HomeMy WebLinkAbout1980-181 I RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE LEASE OF 85 PARKING SPACES LOCATED ON THE SOUTHWEST CORNER OF THE 3 FOURTH LEVEL OF THE 5 LEVEL PARKING STRUCTURE WITHIN THE MEADOW- " BROOK/CENTRAL CITY PROJECT AREA TO H. FRANK DOMINGUEZ , dba 4 VANIR RESEARCH COMPANY, BY THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO (HEALTH & SAFETY CODE SECTION 33433) . 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 6 OF SAN BERNARDINO AS FOLLOWS : 7 SECTION 1. Recitals. 8 (a) The Redevelopment Agency of the City of San Bernardino 9 proposes to lease to H. Frank Dominguez , dba Vanir Research 10 Company, hereinafter referred to as "Developer" , 85 parking 11 spaces located on the southwest corner of the fourth level of the 12 5 level parking structure within the Meadowbrook/Central City 13 Project Area, described in Exhibit "A" attached hereto and 14 incorporated herein by reference as though set forth in full , 15 for the sum of $22 , 950. 00; 6 (b) Notice of the time and place of hearing has been given as required by law; ,1- (c) The Redevelopment Agency has made available for public inspection and copying a summary of financial aspects of 2 the proposed sale; (d) The summary of financial aspects represents that the 22 fair market value of the interest to be conveyed determined at Z 'the highest use permitted under the plan is $127 ,500. 00; and 24 (e) All hearings have been heard as required by Health 25 and Safety Code Section 33433 . SECTION 2 . Determination. Based upon the representations ? lof the Redevelopment Agency of the City of San Bernardino, it I x is found and declared that the consideration for said real i I property, in accordance with covenants and conditions governing 2 such sale, is less than the fair market value of the property 3 determined at the highest use permitted under the plan. The 4 explanation for the difference is as follows : 5 (a) The Redevelopment Agency and City have concluded that 6 the loss of business at the building located on the northeast 7 corner of Second Street and "E" Street, hereafter called "Building" , g is due in part to inadequate parking facilities for the occupants 9 of said Building and their customers and that it is not feasible 10 to renovate said Building and increase its attractiveness to lx businesses so that first class commercial, retail and office 12 users will locate in said building unless adequate parking 13 facilities are provided for. 14. (b) Developer has agreed to renovate said building for 115 first class commercial, retail and office users, provided 16 satisfactory arrangements are made for adequate parking facilities ,r to accommodate such users. (c) Developer is unable to obtain the necessary financing from any lending agency unless adequate parking is designated and ti set aside for the use by the Building' s tenants and their customers. . i (d) Both the City and the Redevelopment Agency have found 2 that providing satisfactory arrangements for parking for the users 23 of said Building is in the best interests of the public and for the revitalization of "E" Street and as part of the redevelopment i t°ti of the Central City Project Area, which will generate tax monies i for the City and the Redevelopment Agency, and wish to induce ' Developer to renovate said Building and to attract first class ! users. a k -2- f I I SECTION 3. Approval. The Mayor and Common Council of the 2 ! City of San Bernardino hereby approve the lease of said property I 3 jupon the terms, conditions, and for the reasons set forth herein. i 4 I HEREBY CERTIFY that the foregoing resolution was duly 5 ; adopted by the Mayor and Common Council of the City of San 6 !
