarding taking of
property under a pretense that the property was wetland. Most recently, Mr. Dodson is providing expert
witness testimony for the City of Redlands regarding endangered species issues in relation to a takings
case. In 1996,Mr. Dodson testified as an expert regarding the desert tortoise, habitat,regulatory process
to obtain incidental take permits and appropriate mitigation before the San Bernardino Superior Court.

Served as the civilian Environmental Protection Officer for the Naval Weapons Center (now the Naval
Air Weapons Station), China Lake, California, for nine years. This was a GS-13 supervisory position
with responsibility for managing the total environmental program for a 1700 square mile (1.1 million
acres)naval research laboratory and test facility located in the Upper Mojave Desert. Maintained a secret

security clearance at China Lake and was cleared for certain color coded projects that required
environmental review. Security clearance not currently in place, but no events have transpired in the
intervening eight plus years that would prevent it from being reissued if required.
Major accomplishments and responsibilities included:
a. Management of a staff of ten with responsibility for compliance with all federal, state and local
environmental laws and regulations. Preparation and development of all environmental
documentation, initial studies, comprehensive environmental impact statements, and compliance
strategies.
b. Represented the Center before decision-making bodies, including the state legislature and county

plan contested by the Fund for Animals.

citywide fiber optic communications backbone supporting CCTV, CMS,

design both the temporary and future ITS communications system for
the Capital Beltway Project outside of Washington D.C. linking field

widening of Fortieth Street from Johnson Street to Electric Avenue
I deeply appreciate the opportunity that ERSC has afforded Tom Dodson &
Associates (TDA) to provide assistance in supporting compliance with the
California Environmental Quality Act (CEQA) for the proposed widening of
Fortieth Street from Johnson Street to Electric Avenue. Based on our
discussions, the City has concluded that an environmental determination
needs to be prepared in order to comply with CEQA for this project. To
complete the environmental document and determination for this project in
a timely manner, TDA proposes to implement the following scope of work.
I. SCOPE OF WORK
Task 1: Prepare the Project Description
Immediately upon delivery of the 30% design plans, TDA will confer with
ERSC and City Staff to review all of the information developed to date. Once
a good understanding the project exists, TDA will prepare a project
description, focusing on the project's construction, design and operation.
TDA will prepare the project description with sufficient detail that it can be
used to identify all physical changes to the environment that can result from
implementing the proposed project. This is a critical step in the process of
preparing a CEQA document because it establishes the framework for
forecasting the potential adverse environmental impacts that can result from
implementing the project. The project description will identify all proposed
construction activities and future operational characteristics of the project
that will be implemented. A draft of the project description will be provided
to your office and the City for review and comment and it will then be
finalized by TDA upon receipt of comments.
I anticipate that a total of 10 hours will be required to complete the project
description. The deliverable product from this task will be a completed
project description which will be used to prepare the impact analysis.
Task 2: Compile the Environmental Document for Review
Working with the City TDA will prepare the appropriate environmental
document for the project. Based on review of the information provided to
date, I expect that the project should be considered for Mitigated Negative
Declaration (MND) as the appropriate CEQA environmental determination. I
believe that the project needs to be evaluated for air quality/greenhouse
gases, noise (shift in noise closer to sensitive receptors) and possible
historical resource values if any structures must be acquired and
demolished. TDA will confer with the City to determine whether a traffic
study or memo will be needed for this project. Because this is a street
expansion to be consistent with the City's General Plan, we do not see it as
generating substantial traffic. Thus, for the purposes of this proposal, I have
not included a traffic study/memo fee. I will also oversee these technical
studies.
Once the Initial Study (IS) document is completed, it will be possible to
verify whether a MND is the appropriate environmental determination. As
noted above, for purposes of this proposal it is assumed that a MND will be
the appropriate CEQA environmental determination.
TDA will finalize the IS for the project in a timely manner (discussed below)
and submit a draft document for review by the City and ERSC prior to
distribution. TDA will utilize the data from the project description and the
regional data base to finalize the IS that will describe all potential impacts
from implementing the proposed project. The impact forecast will be site
specific, fully substantiated and mitigation measures will be identified, as
appropriate, for the environmental issues. The completed draft IS/MND is
the deliverable for this project. The City, of course, makes the final
determination regarding the content of the IS/MND for publication and
distribution for review and comment.
Task 3: Print and Distribute the IS/MND
TDA will meet with the City to collect all comments on the draft IS/MND.
These comments will be responded to and a proposed MND and
substantiating IS for public distribution will be compiled and printed for
distribution. TDA will supply the City with up to 30 copies of the document
(electronic) for distribution. I do not believe it will be necessary to distribute
to the State Clearinghouse since there are no State responsible or trustee
agencies. If more copies are required, they will be delivered to the City
based on actual publication costs. At the end of this task, the proposed
IS/MND will be distributed for 20-day public review and comment period. .
Task 4: Prepare Responses to Comments and the Final IS/MND
Following completion of the public review period (note that TDA will meet
with the you or the City upon request to discuss any comment letter that
arrives before the end of the review period), TDA will meet with the City and
applicant to review proposed responses to all comments received on the
document. Once general agreement on the content of responses is obtained,
they will be prepared and a draft set of responses to comments will be
delivered to the City for final review and comment. We anticipate allocating
20 hours of effort to this task, including one meeting with the City. The
responses to comments will be completed within two weeks of the close of
the public comment period, barring the need to develop original data. If
major new issues are raised that were previously not addressed in the
IS/MND and that the City concludes must be addressed in the final package,
TDA will perform additional analyses based on mutual agreement on the
scope of work and a modified fee.
The end product of this effort will be a final IS/MND decision-making
package available for adoption by the City. Copies of the final package will
be provided to the City and copies will be provided to any party commenting
on the proposed MND. TDA will assist with the distribution of these
documents. These responses to comments will be prepared as a combined
document be for distribution.
II. SCHEDULE
TDA will meet the City's schedule assuming that it is realistic. The delivery
of the Initial Study to the City for internal review will require about 45-60
days after the 30% engineering drawings are completed. TDA will need the
30% engineered plans for review. Following release of the document comes
the 20 day public review and two week turnaround on responses to
comments. Assuming the 30% plans are available in October, this would
place the approval of the project before the City decision-makers in late
December 2016 or early January 2017. This is my best guess regarding
schedule based on the information available at this time.
As a cautionary note, if other factors beyond TDA's control dictate delays in
the schedule, TDA will make adjustments in accordance with directions from
the City. I have arranged for adequate TDA resources to be committed over
the next few months to meet the City's schedule objectives.
III, CONCLUSION
In closing, I want to again thank you for choosing Tom Dodson & Associates
to submit this proposal to prepare this environmental document. I look
forward to working with you and the City in compiling the appropriate

SITE/PROJECT DESCRIPTION
The project site is located along 40th Street and spans approximately 1,550 I.f. between
Johnson Street and North Electric Avenue in the City of San Bernardino, California. 40th
Street between North Electric Avenue and Johnson Street is primarily a two lane road
oriented east and west with one lane in each direction. The westbound lane transitions to
two lanes west of Newmark Avenue to Johnson Street. There are overhead power lines
on the north side of the street which hang over into the shoulder of the west bound lane.
A few overhead power lines run over 40th Street from the north power lines to businesses
located on the south side of the street. The eastbound lane does not have a curb or
shoulder. The street is surrounded by residential homes, unoccupied land, and
businesses.

We understand a catch basin will be installed just west of Electric Avenue connecting to a
storm drain in the intersection. The catch basin depth will be about 10 feet below existing
ground surface.
SCOPE OF SERVICES
Our scope of work will include the following tasks.
Task I: Project Set-up/Field Reconnaissance
As part of the project set-up, staff personnel from our office will conduct the following.
• Obtain a no fee permit from the City of San Bernardino to drill in the street.
• A field reconnaissance to verify site access and mark the boring locations.
• Map areas of pavement distress
• Notify Dig Alert at least 48 hours prior to drilling to clear the boring locations of any
conflict with existing underground utilities.
Task II: Field Investigation
Our field investigation will consist of drilling exploratory borings along the roadway
alignment. The purpose of the borings will be to:
• Measure existing asphalt concrete and aggregate base thickness (if any).
• Obtain subsurface information at the site.
• Obtain undisturbed and bulk samples of the various soil types for laboratory testing.
We plan to drill 5 borings, between 5 and 20 feet below existing ground surface.The deeper
borings will be placed near the proposed traffic signal and at the storm drain facility. Soils
will be continuously logged and classified by the geologist/engineer in the field by visual
examination in accordance with the Unified Soil Classification System.
Relatively undisturbed ring samples will be collected at 2 and 5 feet bgs and every 5 feet
thereafter in the 20 feet deep boring. The relatively undisturbed rings samples will be
obtained using a Modified California Sampler (2.4 inches inside diameter and 3.0 inches
outside diameter) lined with thin-walled sample rings. The sampler will be driven into the
bottom of the borehole with successive drops of a 140-pound hammer falling 30 inches.
The number of successive drops of the driving weight ("blows") required for one foot of
penetration will be shown on the boring summary sheet in the "blow/6-inch" column. The
soil will be retained in brass rings (2.4 inches in diameter and one inch in height). The
central portion of the sample will be retained and carefully sealed in waterproof plastic
containers for shipment to the laboratory. Bulk samples of representative soil types will be
collected in plastic bags. Groundwater levels, where encountered in the borings, will be
recorded.

Task III: Laboratory Testing
Soil samples obtained in the subsurface exploration will be transported to our
geotechnical laboratory. Geotechnical testing may include but not be limited to the
following.
• In-place moisture and density
• R-value.
• Soils corrosivity.
• Sieve analysis.
• Laboratory maximum density.
• Direct shear.
Task IV: Engineering Analysis and Report Preparation:
Data obtained from the field investigation and laboratory tests will be evaluated. Engineering
analyses will be performed to present pavement structural sections and subgrade
preparation recommendations. The report will include the following items.
• Description of the project including existing roadway conditions.
• A description of the field procedures used in the investigation.
• A discussion of the materials encountered within the borings and their engineering
properties.
• A plan indicating the location of the borings.
• Laboratory tests results including soils corrosivity.
• Table listing location and existing pavement thicknesses.
• Map of pavement distress.
• Evaluation of the existing pavement and repair/rehabilitation methods consisting of
removal and replacement (R &R) followed by 0.1-foot grind and overlay or slurry
seal coating.
• Preparation of street subgrade recommendations.
• Compaction requirements.
• Traffic signal pole foundation design recommendation (if required).
• Site soils excavatablity.
• Temporary slope stability of catch basin and storm drain trench wall.
• Trench backfill recommendation.
PROJECT SCHEDULE/DELIVERABLES
Site exploration can begin within 5 days following the receipt of your written notification
to proceed, weather and site conditions permitting. About one day will be required to
perform the exploratory fieldwork.

PROPOSAL: 40th Street and Electric Avenue Traffic Signal and Street Lighting Design Plans in
the City of San Bernardino
Dear Mr. Egan:
TJW Engineering, Inc. (TJW) is pleased to submit this proposed agreement to ENGINEERING
RESOURCES (ERSC) to provide traffic signal, street lighting and signing & striping design plans
for the 40th Street widening project in the City of San Bernardino. The project is associated with
San Bernardino's RFP SSO4-014 which includes the area on 40th Street between Johnson Street
to Electric Avenue, a distance of approximately 1,600 feet.
TJW has been asked to provide the following plan sets for the project:
Traffic Signal Modification Plan: TJW would prepare a traffic signal modification plan for the
intersection of 40th Street and Electric Avenue to accommodate the widening on the southwest
corner of the intersection. The traffic signal plan would include pull box and conduit system at
the controller cabinet to accommodate future traffic signal interconnect to neighboring
intersections on 40th Street.
Signing and Striping Plans: Restriping to accommodate the four lane section of 40th Street as
well as accommodate the traffic signal equipment would be needed. Signing and striping would
need to cover existing areas to remove the existing lane drop situation in the eastbound
direction on 401h Street. It is anticipated that the limits would extend from H Street to Mountain
View Avenue.
Street Lighting Plans: TJW would prepare street lighting plans on 40th Street between Johnson
Avenue and Electric Avenue affected by the street widening. Those locations where existing
street lights are attached to utility poles will be removed and replaced with standard street
lights.

TJW would coordinate with ERSC to prepare the design plans to match the street improvement
plans to be submitted as a package to the City for review and approval. The plans would be
designed per the standards set forth by the City of San Bernardino. The final plan set submitted
to the City for approval would be stamped and signed by a Professional Civil Engineer and/or
Traffic Engineer.

The following items define the scope of services for this proposal.

3. Prepare a concept striping plan in conjunction with ERSC's proposed street base from H
Street to Mountain View Avenue.
4. Prepare signing and striping design plans at a scale of 1"=40' once the concept plans have
been reviewed. It is anticipated that the limits will be from H Street to Mountain View
Avenue, and would include Electric Avenue. The plans would be designed to match the
street improvements and traffic signal plans and would be designed per the standards set
forth by the City of San Bernardino.
5. Prepare a traffic signal modification plan at a scale 1"=20' for the intersection of 40th
Street and Electric Avenue to accommodate the widening on the south side of 40th Street
between Johnson Avenue and Electric Avenue. These plans would be designed to match the
street improvements and would be designed per the standards set forth by the City of San
Bernardino.

6. Coordinate with SCE on the service point for the traffic signal service pedestal.
7. Prepare PS&E package for the traffic signal, signing & striping, and street lighting tasks. TJW
would coordinated with ERSC on the package.
8. Meet with ERSC as necessary to coordinate the project.
9. Submit the plans in concert with ERSC to the City of San Bernardino and respond to plan
check comments by the City. TJW would revise the plans and specifications as necessary.
10. Submit signed and sealed plans to the City for signature to complete the project.
SCHEDULE
TJW anticipates that the concept striping plans would be completed in approximately 10
working days in order to submit to the City of San Bernardino for review. TJW would be able to
immediately begin working on this project once the signed agreement and essential data are
received.
QUALIFICATIONS
TJW Engineering, Inc., located in Irvine, California, is a Small Business Enterprise (SBE) in the
State of California that specializes in traffic engineering and transportation planning. TJW
provides services to a variety of private and public sector clients including cities, counties,
architects, civil engineers, commercial and residential developers, school districts, community
associations, and other public agencies including Caltrans.
This project would be led by Mr. Thomas Wheat, PE, TE. Thomas Wheat has been involved in
the traffic engineering profession for over twenty years designing, managing, and developing
projects for both the public and private sectors. Coming to California in 2003, Mr. Wheat has
designed hundreds of traffic engineering design plans and transportation planning studies in
Southern California. His versatile experience includes leading in the design of traffic signal
plans, traffic signal systems, ITS, signing and striping plans, traffic control plans, and traffic
calming measures. Mr. Wheat has a Bachelor of Science degree in Civil Engineering from
Clemson University, South Carolina. Mr. Wheat is registered Professional Engineer in Civil
Engineering(C#69467)and a registered Traffic Engineer(TR#2565) in the State of California.

Contractors and Subcontractors on the project, due to the Design Professional's negligent acts,
errors, or omissions, such that the total aggregate liability of the Design Professional to all those
named shall not exceed $250,000.00 for this project.

The Client shall make no claim for professional negligence, either directly or by way of a cross
complaint against the Consultant unless the Client has first provided the Consultant with a
