6 SECTION 1. The Malrcr of :..hc City of San Bernardino is
7 hereby authorized and. directed to e� ( cute on behalf of said City
8 an agreement with the Housing Authoritv of Sari Bernardino County
9 for the use of supplemental Community Development Block Grant

10 i funds to purchase a public housinc; site , a copy, o` which is
11 attached hereto , marked Exhibit "A" and incorporated herein by
12 reference as fully as though set torte at lenctth.
13 I HEREBY CERTIFY that the foregoing resolution was duly
14 adopted by the Mayor and Common Ccuncil of the City of San Bernardino

2 (public housino site acquisition)
? THIS AGREEMENT is entered into between the CITY OF SAN
4 BERNARDINO , a municipal corporation, referred to as "City" , and
S the HOUSING AUTHORITY OF THE COUNT" OF SAN BERNARDINO , referred
6 to as "Housing Authority" .
7 City and Housing Authority agree as follows :

g 1 . Pecitals. I
g (a) City has applied for and received in conjunction
20 with the County of riverside and the County of San Bernardino, a
11 supplemental Community Development Block C'rant from the U. S.
i
12 Department of Housing and Urban Development (HUD) for the purpose
IJ of public housing site acquisition , and
1 (b) The Housing Authority; is approved by HUD and the
45 City for development and ownership of public housing units , and
16 (c) The Housing Assistance Plan for the City indicates
17 the need for new construction of public housinq units , and
(d) The Hous.incr Authority, in order to secure property
t9 in conjunction with the development of specific public housing
projects , requires funding to execute purchase and/or option agree-
ments , and

(e) Adequate fundinc, for purchase and/or option funds '

! cannot be secured in a. timely manner from HUD Pr.elimi.nary Loans

or any, source other than the Cit,-' s supplemental Community Develop-!-
ment Block Grant, and
(f) The Housing Authority agrees to comply with all
provisions contained in the supplemental Community Development

2 2. The City ' s supplemental Community Development Block
3 Grant, upon written request and approval , may be utilized by the
4 Housing Authority for public housing site acquisition including
5 purchase or option costs, appraisal fees, soils tests and engi_neer-
6 ing fees, and any other property acquisition costs allowed for
7 under Community Develocxmtent Block Grant regulations.
8 3, All sites proposed for purchase/option by the Housinc
9 Authority shall be in priority new construction areas of the City ' s
10 Housing Assistance Plan.
11 4 . The Housing Authority' s written request for use of
12 supplemental CDBG funding shall include the following items :
13 (a) Completed HUD Form #52651 Preliminary Site Report.
14 (b) The Housinc, Authority' s certification that pre-
S, liminary screening and informal site approval by HUD personnel for
16) each specific site has been completed.
17 (c) Copies of the Purchase/option agreements on each
specific site proposed.
(d) Evidence of the Housinq Authority's compliance
with the Property Acquisition Regulations as described in 24CFR.
�i Part 42 of HULA Uniform Relocation Act Regulations for each
22 specific site.
2,13 (e) Copies of associated property acquisition billings
24 including appraisal fees , soil tests and engineering costs, etc,
25 (f) Certi -ication by the Housina Authority that
purchase of the sites proposed is it conjunction with a Public
Housina Development Program currently beincl. reviewed or to be
submitted to HUD, or for the purpose of land bankinn of public

I housing sites.

2 5. Approval of the use of supplemental CDBr- zunds by the
i
3 Housing Authority is subject to environmental clearance and HUD
i
4 approval of release of funds for each site.
5 6. The Housing: Authority agrees to remit to the City all
6 costs of propertlY7 acquisition which were paid from the supplemental;
7 CDB(" funds subsequent to the execution of an Annual Contributions
i
g Contract (ACC) with HUD, except where the City has specifically
9 approved use of a portion of these funds for acquisition costs
10 which exceed the amounts that may be reimbursed out of ACC funds
I
11 (i .e. , land cost wr .tedowns) .

12 7. In the event an ACC is not executed on sites which
13 , have been acquired using supplemental CDB(, funds, at the discretion
"t4 of the City, the Housing Authorit-y shall undertake one or more
of the following actions :
r6 (a) Deed ownership of-. all sites purchased with CDBG
1 funds but not approved by HUD to the City.
(b) Retain ownership of unused sites for future public
housing development.
(c) Remit all recovered property purchase/option/

acquisition monies back to the City.
2 !' (d) Take any additional actions deemed necessary.

8 . This agreement shall be in effect for a period of five ;
jyears after the date of its execution and may be renewed thereafter i
25 ;upon mutual agreement of both parties.
