A RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE VACATION OF
2 THAT PORTION OF PINE AVENUE BETWEEN KENDALL DRIVE AND INTERSTATE HIGHWAY
15E, IN THE CITY OF SAN BERNARDINO AND RESERVING PUBLIC UTILITY EASEML.NTS
3 IN A PORTION THEREOF.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:

SECTION 1 . The Mayor and Common Council of the City of San Bernar-

dino, having heard the evidence offered in relation to the proposed vacation
7
of that portion of Pine Avenue between Kendall Drive and Interstate Highway
8
i 15E, more particularly described in City Resolution of Intention No. 30-199,
9
hereby find from all of the evidence submitted that such portion of Pine
10
Avenue between Kendall Drive and Interstate Highway 15E proposed to be vaca-
ted by said resolution is unnecessary for present or prospective publ':c

street purposes,

SECTICN 2. The Mayor and Common Council of said City do hereby order

the vacation of that portion of Pine Avenue between Kendall Drive and Inter-
15
state Highway 15E San Bernardino, California, more particularly described
16
l' as follows:

That portion of Pine Avenue, as same now exists, 50 feet wide anj
18 lasing within Blocks 42 and 46, Irvington Land and Water Company's Subdivi-
sion as per plat thereof recorded in Book 1 of Records of Survey, page 32,
19 records of the County Recorder of San Bernardino County, State of 'California ,
described as follows:

Beginning at the intersection of the East line of saia Pine Av:�nue
21 1 and the Southwesterly line of Kendall Drive, 80.00 feet wide; thence South
along said East line of Pine Avenue to the Northeasterly line of I=nterstate
22 Highway 15E; thence Northwesterly along said Northeasterly line to the '.!as't.
line of said Pine Avenue; thence North along said West line to the South--
23 i westerly line of said Kendall Drive; thence Southeasterly along said South-
westerly line to the Point of Beginning.

SECTION 3. This Resolution shall reserve, and nothing herein shall
27 I in any way affect or disturb, each and every existing easement for sanitary
28 sewer and appurtenant facilities and for public utility purposes belonging

1 either to the City of San Bernardino or to any public utility and there is

further reserved for present and future general public utility purposes and
3 for this City an easement reasonably necessary to locate sanitary sewer,
4 public utility and appurtenant facilities over, in, under or across the
5 North 30.00 feet, as measured at right angles to the Southwesterly lire of
6 Kendall Drive, and the East 25.00 feet of the real property described
7 hereinbefore along with the right to use, install , maintain, repair, re;, lace
8 or renew such facilities and those reserved by Resolution of Intention
9 No. 80-199 .
10 SECTION! 4. The City Clerk of the City of San Bernardino shall cause
11 a certified copy of this resolution to be recorded in the office of the
12 County Recorder of the County of San Bernardino.
13 I HEREBY CERTIFY that the foregoing resolution was duly adopted by
14 the Mayor and Common Council of the City of San Bernardino at a
15 meeting thereof held on the — /4� Clay of
