HomeMy WebLinkAbout1980-117 1 RESOLUTION NO. / 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE SECRETARY OF THE AIR FORCE 3 RELATING TO MUTUAL AID IN FIRE PROTECTION FOR NORTON AIR FORCE BASE. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 5 OF SAN BERNARDINO AS FOLLOWS : 6 SECTION 1. The Mayor of the City of San Bernardino is i 7 hereby authorized and directed to execute on behalf of said City j 8 an Agreement with the Secretary of the Air Force relating to 9 mutual aid in fire protection for Norton Air Force Base, a copy 10 of which is attached hereto, marked Exhibit "A" and incorporated 11 (', herein by reference as fully as though set forth at length. I I 12 II I HEREBY CERTIFY that the foregoing resolution was duly 13 ;' adopted by the Mayor and Common Council of the City of San 14 Bernardino at a meeting thereof , held 1 on the -%Z day of �, �r� / , 1980 , by the following 16 vote, to wit: AYES : Councilmen / NAYS: ABSENT: 22 City Clerk 23 The foregoing resolution is hereby appr ed his _ days 24 i of - 1980 . 2 o 9C Cit of San Bernardino : Approved as to form: 7 City AEPUFFney i !i AGREEMENT FOR MUTUAL AID IN FIRE PROTECTION This agreement, entered into this 15th day of Feb , 1980, between the Secretary of the Air Force, acting pursuant to the authority of the 42 U.S.C. (1856(A)) and San Bernardino Fire Department is for the purpose of securing to each the benefits of mutual aid in fire prevention, in the protection of life and property from fire, and in firefighting. It is agreed that: (1) On request to a representative of the Norton Air Force Base Fire Depart- ment by a representative of the San Bernardino Fire Department, firefighting equipment and personnel of the Norton Air Force Base Fire Department will be dispatched to any point within the area for which the San Bernardino Fire Depart- ment normally provides fire protection as designated by the representative of the San Bernardino Fire Department. (2) On request to a representative of the San Bernardino Fire Department by a representative of the Norton Air Force Base Fire Department, firefighting equipment and personnel of the San Bernardino Fire Department will be dispatched to any point within the firefighting jurisdiction of the Norton Air Force Base Fire Department as designated by the representative of the Norton Air Force Base Fire Department. (3) Any dispatch of equipment and personnel pursuant to this agreement is subject to the following conditions: (a) Any request for aid hereunder shall include a statement of the amount and type of equipment of personnel requested, and shall specify the loca- tion to which the equipment and personnel are to be dispatched, but the amount and type of equipment and number of personnel to be furnished shall be deter- mined by a representative of the responding organization. (b) The responding organization shall report to the officer in charge of the requesting organization at the location to which the equipment is dis- patched and shall be subject to the orders of that official. (c) A responding organization shall be released by the requesting organization when the services of the responding organization are no longer re- quired or when the responding organization is needed within the area for which it normally provides fire protection. (d) In the event of a crash of aircraft owned or operated by the United States or military aircraft of any foreign nation within the area for which the San Bernardino Fire Department normally provides fire protection, the Chief of the Norton Air Force Base Fire Department or his representative may assume full command on his arrival at the scene of the crash. (4) Reimbursement for costs of firefighting on federal property may be filed in accordance with 15 U.S.C. 2210. (5) All equipment used by San Bernardino Fire Department in carrying out this agreement will, at the time of action hereunder, be owned by it; and all personnel acting for San Bernardino Fire Department under this agreement will, at the time of such action, be an employee or volunteer member of San Bernardino Fire Department.
