Description) N/A Finance: Council Notes: /D Agenda Item No. 3 / CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Public Hearing --- 10:00 AM and Resolution Authorization the Sale of a portion of City Property located at 1350 South"E" Street to the San Bernardino Valley Municipal Water District. BACKGROUND: On February 15, 1960,the City had purchased this property from the City of Riverside. The total size of land purchase was 3.55 acres or 154,638 square feet. On May 23, 1966 Resolution No 8184 was adopted authorizing a fifty year lease at $1.00 per year with the San Bernardino Valley Municipal Water District. Per the terms of lease,the Lessee was to construct an administrative building for the use of the Lessee and the public. July 28, 1969, Resolution No 9920 was adopted authorizing the execution of a second Amendment to the lease, which permitted the Lessee to construct a storage and workshop building. On December 19, 1994, Resolution No. 94-380 was adopted to sell approximately 135,000 square feet of the land with the structures to San Bernardino Valley Municipal Water District for$190,000 or$1.40 a square foot. A sale agreement was signed by both parties to sell any remaining land or buy back any excess land for $1.40 a square foot. Either party has first priority to purchase the other parties land if they wanted to sell or the first right of refusal to purchase the property. The City retained 13,500 square feet for a sewer lift station. The City fenced off this lift station leaving an excess of 2.25 feet on the West and 6 feet on the south of the property line fence, a total area of 965 square feet. The San Bernardino Valley Municipal Water District, would like to acquire this 965 square feet of land from the City of San Bernardino for expansion. The City water department has investigated this proposal to sell a portion of land adjacent to the department's pump station and determined no conflicts would exist. Based on the existing sale agreement between the City of San Bernardino and San Bernardino Municipal Valley Water District,the dollar amount per square foot would remain the same until December 31, 2019. The dollar amount worked out to be $1.40 a square foot for the land they purchased from the City. The price for the 965 square feet at $1.40 a square foot would be $1,350.00. Under the City's Municipal Code Section 2.65.050, City owned property could be sold to another Public Agency without competitive bidding. On September 8, 1998, Resolution No. 98-253 was adopted, establishing a fair market value of$1,350.00 for the subject property and setting a public hearing relative to the proposed sale. Vu IZ Z S s lU 1 N� S �6 Oi �1 Z - SS COFT 1 RESOLUTION NO: 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF 3 SAN BERNARDINO AUTHORIZING THE SALE OF A PORTION OF REAL 4 PROPERTY LOCATED AT 1350 SOUTH "E" STREET TO THE SAN BERNARDINO VALLEY MUNICIPAL WATER DISTRICT AND AUTHORIZING AND DIRECTING 5 THE EXECUTION OF A QUITCLAIM DEED. 6 WHEREAS, the City of San Bernardino is the owner of certain real property 7 approximately 965 square feet, located at 1350 South"E" Street; and 8 9 WHEREAS, as set forth in Resolution No.98-253, adopted on the 8`h day of September, 10 1998, the Mayor and Common Council of the City of San Bernardino declared the intention to 11 sell approximately 965 square feet of real property located at 1350 South "E" Street in said City, 12 more fully described therein; and 13 WHEREAS, in said Resolution No. 98-253, it was determined that the public interest and 14 15 convenience require the sale of said real property; and 16 WHEREAS, in said Resolution No. 98-253, the fair market value of said real property 17 was found and determined to be the amount of$1,350.00; and 18 WHEREAS, a public hearing was held on the 5`h day of October 1998, relative to the 19 proposed sale of said real property. 20 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 21 OF SAN BERNARDINO, AS FOLLOWS: 22 SECTION 1. That the sale of that certain real property approximately 965 square feet 23 24 located at 1350 South "E" Street in said City, more fully described in a Quitclaim Deed to the 25 San Bernardino Valley Municipal Water District, a copy of which is attached hereto as Exhibit 26 "A" and incorporated herein, is hereby approved in the amount of$1,350.00. 27 28 Rev. 09/14/98 RESOLUTION APPROVING SALE OF CERTAIN REAL PROPERTY APPROXIMATELY 965 SQUARE I FEET LOCATED AT 1350 SOUTH"E"STREET 2 SECTION 2.
