AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF PROGRAM SUPPLEMENT NO. 13 TO LOCAL AGENCY-STATE AGREEMENT NO. 08-5033 FOR LOCAL AGENCY FEDERAL- 3 AID SAFETY IMPROVEMENT PROJECTS, BETWEEN SAID CITY AND THE STATE OF CALIFORNIA, ACTING BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION. i BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 I SAN BERNARDINO AS FOLLOWS: j 6 ii � SECTION 1 . The Mayor of the City of San Bernardino is hereby 7 authorized and directed to execute on behalf of said City Program I I $ Supplement No. 13 to Local Agency-State Agreement No. 08-5033 for i Local Agency Federal-Aide Safety Improvement Projects, between said i0 City and the State of California, acting by and through its Department 11 of Transportation, a copy of which is attached hereto marked Exhibit 12 "A" and incorporated herein by reference as fully as though set forth I 13 at length herein. � 14 I HEREBY CERTIFY that the foregoing resolution was duly adopted 15 by the Mayor and Common Council of the City of San Bernardino at a 16 ---. meeting thereof, held on the day of i 17 1980, by the following vote, to-wit: 18 AYES: Couq cilmen: ;. 19 `� � I 20 NOES: 21 ABSENT: I 22 23 f 24 SHAUNA CLARK, City Clerk ! 25 The foregoing resolution is hereby approved this day of (_9 26 27 Approve s to form: C�;0/ 0- City o San Bernardino 28 City Atto ney Date February 19, " 19 8 0 Program Supplement No. 13 To Master Agreement No. 08-5033 City of Local Agency San Bernardino Project Number HES-R0 5 7 (4) SPECIAL COVENANT for use of Item 169 . 1 Funds to match Federal Bridge Replacement, Highway Safety and Safer Off-System Funds . Funds required to match .Federal Highway Funds in the project will be provided by the State as authorized by Item 169 . 1 of the Budget Act of 1979 and allocated by the California Transportation Commission. In the event Item 169 . 1 funds less than the amount shown are required as a result of a low bid, the excess will be returned to the Statewide reserve . In the event . Item 169 .1 funds greater than the amount shown are required as a result of a high bid, the required amount may be added subject to the availability of .funds and provided said addition of funds can be made prior to the execution of the Federal-State Project Agreement. Item 169 .1 funds will not be available for increased project costs following the execution of the Federal-State Project Agreement. a ' After completion of the final cost accounting for a project, any unexpended Item 169 . 1 funds will revert to the Statewide reserve. As required by the California Transportation Commission Resolution for all recipients of 169 . 1 funds , the Local Agency shall report to the Commission prior to July 1, 1980 the uses made of the 169 . 1 funds ; how the recipient conformed with the uses permitted by the resolution, and how the local agency matching funds that were released were used.
