B2— 2 RESOLUTION OF THE CITY OF SAN BERNARDINO MAKING APPLICATION TO TEE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO FOR THE 3 ANNEXATION OF UNINHABITED TERRITORY LOCATED SOUTH OF CENTRAL AVENUE, EAST OF VALLEY VIEW AVENUE, AND DETACHMENT FROM COUNTY SERVICE AREA NO. 38, IMPROVEMENT 4 ZONE G OF CSA NO. 38, COUNTY SERVICE AREA NO. 70, AND IMPROVEMENT ZONE A OF CSA NO. 70. 5 WHEREAS, the Mayor and Common Council as the governing body of the 6 City of San Bernardino are initiating proceedings for a change of organization 7 (annexation) pursuant to Government Code Part 2 of Division 2 of Title 4, 8 Section 35000, et seq. , 9 NOW, THEREFORE, the Mayor and Common Council do hereby resolve, 10 determine and order as follows: 11 SECTION 1. Application and a proposal is hereby made to the Local 12 Agency Formation Commission of the County of San Bernardino for the annexation 13 of uninhabited territory located south of Central Avenue, east of Valley 14 View Avenue, and the detachment from County Service Area No. 38, Improvement 15 Zone G of CSA No. 38, County Service Area No. 70, and Improvement Zone A of 16 CSA No. 70, as outlined in the justification form marked Exhibit "A", and the 17 � plan and narrative marked Exhibit "B", which are attached hereto an 18 incorporated by reference as fully as though set forth at length herein. 19 20 SECTION 2. The territory proposed to be annexed is contiguous to the corporate limits of said City, and also substantially surrounded by the City of San Bernardino. 2. The incorporation of this territory will help contribute to and facilitate the orderly growth and development of the existing City area and the territory proposed to be annexed. This proposed annexation is within the sphere of Influence for the City of San Bernardino. 3. This annexation will also help to provide a uniform and orderly manner of growth, planning and zoning of lands, and the subdivision of lands therein in such a manner most conducive to the welfare of said City and the area proposed for annexation. The City of San Bernardino has planned for providing all typical City services to the area under consideration for annexation. The following is an enumeration and description of services which will be extended to the affected territory, which describes the level and range of such services that will be provided, as well as the feasibility of extending such .services and any improvements that will be required by the City, along with a description of when the service will commence and the financing of such im- provements and services and any condition imposed by the City: 1. Planning, Zoning, Code Enforcement and Building Inspection - The City shall provide these services in conformance with appropriate government codes and City Ordinances as well as following the City's General Plan for zoning and subject to the provisions of Land Use Ordinance No. 1991. This function is supported by City taxes and appropriate zoning, building and permit fees. 2. Parks and Recreation - The area proposed for annexation will have no ice impact on park or recreational facilities or programs, and no additional will be required as a result of the annexation. The cost to the taxpay the proposed annexation will be collected through the City taxes, and by required fees charged to those individuals who wish to participate in City sponsored recreational activities where charges and fees are applicable. Mill Community Center is approximately one-quarter of a mile west of this proposed annexation. 3. Library Service - It is important to note that the resources of the entire library system are readily made available to the proposed annexation, including the Downtown Central Branch. 4. Public Safety, Police - The San Bernardino Police Department is author- ized a camplement of 199 sworn officers and approximately 63 civilians not counting 53 school crossing guards. The Patrol Division maintains a 12 beat or section split of the City. The Patrol Division presently averages 15 police units on patrol 24 hours a day, supervisory and traffic personnel. The Detective Division has 30 sworn officers and works from 8:00 a.m. to 5:00 p.m. daily, Monday through Friday. The Services Division maintains all records and identification and provides support services to the other two divisions on a 24 hour a day basis. 5. Public Safety, Fire, Paramedic and Rescue - Fire protection service - grill continue upon annexation and the affected residents will be provided with a Class 3 rated Fire Department with ten (10) different fire stations to respond. A typical structural fire on the first alarm deploys two (2) engine companies, one (1) ladder truck company, a paramedic squad and one (1) Battalion Chief. In addition to fire protection, the City also has a minimami of three (3) paramedic units on duty 24 hours a day, each unit has two (2) paramedics each, giving a to- tal of six (6) paramedics on duty at all times. Also, the City is equipped with helicopter assistance for rescue and/or evacuation service when required. 6. Public Safety, Ambulance Service - The City of San Bernardino under Ordinance No. 1987 franchise to Courtesy Ambulance Company as the only medical transportation carrier within the City limits. The rates are established by the above ordinance and said fees are paid by the user. 7. The treatment, disposal and reclamation of wastewater is processed by the City of San Bernardino's Treatment Plant. No future extension or upgrading of services is foreseen at this time unless such a request is made at which time additional charges would then be passed onto the customer requesting this change. Such changes would be in accordance with the Water District's ordinance. 8. Liberty and T.V. Cable - These companies presently provided services to this area, upon property owners request. 9. Public Utilities: Electricity, Gas and Telephone Service - These services are currently provided to the project area. The City will allow service to con- tinue upon annexation under the present franchise agreements between the various utility companies. The rate structure and cost to the property owners are controlled by the Public Utilities Commission and any e_%pansion of future service will be created by the request of developer and/or property owners. 10. Solid Waste, Collection and Disposal - When the area is annexed and ; developed, the City will provide service at that time. Also, if upon request the City will provide refuse service to the existing customers, or at the end of the 5 year cancellation .period, whichever comes first. 11: Transit - Upon annexation, the bus service provided for this area will remain under the control of Qrmi:trans. Qrmitrans' long range transit plans are at the request of residents in the area through their Councilmra.n or directly to Cmnitrans. Such change must have approval of the City Council. The Short Range Transit Plan calls for continuation of the present service levels on these routes. Service level changes are made twice yearly, in January and June, and are initiated at the request of the City Council and/or Cnnitrans planning staff. .• 3r
