David Alder Ashley Dial Daniel Malmuth Meeting called to order on Tuesday, August 5, 2014 at 3:38 p.m. in the Sixth Floor MIC Conference Room. Commissioners were given packets with copies of our City Ordinance MC -309 along with a copy of the Mural Ordinance from the City of Pomona regarding Public Art Mural and Mural Policy and Guidelines. NEW BUSINESS Introduction of speaker, Henry Empeno, Jr., Senior Deputy City Attorney Mr. Empeno discussed the roles and responsibilities of the Fine Arts Commissioners as stated in Chapter 2.30 of San Bernardino Municipal Code Ordinance MC -309 which was adopted in 1983 and amended in 1988 and 1991. He also discussed the Brown Act. Page 2 Fine Arts Commission Meeting 8/5/14 ELECTION OF OFFICERS A motion was made by Dorothy Garcia to nominate Lynette Kaplan as Chairman. She declined. A motion was made by Michael Segura to nominate Dorothy Garcia as Chairman. Motion was seconded by Lynette Kaplan. No objections. A motion was made by Tony Barber to nominate Michael Segura as Vice Chairman. Motion was seconded by Velia Marquez. No objections. FINE ARTS COMMISSION POLICIES Chairman Garcia discussed the policy regarding guest speakers. It was the recommendation of the commission that all guest speakers obtain permission to speak prior to the printing of the agenda, and guest speakers will need to speak on items relevant to the items on the Agenda. COMMITTEE MEETINGS A motion was made by Tony Barber and seconded by Michael Segura, to change the frequency of the FAC meetings to twice a month rather than once a month. It was also recommended that the time of the FAC meetings be changed to from 3:30 p.m. to 4:00 p.m. and that they be held on the 2" d and 4th Tuesdays of each month. This change will be in effect until such time as the FAC decides to implement another change. Upcoming meeting dates will be: August 26, 2014, September 9, 2014, September 23, 2014, October 14, 2014, and October 28, 2014. PROPOSED REVISION OF FINE ARTS ORDINANCE MC -309 A motion was made by Deborah Bunger and seconded by Tony Barber to recommend the proposed revisions of Ordinance Chapter 2.30, 2.30.020 be sent to the Legislative Review Committee: A. Change "fine arts" to "the visual and performing arts"; C. Add `By 2017" develop a master plan for the fine arts objectives and development in San Bernardino; D. Leave as it reads; E. Change language to "Promote other art related activities as resources are available." Page 3 Fine Arts Commission Meeting 8/5/14 CITY MURAL POLICY Chairman Garcia discussed the following items taken from the City of Pomona's Mural Ordinance: a. Establishment of regulations for the installation and application of Original Artwork Murals; b. Murals that are proposed as Public Art for private development as regulated by; c. Murals that are funded by in -lieu contributions and donations to the City's Public Art Fund; d. The murals shall remain in place without alterations for a minimum of five years from the date the mural is completed. The application shall certify in the permit application that the application agrees to maintain the mural in place for a minimum period of five years without alteration; e. The mural shall not be applied to the principal building facade facing a public street; Chairman Garcia recommended that the committee read and review the City of Pomona's mural ordinance and comment on any of the items above and also create a Mural Sub - Committee. Chairman Garcia made a motion to create a Sub - Committee on Mural Ordinance and nominated Michael Segura as Chairman of the Sub - Committee. This motion was seconded by Tony Barber. Sub- Committee members will be Michael Segura, Tony Barber, and Bronica Martindale. Members will meet and bring recommendations for a draft Mural Ordinance to the next meeting set for Tuesday, August 26, 2014. APPROVAL OF MINUTES A motion to approve the minutes of the June 3, 2014 meeting was made by Deborah Bunger, seconded by Lynette Kaplan. OLD BUSINESS It was recommended that Commissioners continue to gather information for the FAC database, i.e., arts organizations, artists, and venues. Gigi Hanna stated that a part-time employee in her office is creating a template in -house to create a booklet showing different areas in town that could be used for filming locations. Page 4 Fine Arts Commission Meeting 8/5/14 COMMISSIONER/STAFF ANNOUNCEMENTS Michael McKinney stated that on July 26, 2014 the Mayor received a letter from the San Bernardino Valley Concert Association regarding the purchase of the building at Eleventh and "B" Street, which is a designated historical building. It is owned by the San Bernardino Municipal Water Department and was once a Cultural Center. The property has a value of $338,000.00, however, the San Bernardino Valley Concert Association had indicated to the Water Department that they were unable to pay for that. The Water Department has entered into negotiations with the San Bernardino Valley Concert Association and they are willing to do a $1.00 per year lease for that building on a long term basis. So they are beginning to negotiate those issues at this moment. The caveats, there are active water wells on that property and those will have to be maintained. Michael McKinney announced that the Cultural Development Construction Fund balance as of June 30, 2014 was $439,384.00 verified and reported. However, as of 6/30/14 in account number #247 the Cultural Development Construction Fee unverified is $1,173,000. Chairman Garcia announced upcoming Arts Connection Conference on September 13, 2014 in Rancho Cucamonga. Lynette Kaplan announced she is going to be in a play held at Footlighters in Redlands. PUBLIC COMMENTS None Adjournment: Meeting adjourned August 5, 2014 at 5:30 p.m. The next Fine Arts Commission meeting will be on Tuesday, August 26, 2014, Sixth Floor, MIC Conference Room.
