June 1998 Allocation of $42,000 in Traffic Systems Fee Fund account for installation of pedestrian crossing a
Mt. Vernon Avenue and Johnson Street.
8/17/98 Approval of plans and authorization to advertise for bids per Plan No. 9828.
Recommended Motion:
Adopt Resolution and increase the budget in the Traffic Systems Fee Fund by $3,300; additional costs to be covered
by additional revenue which will be paid by San Bernardino Valley College and the City of Colton.

2 RESOLUTION OF THE MAYOR AND COMMON COUNCH, OF THE CITY OF
3 SAN BERNARDINO AWARDING A CONTRACT TO NEW WEST SIGNAL FOR
INSTALLATION OF PEDESTRIAN CROSSING ON MT. VERNON AVENUE AT
4 JOHNSON STREET PER PLAN NO. 9828.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
6 BERNARDINO AS FOLLOWS:
7 SECTION 1. NEW WEST SIGNAL is the lowest responsible bidder for:
8 INSTALLATION OF PEDESTRIAN CROSSING ON MT. VERNON AVENUE AT JOHNSON
9 STREET per Plan No. 9828. A contract is awarded accordingly to said bidder in a total amount
10 of$37,308.00 but such award shall be effective only upon being fully executed by both parties.

All other bids, therefore, are hereby rejected. The Mayor is hereby authorized to execute said
12
13 contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk
14 and incorporated herein by reference as fully as though set forth at length.
15 SECTION 2. This contract and any amendment or modifications thereto shall not take
16 effect or become operative until fully signed and executed by the parties and no party shall be
17
obligated hereunder until the time of such full execution. No oral agreements, amendments,
18
modifications or waivers are intended or authorized and shall not be implied from any act or
19
20 course of conduct of any party.
21 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
22 within sixty (60) days of the passage of this resolution.
