Home My WebLink About1980-163 RESOLUTION NO. —/ A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR- DINO, A MUNICIPAL CORPORATION, ACCEPTING AN EASEMENT FROM THE BOARD OF EDUCA- TION, SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That the City of San Bernardino does hereby accept an easement from the Board of Education, San Bernardino City Unified School District for a valuable consideration, receipt of which is hereby acknowledged; said real property is located: Parcel No. 1 : the west 5 feet of the east 190.77 feet of Lot 23, Block 23, Rancho San Bernardino, as per Plat thereof recorded in Book 7 of Maps, at Page 2, records of the Recorder of San Bernar- dino County. Parcel No. 2: the south 15 feet of the east 190.77 feet of Lot 23, Block 23, of said Rancho San Bernardino, and that the acceptance of this easement is necessary for pipeline purposes and appurtenant facilities and maintenance thereof in, over, under and across the above property as described. SECTION TWO: That a copy of said easement is attached hereto, marked Exhibit "A" , and made a part hereof as fully as though set forth at length herein. SECTION THREE: That all property affected by this transaction will be designated for Water Department use. BE IT FURTHER RESOLVED that a copy of this Resolution be attached to said easement, and that the same be recorded in the office of the County Recorder of San Bernardino County. Wessel , Secretary Board of Water Commissioners SUBJECT: SUBSTITUTION OF EASEMENT FOR WATER SERVICE -- MUSCOTT ELEMENTARY SCHOOL -- ACCEPTANCE OF NEW EASEMENT PROPOSED ACTION: Approval of Resolution providing for the acceptance of an easement from the Board of Education, San Bernardino Unified School District. BACKGROUND INFORMATION: An original easement was received from the school district to allow for a water main installation at 6th and Muscot on school property. Based upon having received the easement, the water main installation was com- pleted. Due to physical barriers at the 6th and Muscot site location, the actual water main installation did not conform to the easement as written. The actual installation was accomplished immediately adjacent, but easterly of the actual easement received. Therefore, it is appropriate to accept an easement that does conform to the installation and by appropriate action quit claim the original easement back to the school district.
